Article 1 In order to strengthen the management of urban construction waste, maintain the city appearance and environmental sanitation, and protect and improve the ecological environment, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the disposal activities such as the discharge, transportation, consumption and utilization of construction waste in urban built-up areas within the administrative area of this Municipality.

The built-up areas of towns, economic development zones and industrial parks where the people's governments at or above the county level are located, as well as other areas designated and announced by the people's governments at or above the county level for the discharge, transportation, consumption and utilization of construction waste, shall be implemented in accordance with the provisions of this Ordinance on urban built-up areas.

The term "construction waste" as mentioned in these Regulations refers to the waste soil, materials and other wastes generated by the new construction, reconstruction, expansion and demolition of various buildings, structures and pipe networks, as well as the repair and decoration of houses.

If the construction waste specified in the preceding paragraph belongs to hazardous waste, it shall be disposed of in accordance with relevant laws and regulations. Article 3 The municipal and county people's governments shall establish a coordination mechanism for construction waste management, study and solve major problems in construction waste management, coordinate and urge relevant departments to perform their duties of supervision and management according to law, and arrange special funds for construction waste management in the financial budget. Article 4 The municipal and county-level administrative departments of city appearance and environmental sanitation shall be responsible for the management of urban construction waste within their respective jurisdictions in accordance with their management authority.

City and county urban management law enforcement departments are responsible for the daily supervision and inspection of construction waste disposal, and punish illegal acts according to law.

City and county housing and urban construction, development and reform, public security, natural resources, ecological environment, transportation, water conservancy, market supervision and management, forestry and other departments within the scope of their respective duties, do a good job in the management of construction waste.

Township (town) people's government, street offices accept the guidance of the city, county-level city appearance and environmental sanitation administrative departments, responsible for the supervision and inspection of construction waste disposal activities within their respective jurisdictions. Article 5 Village (neighborhood) committees shall assist local city appearance and environmental sanitation management departments, township (town) people's governments and sub-district offices in the management and publicity of construction waste in their villages (communities), stop illegal acts in time, and report to local city appearance and environmental sanitation management departments, township (town) people's governments or sub-district offices. Article 6 The disposal of construction waste shall follow the principles of reduction, harmlessness and recycling, and whoever produces it shall bear the responsibility for disposal. Seventh people's governments at the city and county levels should encourage the development of new building methods, promote prefabricated buildings, carry out full renovation of buildings, and reduce the discharge of construction waste.

Construction units, construction units should be in accordance with the requirements of planning, environmental protection and other aspects, the local use of construction waste. Article 8 The people's governments at the city and county levels shall, in accordance with the requirements of green development, give priority to the development of construction waste recycling industries and promote the recycling of construction waste.

Government funds invested in urban environmental sanitation, municipal engineering, landscaping and other infrastructure projects should give priority to the use of construction waste comprehensive utilization products. Ninth construction waste generated by the project needs to be discharged outside the construction site, the construction unit shall apply to the administrative department of city appearance and environmental sanitation where the project is located before the project starts.

To apply for a construction waste discharge permit, the following materials shall be provided:

(a) construction waste disposal plan, including project name, construction address, types and quantities of construction waste, transportation enterprises, disposal sites and other matters;

(two) the construction waste transportation contract signed with the enterprise or individual that has obtained the construction waste transportation license;

(three) the certification materials issued by the disposal site or backfill site that has obtained the construction waste disposal permit;

(four) other materials as prescribed by laws, regulations and rules.

The administrative department of city appearance and environmental sanitation shall make a decision within five working days from the date of accepting the application. If the conditions are met, the license shall be granted; If it does not meet the requirements, the license shall not be granted, and the reasons shall be explained in writing to the applicant. Tenth in any of the following circumstances, there is no need to apply for a construction waste discharge permit:

(a) sporadic projects, individual self-built houses, house decoration, small-scale projects below the quota and cultural relics protection construction projects that do not need to apply for construction permits according to law;

(two) municipal sporadic engineering and maintenance;

(three) construction projects that need emergency construction due to special circumstances such as emergency rescue and disaster relief. Eleventh city appearance and environmental sanitation administrative departments should guide the township (town) people's government, street offices, property service enterprises, in accordance with the principle of convenient village (neighborhood) people, owners and cleaning, reasonable delineation and setting up construction waste dumps.

Construction waste generated by sporadic projects, individual self-built houses and house decoration. , the owner or the construction unit should implement anti-leakage measures such as bag collection and transport them to the construction dump by themselves.

Where property service management is implemented, the construction waste at the stacking point shall be transported by an enterprise or individual entrusted by the property service enterprise to obtain the transportation license for construction waste; If the village (community) and property service management are not implemented, the construction waste at the dumping point shall be removed by the relevant units designated by the administrative department of city appearance and environmental sanitation.
