Criminal case inspection process

Legal analysis: generally, the investigation can't last more than two months. After the investigation, the case will be transferred to the procuratorate for review and prosecution. After the case is transferred to the procuratorate, the lawyer will begin to read the case file, collect and sort out the evidence, and present the defense opinions of the parties to the procuratorate. According to the law, when investigating a closed case, the public security organ shall ensure that the facts of the crime are clear and the evidence is true and sufficient, write a prosecution opinion, and transfer it to the people's procuratorate at the same level for examination and decision together with the case file and evidence; At the same time, inform the criminal suspect and his defense lawyer about the case transfer.

Article 46 The victim of a public prosecution case, his legal representative or near relative, the party involved in an incidental civil action and his legal representative shall have the right to entrust an agent ad litem from the date when the case is transferred for examination and prosecution. The private prosecutor and his legal representative in a private prosecution case, the parties involved in an incidental civil action and his legal representative have the right to entrust an agent ad litem at any time. The people's procuratorate shall, within three days from the date of receiving the case materials transferred for examination and prosecution, inform the victim and his legal representative or his near relatives, the parties involved in incidental civil litigation and his legal representative that he has the right to entrust an agent ad litem. The people's court shall, within three days from the date of accepting a case of private prosecution, inform the private prosecutor and his legal representative, the parties to an incidental civil action and his legal representative that they have the right to entrust an agent ad litem.

Article 162 When investigating a closed case, the public security organ shall ensure that the facts of the crime are clear and the evidence is true and sufficient, and write a prosecution opinion, which shall be transferred to the people's procuratorate at the same level for examination and decision together with the case file and evidence; At the same time, inform the criminal suspect and his defense lawyer about the case transfer. If a criminal suspect voluntarily pleads guilty, it shall be recorded and transferred with the case, and the relevant information shall be stated in the prosecution opinion.
