As a lawyer, if you lose the lawsuit, how will you explain it to your client?

One is the arbitration case of construction disputes, and the details will not be disclosed, because the case is really complicated and it is unclear in a few words. The reason for losing the case is that I am not familiar with arbitration and construction disputes. I took the wrong case for money and made two mistakes. First, I was too careless in choosing an arbitrator. Second, I am not familiar with the substantive issues of construction projects. There is a major omission in the certificate. After losing the case, I honestly admitted my mistake to my client. Originally, I said that the lawyer's fee should be refunded, but the customer didn't want it, but this quality customer did it.

Let's learn a lesson. In the future, unfamiliar areas will not take orders. For example, when writing this answer, a classmate came to me and said that his father's pig farm would talk to the government about compensation, and if it was demolished, he would sue and let me help him deal with it. I didn't say anything. I paid a lawyer's fee of 654.38+10,000 yuan first, and said that I would pay it again according to the result after processing. The farmer friend in the basin is too simple. Although his heart is bleeding, he can only refuse.

There's nothing I can do. The needs of customers are too diverse. Since I switched to litigation, I have encountered various cases, such as intellectual property rights, labor disputes, private lending, traffic accidents, marriage inheritance, real estate disputes, construction projects, contractual management rights, criminal cases, administrative litigation, equity disputes, letters and complaints, anti-unfair competition, margin financing and securities lending disputes, and invoice correction. This is endless, much more interesting than no lawsuit.

Speaking of which, there are actually some problems with non-litigation. For example, I have a client who is engaged in overseas immigration and overseas real estate sales, and needs a lawyer to be a witness of the client's signature for a long time. A single lawyer's fee 1000 to 5000 can be tens or even hundreds from time to time, but there is no guarantee that all clients will sign in front of lawyers. Should I take this business?

There are also syndicated loans for listed projects, abs for new third board business, and debt issuance for state-owned enterprises.

Some big firms will solve this problem through internal cooperation, but when it comes to the partners of law firms robbing each other of business, there is a lot of gossip. Business at the partner level is divided into more private cooperation, and the real corporate system still has a long way to go in this industry.

Lawyers have a hard time in their early days. It is normal to be a tiger balm lawyer at this stage. This kind of lawyer also has the necessity of his existence, but after crossing the bottleneck of survival, he should start looking for a position. At this time, he should think about the choice, but it will not happen overnight. Take your time! I'm groping, too

The second situation is relatively simple. On behalf of the seller, it requires the buyer to pay the final payment of the equipment. The contract stipulates that the final payment shall be paid within 30 days after the goods are received and accepted. There is a complete factory and acceptance certificate, and there is no quality problem. The defendant is an oil industry company far away in the northeast. When the case was put on file, the court of the plaintiff's domicile refused to accept it on the grounds of agreed jurisdiction. The defendant went to the northeast, and the people's court of the defendant's domicile refused to accept it. The reason is that the oil industry companies there are under the jurisdiction of the oil court, so I learned that there is an oil court system besides the specialized maritime, railway and military courts in China, which was finally accepted by the oil court. The defendant's defense reason at the trial was that he was not sure whether there was any quality problem before the product warranty period expired, so he should pay the final payment after the ten-year warranty period expired, and then the court made a judgment according to the defendant's defense opinion ... I can only say that this case was learned, or a case I did during my internship, which is still fresh in my memory after so many years!

So far, except for two cases with special reasons, and cases in which the parties were clearly told that they might lose the case before signing the contract, they have never lost the case.

At the same time, I feel guilty that the judge's heart is as unfathomable as the sea. No matter how confident I am to win, no matter how many cases I have played, my heart will be pounding with anxiety until I see the verdict. Whenever this day comes, I really want to change careers, and the feeling of waiting for the trial is too painful.

The secret is to take the case seriously, not to take an uncertain case, but to tell the parties directly that they are uncertain and tell the truth.
