Regulations of Guangxi Zhuang Autonomous Region on the Protection of Mangrove Resources

Chapter I General Provisions Article 1 In order to strengthen the protection and management of mangrove resources, protect biodiversity, resist marine natural disasters such as storm surges, and promote the improvement of coastal ecological environment, according to the Forest Law of People's Republic of China (PRC), the Law of the People's Republic of China on the Protection of Marine Environment, the Law of People's Republic of China (PRC) on the Use and Management of Sea Areas, the Regulations of People's Republic of China (PRC) Nature Reserve and other relevant laws. Article 2 These Regulations shall apply to the protection and management of mangrove resources within the administrative area of this autonomous region. Its protection scope includes:

(1) Mangrove Nature Reserve and Mangrove Conservation Community;

(2) Mangrove land, including mudflats and wetlands where mangroves grow, and mudflats and wetlands planned by people's governments at or above the county level for the restoration and development of mangroves;

(3) Mangroves growing in coastal intertidal zones and estuaries;

(4) Migratory birds and various wild animals and plants inhabiting, foraging and staying in mangroves.

The term "mangrove" as mentioned in these Regulations refers to the woody plant community in the tidal flat wetland, which is distributed in the coastal intertidal zone and the estuary of the autonomous region, with mangrove plants as the main body and evergreen shrubs or trees. Article 3 The protection and management of mangrove resources shall follow the principles of ecological priority, scientific planning, social participation, rational utilization and sustainable development. Article 4 The people's governments at the autonomous region, city divided into districts and county level where mangrove resources are located shall incorporate the protection and management of mangrove resources into the local national economic and social development plan, strengthen the leadership over the protection and management of mangrove resources, coordinate and solve major problems in the protection and management of mangrove resources, do a good job in the construction and management of mangrove nature reserves and mangrove protected communities, and incorporate the funds for the protection and management of mangrove resources into the fiscal budget at the corresponding level.

The township people's governments and sub-district offices where mangrove resources are located shall cooperate with the protection and management of mangrove resources within their respective jurisdictions, and prevent, stop and assist in the investigation and punishment of acts of destroying mangrove resources. Article 5 The competent forestry authorities of the people's governments at the city or county level in the autonomous region and where mangrove resources are located shall be responsible for the protection and management of mangrove resources within their respective administrative areas. Mangrove nature reserves shall be managed in accordance with the Regulations of People's Republic of China (PRC) on Nature Reserves and other relevant provisions.

The competent departments of development and reform, public security, finance, natural resources, ecological environment, construction, transportation, water conservancy, agriculture and rural areas, tourism, ocean, radio and television of the people's governments at the county level where mangrove resources are located shall, according to their respective functions and duties, do a good job in the protection and management of mangrove resources. Article 6 The village (neighborhood) committees where mangrove resources are located shall, according to local conditions, stipulate measures for the protection of mangrove resources in village regulations or residents' conventions, and assist the people's governments and relevant departments in the protection and management of mangrove resources. Seventh all units and individuals have the obligation to protect mangrove resources, and have the right to stop and report the destruction and occupation of mangrove resources.

The people's government at the county level where mangrove resources are located shall establish and improve the reporting system for acts of destroying mangrove resources, and announce the reporting telephone number to the public; If the report is verified, the whistleblower will be rewarded. Article 8 The people's governments of autonomous regions and cities and counties where mangrove resources are located shall establish a compensation system for mangrove ecological protection according to the needs of mangrove resources protection.

Due to the need to protect the mangrove ecology, resulting in the loss of the legitimate rights and interests of the relevant rights holders, the people's governments of autonomous regions, cities and counties divided into districts shall give fair and reasonable compensation in accordance with the relevant provisions; If it affects the production and life of the relevant right holders, it should also be properly arranged. Ninth people's governments at all levels and forestry, radio and television and other relevant competent departments should strengthen the publicity and education of mangrove resources protection, popularize the knowledge of mangrove resources protection, and enhance citizens' awareness of mangrove resources protection.

Radio, television, newspapers, internet and other media should carry out publicity work on the protection of mangrove resources. Tenth encourage citizens, legal persons and other organizations to participate in the protection of mangrove resources through investment, donation, species recognition and adoption.

Encourage scientific research institutions, institutions of higher learning and other relevant organizations or individuals to carry out scientific research, scientific popularization, technological development and international cooperation in the protection and utilization of mangrove resources, and popularize and apply advanced technologies. Chapter II Mangrove Resources Protection Planning Article 11 The competent forestry department of the Autonomous Region People's Government shall, jointly with the relevant competent departments of development and reform, natural resources, ecological environment, construction, transportation, water conservancy, agriculture and rural areas, tourism and ocean, formulate a mangrove resources protection plan for the whole region, and organize its implementation after being submitted to the Autonomous Region People's Government for approval.

The competent forestry department of the people's government at the city or county level where mangrove resources are located shall, according to the mangrove resources protection plan approved by the people's government at the next higher level, work out the mangrove resources protection plan in their respective administrative areas jointly with the relevant competent departments, organize the implementation after the approval of the people's government at the same level, and report it to the competent forestry department of the people's government at the next higher level and the relevant competent departments for the record. Twelfth mangrove resources protection planning should be based on the protection object and scope, resource status and ecological function, and clearly define the objectives and tasks of mangrove resources protection, safeguard measures, prohibited development and construction areas, restricted development and construction areas, protection, recovery and utilization methods. , and with urban and rural planning, land use planning, marine main functional area planning, forest protection and utilization planning, environmental protection planning, port planning and so on. , and incorporated into the multi-regulation compilation management.
