A case of compensation after tibia and fibula fracture in children

Legal analysis: Xiaoyu (10 years old) and his mother went to a children's playground to pay for play, and accidentally fell while playing trampoline, resulting in fractures of his right tibia and fibula.

After investigation, Xiaoyu's mother was not around when the accident happened, and there were no playground staff around. There is no protective device around the trampoline involved. Warning signs accompanied by parents are posted in the business premises.

Xiaoyu was sent to hospital for treatment and spent more than 20,000 yuan. Afterwards, Xiaoyu filed a lawsuit with the court, demanding that the playground be liable for compensation.

Legal basis: Article 179 of the Civil Code of People's Republic of China (PRC) infringes upon others and causes personal injury, it shall compensate the reasonable expenses for treatment and rehabilitation, such as medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies, and the income reduced due to absenteeism. If it causes disability, it shall also compensate for the cost of assistive devices and disability compensation; If death is caused, funeral expenses and death compensation shall also be paid.
