Who owns the land in China?

The basic principles of the "Land Management Law" are regulations.

The "Land Management Law" stipulates: The state encourages units and individuals to develop unused land in accordance with the overall land use plan and on the premise of protecting and improving the ecological environment to prevent soil erosion and land desertification.

Land that is suitable for development into agricultural use should be given priority. Rational development and utilization of land plays an important role in improving land utilization and output rates and increasing the effective supply of land products.

The "Land Management Law" stipulates: The state protects cultivated land, strictly controls the conversion of cultivated land into non-cultivated land, and takes measures to ensure that the total amount of cultivated land within the administrative region is not reduced.

If the total amount of cultivated land is reduced, the State Council shall order the reclamation of cultivated land equivalent to the quantity and quality of the reduced cultivated land within a specified period. It shall be inspected and accepted by the land administration department of the State Council together with the agricultural administration department.

Under the conditions of the socialist market economy, land has the dual attributes of resources and assets. Land has entered the market circulation as a special commodity. The implementation of paid use of land is conducive to rationalizing the relationship between land owners and land. The economic relationship between users is conducive to the rational use of land.
