The traffic administrative department of the public security organ shall determine the responsibility of the parties according to the role played by their actions in road traffic accidents and the severity of their faults.

For the elderly who don't run the red light while walking the crosswalk, the elderly are not responsible;

For the elderly who did not take the crosswalk line, but were already on the motorway, and the motor vehicle did not pay attention to the accident, the owner of the motor vehicle took the primary responsibility, and the elderly took the secondary responsibility;

When the motor vehicle approaches, the old man suddenly breaks into the motor vehicle lane and brakes suddenly, which can't avoid the accident. The responsibility of the old man shall be subject to the responsibility certificate issued by the transportation department.

On the determination of traffic accident responsibility;

Traffic accident responsibility is usually divided into five levels: full responsibility, primary responsibility, equal responsibility, secondary responsibility and no responsibility. The division of responsibilities for traffic accidents corresponds to each other, that is, all responsibilities correspond to no responsibilities, primary responsibilities correspond to secondary responsibilities, and equal responsibilities correspond to equal responsibilities.

Specific standards for the determination of traffic accident liability

Full responsibility and no responsibility

If a traffic accident is caused by one of the following circumstances, the parties shall bear all the responsibilities of the accident, and the other parties to the accident shall not bear the responsibilities:

1. If one party intentionally causes a road traffic accident, it shall take full responsibility, and the other party shall have no responsibility.

2. If a road traffic accident is caused by the fault of one party, and the other parties have no illegal acts, the party at fault shall bear all the responsibilities for the accident.

3. If the parties escape, resulting in changes in the scene and loss of evidence, and the public security traffic control department cannot verify the facts of the road traffic accident, the escaping parties shall bear all the responsibilities;

4. If the parties intentionally destroy, forge the scene or destroy the evidence, they shall bear all the responsibilities of the accident.

5. When a vehicle-related traffic accident occurs while driving a motor vehicle, if the parties fail to stop immediately and protect the scene, and the responsibility for the traffic accident cannot be determined, they shall bear full responsibility for the accident.

6. If a party has the conditions to report the case but fails to report it or fails to report it in time, thus making it impossible to determine the responsibility for the traffic accident, it shall bear full responsibility.

7. Neither party is at fault for causing road traffic accidents. If it is a traffic accident, neither party is responsible.
