Chapter VII Publicity, Education and Scientific and Technological Progress of Earthquake Prevention and Disaster Reduction in Shandong Province

Article 51 People's governments at or above the county level and their relevant departments shall strengthen publicity and education on earthquake prevention and disaster reduction, establish a social mobilization mechanism for earthquake prevention and disaster reduction, mobilize social forces, and improve the awareness of earthquake prevention and disaster reduction and the ability to cope with earthquake disasters in the whole society.

The competent department of earthquake work of the people's governments at or above the county level shall guide, assist and urge the relevant units to do a good job in publicity and education on earthquake prevention and disaster reduction, earthquake emergency self-help and evacuation drills, and organize and carry out earthquake safety demonstration and pilot activities.

Fifty-second organs, organizations, enterprises, institutions, residents' committees, villagers' committees and other grassroots organizations shall organize publicity and education activities for earthquake prevention and disaster reduction, and carry out earthquake emergency self-help and evacuation drills.

Schools should popularize the knowledge of earthquake prevention and disaster reduction, organize necessary earthquake emergency rescue drills, cultivate the earthquake safety awareness of teachers and students, and improve the ability of emergency avoidance and self-help and mutual rescue.

Fifty-third people's governments at or above the county level and their earthquake, radio and television departments should expand the coverage of publicity and education on earthquake prevention and disaster reduction through radio, television, newspapers, internet and other news media and means of communication, and improve the effectiveness of publicity and education on earthquake prevention and disaster reduction.

The news media should take the initiative to carry out public welfare publicity activities such as earthquake prevention and disaster reduction, earthquake emergency avoidance, self-help and mutual rescue knowledge.

Article 54 The people's governments at or above the county level shall make overall use of social resources, strengthen infrastructure construction such as publicity and education bases for earthquake prevention and disaster reduction, exhibition halls for earthquake science popularization, and exhibition areas for earthquake science popularization in science and technology museums, and protect the remains of earthquake sites.

The people's governments at or above the county level and their seismological, scientific and technological departments, science and technology associations and other organizations shall strengthen the work of popular science on earthquake prevention and disaster reduction, incorporate the popularization of scientific and technological knowledge on earthquake prevention and disaster reduction into popular science planning, and organize popular science activities on earthquake prevention and disaster reduction.

Article 55 The provincial and district people's governments and their development and reform, science and technology departments shall incorporate major scientific research projects on earthquake prevention and disaster reduction into scientific development planning, support basic and applied research on earthquake prevention and disaster reduction, increase investment in scientific research, and give priority to solving key scientific and technological problems that restrict the development of earthquake prevention and disaster reduction.

The municipal people's governments of provinces and districts and their development and reform, finance, science and technology, housing and urban and rural construction, earthquake and other departments should strengthen the construction of scientific experimental infrastructure for earthquake prevention and disaster reduction, and provide basic conditions for scientific theoretical research and technical practice of earthquake prevention and disaster reduction.

The competent departments of seismic work of the people's governments of provinces and districts shall strengthen cooperation with institutions of higher learning, scientific research institutions and enterprises, make use of social scientific and technological resources, and improve the scientific and technological innovation ability of earthquake prevention and disaster reduction.

Article 56 People's governments at or above the county level shall encourage research, development and popularization of building structural systems and new technologies, new processes and new materials that are conducive to improving seismic performance.

Article 57 The people's governments at or above the county level and their relevant departments shall strengthen the construction of scientific and technological teams for earthquake prevention and disaster reduction, optimize the talent structure, cultivate and introduce leading and reserve talents for science and technology, strengthen foreign cooperation and exchanges for earthquake prevention and disaster reduction, broaden the fields and channels of exchanges, and follow up and learn the latest scientific and technological achievements of international earthquake prevention and disaster reduction.

Chapter VIII Supervision and Administration

Fifty-eighth people's governments at or above the county level and their relevant departments and units of earthquake, development and reform, housing and urban construction, land and resources, civil affairs, public security, transportation, railways, water conservancy, electric power, communications, etc. shall conduct special supervision and inspection on the following earthquake prevention and disaster reduction work:

(a) the preparation and implementation of earthquake prevention and disaster reduction planning;

(2) Construction of earthquake monitoring facilities and environmental protection for earthquake observation;

(3) Seismic safety evaluation of major construction projects;

(four) the implementation of seismic fortification requirements and mandatory standards for construction projects;

(five) to carry out earthquake zoning work;

(six) the preparation of earthquake emergency plans and earthquake emergency drills;

(seven) the construction and training of earthquake disaster emergency rescue team;

(eight) the planning, construction and management of earthquake emergency shelters;

(nine) the construction of earthquake relief command system and technical support system;

(ten) emergency rescue equipment and material reserve call system construction;

(eleven) measures to strengthen earthquake prevention and disaster reduction in key earthquake monitoring and defense areas;

(twelve) publicity and education on earthquake prevention and disaster reduction.

Article 59 The departments of health, food and drug supervision and administration, industrial and commercial administration, quality and technical supervision, and price of people's governments at or above the county level shall strengthen supervision and inspection of the quality and price of food, medicine, building materials and other materials needed for earthquake relief.

