Regulations of Henan Province on Green Building

Chapter I General Provisions Article 1 In order to implement the concept of green development, promote the high-quality development of buildings, standardize green building activities, save resources, build high-quality green buildings, change the development mode of urban and rural construction, promote the peak of carbon dioxide emission and carbon neutrality in urban and rural construction, and improve the living environment, in accordance with the People's Republic of China (PRC) Building Law, the People's Republic of China (PRC) Energy Conservation Law, the Civil Building Energy Conservation Regulations and other laws and administrative regulations. Article 2 These Regulations shall apply to the planning, design, construction, operation, transformation, supervision and management of green buildings within the administrative area of this province.

The term "green building" as mentioned in these Regulations refers to high-quality civil buildings that save resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use space, and maximize the harmony between man and nature.

According to national standards, green buildings are divided into basic, one-star, two-star and three-star levels from low to high. Article 3 The development of green buildings shall adhere to the principles of overall planning, government guidance, market promotion, social participation, adaptation to local conditions and economic application. Article 4 The people's governments at or above the county level shall incorporate the green building work into the national economic and social development plan, formulate policies and measures, define the development goals, and incorporate the completion of the goals into the comprehensive performance evaluation system for high-quality economic and social development. Fifth people's governments at or above the county level shall be responsible for the guidance, supervision and management of green building work within their respective administrative areas.

The development and reform, science and technology, industry and information technology, finance, natural resources, ecological environment, transportation, water administration, market supervision, statistics, government administration, local financial supervision, taxation and other departments of the people's government at or above the county level shall, according to their respective functions and duties, do a good job in green building related work. Sixth people's governments at or above the county level shall encourage and support the research, development, demonstration, promotion, training and publicity of green building technology, and promote the progress and innovation of green building technology. Seventh people's governments at or above the county level may, in accordance with the relevant provisions of the state, commend and reward units and individuals that have made remarkable achievements in green building work. Chapter II Planning and Standards Article 8 The competent department of housing and urban-rural construction of the provincial people's government shall, jointly with the competent department of standardization of the province, formulate relevant local standards for green buildings and establish and improve the standard system for green buildings in accordance with national standards and in combination with the natural environmental conditions and economic development level of the province. Article 9 The competent departments of housing and urban-rural construction of the people's governments at the city or county level divided into districts shall organize the preparation of special plans for the development of green buildings in their respective administrative areas, and solicit opinions from the departments of development and reform, natural resources, industry and informatization, and market supervision. , approved by the people's government at the same level to the public.

The special plan for the development of green buildings should define the development goals of green buildings, key development areas, energy consumption limits of public buildings, new building technical routes and green transformation of existing civil buildings, and determine the targets and paths for carbon emission reduction.

The special planning for the development of green buildings shall conform to the overall planning of land and space, and be connected with relevant planning. Tenth districts of the city and county people's government departments in charge of natural resources should be the relevant requirements of the special planning for the development of green buildings into the regulatory detailed planning.

The competent department of natural resources of the people's government at the city or county level divided into districts shall, when transferring or allocating land, incorporate the requirements of green building grade determined by the planning conditions of construction land into the contract for transferring the right to use state-owned land or the decision on allocating state-owned land. Eleventh new civil buildings in urban planning areas should be built in accordance with green building standards, except for farmers' self-built houses.

Large-scale public buildings, office buildings of state organs, other public buildings invested by state-owned funds, and residential quarters with a construction area of100000 square meters or more shall be built in accordance with the green building standards of one star or above.

The term "large public buildings" as mentioned in these Regulations refers to public buildings with a single building area of over 20,000 square meters.

Encourage other civil buildings to build in accordance with the green building standards of more than one star.

The competent department of housing and urban construction of the people's government at or above the county level may, in accordance with the relevant provisions of the state and this province, improve the development level of green buildings, promote the large-scale and intensive development of green buildings, and promote the creation of green ecological cities and green communities. Chapter III Construction and Renovation Article 12 If the construction, design, construction, construction drawing design document review, supervision and other units need to carry out green building construction or renovation in accordance with the relevant plans such as the special plan for green building development, they shall implement it in accordance with the requirements of green building grades and standards. Thirteenth construction units in the feasibility study report or project application report, should include the building energy consumption, renewable energy utilization and building carbon emissions analysis report, and clear the green building grade and standard requirements; In the process of consultation, design, construction and supervision of bidding or entrusted construction projects, the green building grade and standard requirements of construction projects shall be clearly stated to the relevant units, and the implementation shall be organized; Strengthen the quality management of the whole process of green building construction and assume the main responsibility for the implementation of green building in the project. Fourteenth design units should design according to the grade and standard of green building, and the materials, components and equipment selected for the project should meet the requirements of green building standards.
