Regulations of Shenzhen Special Economic Zone on Qianhai Shekou Pilot Free Trade Zone

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Outline of Guangdong-Hong Kong-Macao Greater Bay Area Development Plan, Regulations of China (Guangdong) Pilot Free Trade Zone and the basic principles of relevant laws and administrative regulations in order to promote the construction and development of Shenzhen Qianhai Shekou Area in China (Guangdong) Pilot Free Trade Zone, continuously improve the level of trade and investment liberalization and facilitation, build an institutional system adapted to the development of open economy, and promote the construction of Socialism with Chinese characteristics Experimental Demonstration Zone in Guangdong-Hong Kong-Macao Greater Bay Area and Shenzhen. Article 2 These Regulations shall apply to the Shekou area in Qianhai, Shenzhen, the China (Guangdong) Pilot Free Trade Zone approved by the State Council and the expanded area approved by the State Council (hereinafter referred to as the Free Trade Zone). Article 3 FTZ should pay attention to system integration and innovation, create a market-oriented, rule-of-law and international business environment, build a new open economic system, promote in-depth cooperation between Guangdong, Hong Kong and Macao, and build itself into a new highland of reform and opening up in the new era and a high-level free trade pilot zone with international influence with convenient investment and trade, prominent radiation-driven role, safe and efficient supervision and a more perfect rule-of-law environment. Article 4 The construction and development of a free trade zone shall adhere to the principles of opening wider to the outside world, reform and innovation, and promoting free trade. Chapter II Management System Article 5 FTZ shall establish a management system with consistent powers and responsibilities, departmental cooperation, efficient operation, openness and transparency in accordance with the principles of open innovation, simple administration and decentralization, combination of management and administration, and optimization of services. Article 6 The Bonded Zone Management Committee (hereinafter referred to as the Administrative Committee) is an agency of the Municipal People's Government and performs the following duties:

(1) Promoting FTZ development, reform and system innovation as a whole, and formulating, drafting and organizing the implementation of FTZ development plans and policies and measures;

(two) responsible for the bonded area investment, trade, finance, talent, science and technology and other related administrative management and public services;

(three) responsible for FTZ planning, urban construction and other specific affairs, and promote the FTZ industrial layout and the introduction and construction management of major investment projects;

(four) to coordinate the administrative work of FTZ tax, financial supervision, customs, maritime affairs and other departments;

(five) to organize the implementation of credit management and supervision information sharing;

(six) to perform the relevant duties of national security review and anti-monopoly review according to law;

(seven) to perform other duties entrusted by the people's Government of the State Council, Guangdong Province and the Municipal People's Government.

With the approval of the Municipal Organization Department, the CMC may set up a working department with administrative functions to perform relevant duties externally.

The authority division of FTZ approved by the State Council to expand the regional scope shall be formulated separately by the Municipal People's Government. Article 7 The Municipal People's Government may entrust the municipal administrative authority required for FTZ development to the Administrative Committee, and guide, coordinate and supervise the exercise of the entrusted authority. Article 8 The Municipal People's Government shall study FTZ's policies and development plans as a whole, decide on major issues of FTZ's development, guide the pilot reform work, and coordinate FTZ's affairs concerning China, Guangdong, Hong Kong and Macao.

The relevant departments of the Municipal People's Government and the people's governments under their jurisdiction shall, within the scope of their respective duties, undertake the management duties of the bonded area according to law. Article 9 Shenzhen Qianhai Local Financial Supervision Administration shall exercise FTZ-level local financial supervision and management power, perform corresponding administrative licensing, administrative punishment, administrative compulsion, administrative inspection and other duties, be responsible for the overall planning, coordination, statistics and investigation of FTZ local financial management, and may formulate relevant supervision systems that try first.

Shenzhen Qianhai Local Financial Supervision Administration can carry out pilot projects of comprehensive financial supervision supported by cooperative supervision and collaborative supervision, and explore the construction of cross-border financial innovation supervision zones. Article 10 FTZ comprehensive administrative law enforcement organs shall, according to law, exercise administrative punishment, administrative coercion and administrative inspection in the management fields of commerce, intellectual property rights, market supervision and management, transportation, ecological environmental protection, water affairs, labor supervision, culture (including press and publication, radio, film and television, copyright), urban management, natural resources, production safety and so on. Article 11 FTZ integrity supervision institutions shall perform supervision duties on the development, construction, operation and management of FTZ according to the authorization of Shenzhen Municipal Supervision Commission. Twelfth tax, financial supervision, customs, maritime affairs and other departments should support the development of FTZ within the scope of their respective duties.

Establish FTZ financial supervision coordination mechanism with the participation of national financial supervision department in Shenzhen, municipal local financial supervision department and Shenzhen Qianhai Local Financial Supervision Administration. Article 14 Learn from the industrial management mechanism of Hong Kong and Macao, promote the convergence with industrial standards and management rules of Hong Kong and Macao, give full play to the role of industrial associations and chambers of commerce in formulating technical standards and standardizing industrial development, and strengthen the self-discipline management of industries in the Free Trade Zone.

Encourage international industrial and standard organizations to set up residence in the FTZ, cancel the pre-approval of the competent business unit when applying for establishment registration, simplify the registration process, allow them to recruit members worldwide, and manage them in accordance with the relevant provisions of the Regulations of Shenzhen Special Economic Zone on Industry Associations.