Article 60 The earthquake, finance, civil affairs and other relevant departments of the people's governments at or above the county level and audit institutions shall strengthen the supervision and management of the use of funds, materials and social donations for earthquake emergency rescue, post-earthquake transitional resettlement and recovery and reconstruction.

Article 61 The supervisory organs of the people's governments at or above the county level shall strengthen the supervision of the administrative organs for earthquake prevention and disaster reduction, organizations authorized by laws and regulations to manage public affairs and their staff.

Article 62 The competent department of earthquake work of the people's government at or above the county level and other departments exercising supervision and management functions in accordance with the provisions of these Regulations shall be punished according to law in any of the following circumstances:

(1) Failing to make an administrative license or handle the approval documents according to law;

(two) found illegal acts or received a report of illegal acts will not be investigated;

(three) beyond the authority to determine the seismic fortification requirements of construction projects, to determine or reduce the seismic fortification requirements without authorization;

(four) to disseminate earthquake prediction and prediction opinions to the society;

(five) other acts in violation of these regulations.

Sixty-third in violation of these regulations, not in accordance with the provisions of the construction of special earthquake monitoring network or strong earthquake monitoring facilities, the people's governments at or above the county level shall be ordered by the competent department of seismic work to make corrections within a time limit; If no correction is made within the time limit, a fine of 20,000 yuan to 200,000 yuan shall be imposed.

Article 64 If, in violation of these regulations, a construction project fails to carry out seismic safety evaluation according to law, or fails to carry out seismic fortification according to the seismic fortification requirements determined in the audited seismic safety evaluation report, the competent department of seismic work of the people's government at or above the county level shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 30 thousand yuan but not more than 300 thousand yuan shall be imposed.

In violation of these regulations, if a construction project fails to carry out seismic fortification according to the seismic fortification requirements determined by the competent department of seismic work of the people's government at or above the county level according to the seismic zoning results or seismic parameter zoning map, the competent department of seismic work of the people's government at or above the county level shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than five thousand yuan but not more than fifty thousand yuan shall be imposed.

Sixty-fifth in violation of these regulations, the seismic safety evaluation unit has one of the following acts, the competent department of seismic work of the provincial people's government shall order it to make corrections within a time limit, confiscate the illegal income, and impose a fine of not less than ten thousand yuan but not more than fifty thousand yuan; If the circumstances are serious, the qualification certificate shall be revoked according to the relevant provisions:

Engaging in seismic safety evaluation activities beyond the scope of qualification;

(two) engaged in seismic safety evaluation activities in the name of other seismic safety evaluation units;

(three) allowing other seismic safety evaluation units to engage in seismic safety evaluation activities in the name of their own units;

(four) failing to submit the seismic safety evaluation report to the construction unit in accordance with the provisions or failing to pass the evaluation.

Article 66 If a unit that violates the provisions of these Regulations and fails to obtain the qualification for seismic safety evaluation engages in seismic safety evaluation activities without authorization, the competent department of seismic work of the people's government at or above the county level shall order it to stop the illegal act, confiscate its illegal income and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan.

In violation of these regulations, the seismic safety evaluation unit outside the province fails to go through the registration procedures for seismic safety evaluation activities in this province, and the competent department of seismic work of the people's government at or above the county level shall order it to make corrections; If no correction is made within the time limit, a fine of not less than three thousand yuan but not more than thirty thousand yuan shall be imposed.

Article 67 Where unregistered seismic safety evaluators engage in seismic safety evaluation activities in the name of registered practitioners in violation of the provisions of these Regulations, the competent seismic work department of the provincial people's government shall order them to stop the illegal acts, confiscate their illegal income and impose a fine of more than 2,000 yuan and less than 20,000 yuan.

Whoever, in violation of the provisions of this Ordinance, forges, leases, transfers or sells a registered practice certificate or a special seal for registered practice shall be ordered by the competent department of earthquake work of the provincial people's government to stop the illegal act, confiscate the illegal income and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan; If the circumstances are serious, it shall be ordered to stop practicing or revoke its registered qualification.

Article 68 Whoever, in violation of the provisions of these Regulations, creates, spreads and disseminates earthquake rumors in post-earthquake transitional resettlement, recovery and reconstruction, which disturbs social order and constitutes a violation of public security administration, shall be punished by the public security organs according to law.

Article 69 If the people's governments at or above the county level in the earthquake-stricken areas report the earthquake situation and disaster situation late, falsely report or conceal it, the people's governments at higher levels shall order them to make corrections, and the directly responsible personnel in charge and other directly responsible personnel shall be punished according to law.

Article 70 Whoever embezzles, intercepts or misappropriates funds and materials for earthquake emergency rescue, post-earthquake transitional resettlement or post-earthquake recovery and reconstruction shall be ordered by the financial department, auditing organ and supervisory organ to make corrections and recover the embezzled, intercepted and misappropriated funds and materials; Illegal income, confiscate the illegal income; Give a warning or informed criticism to the unit, and punish the directly responsible person in charge and other directly responsible personnel according to law.

Seventy-first acts in violation of these regulations, laws and regulations have provisions to deal with, such provisions shall apply.

Article 72 These Regulations shall come into force on 20 10 1 February 1 day.
