Equipment Rental Contract

Jiansheng Concrete Pumping Machinery Leasing Contract

Lessor: Rail Project Department (hereinafter referred to as Party A)

Lessor unit: Machinery and Equipment Leasing Department (hereinafter referred to as Party B)

Due to project construction needs, Party A rents concrete pumping machinery from Party B. In order to clarify the responsibilities of both parties, in accordance with the "People's *** "The Contract Law of the People's Republic of China" and relevant laws and regulations, upon mutual agreement between Party A and Party B, this contract is hereby signed to comply with it.

2. The rental fee is calculated according to the following charging methods: (all unit prices include tax)

1. 52-meter/48-meter boom pump truck: 20 yuan/m3, the delivery guarantee is 2120 yuan (4 hours), overtime is calculated at 530 yuan/hour, one shift is 4452 yuan (8 hours)

2. Vehicle-mounted pump (includes takeover); 15 Yuan/m3, the minimum guarantee for delivery is 1590 Yuan (4 hours), overtime is calculated at 350 Yuan/hour, one shift is 3074 Yuan (8 hours)

Remarks: Empty truck waiting time: no more than 2 hours, after 2 hours overtime, the 37-meter boom pump truck will be charged an additional 300 yuan/hour, the 48-meter and 52-meter boom pump trucks will be charged an additional 400 yuan/hour, and the vehicle-mounted pump will be charged an additional 300 yuan/hour.

3. Payment method:

1. At the end of each pumping, Party B’s actual pumping volume will be calculated based on the supply volume of the mixing station, and shall be determined by Party A or the relevant personnel at the construction site. The signature confirms the time and quantity of the pumped visa form, which serves as the settlement voucher for both parties.

2. Party A and Party B will check the monthly payment on the 25th of the month. After the verification is correct, both Party A and Party B will sign and confirm the reconciliation letter for that month. Within 10 days after confirmation by both parties, Party B is responsible for providing Party A with a formal tax invoice of the same amount for settlement, and Party A is responsible for settling all the expenses to Party B through bank transfer according to the monthly expenses confirmed by both parties.

IV. Rights and obligations of both parties:

1. Responsibilities of Party A:

①. Party A must notify Party B 24 hours in advance when using a pump, and will deliver the pump Inform Party B of specific parameters such as the location of the concrete, concrete grade, slump, and pumping volume, so that Party B can reasonably arrange the delivery.

②. Party A must strictly implement the requirements for pumping concrete. If there is a problem with Party A's concrete (such as too many stones and the slump does not meet the requirements), Party B's pump truck will be clogged with pipes. Party B is not responsible for any losses that result in the concrete being scrapped and unable to be poured.

③. Party A should do the preliminary work before pumping (such as site road safety and smoothness; go through relevant road occupation approval procedures. Party A is only responsible for any road occupation or noise at Party A's construction site. The fines imposed on Party B's pump truck equipment by urban management or environmental protection, traffic police, etc. caused by problems);

④. Any losses caused by Party A's construction shall be borne by Party A.

2. Party B’s responsibilities:

① Party B is responsible for arriving at the construction site according to Party A’s pump time requirements and cooperating with the work of on-site personnel.

②. Party B is responsible for all road traffic related matters before Party B’s equipment arrives at Party A’s construction site.

③. Party B’s operators must strictly abide by safe operations, and Party B is responsible for the safety of Party B’s pump truck equipment.

④. During the construction process, if a mechanical failure occurs in the pump truck, Party B must immediately carry out emergency repairs and notify Party A in a timely manner. If it cannot be repaired within a short period of time, Party B must negotiate with Party A to take effective solutions.

5. Liability for breach of contract:

1. If Party A fails to pay as agreed in the contract, Party B has the right to stop providing pump truck services and demand repayment of the owed money from Party A. From that date, liquidated damages will be collected at a rate of 5% of the arrears every day until the entire amount is paid in full. Before Party B’s pumping payment is paid in full, Party A cannot ask other pump trucks to pump.

2. If Party A unilaterally terminates the contract midway, it shall bear liquidated damages equal to 20% of the total payment for the unfulfilled portion of the contract.

VI. Handling of disputes

Dispute resolution methods: Disputes arising under this contract shall be resolved through negotiation by both parties. If the resolution cannot be resolved, the first method below may be used to resolve the dispute: < /p>

1. Apply to the Arbitration Commission for arbitration;

2. File a lawsuit with the People’s Court of the place where the lessee’s legal person is registered.

7. Contract Attachments

1. For matters not covered in this contract, both parties may reach a written supplementary agreement.

2. The attachments and supplementary agreements to this contract are integral parts of this contract and have the same legal effect as this contract.

8. Other Agreements

1. This contract is made in 4 copies. Party A and Party B each hold 2 copies, which have the same legal effect.

2. This contract will come into effect on the date it is signed and sealed by both parties. It will automatically terminate after both parties have completed their respective responsibilities and settled the contract payment.
