The so-called telecom fraud refers to the related means of VoIP, including three or even other means. All the acts of criminals using information technology such as SMS, telephone and internet to commit fraud are called telecom fraud, not just one.

Usually, what we call "telecom fraud" in our daily life is a criminal act committed by criminals in the early stage of information network crime, aiming at an unspecified majority of people, by telephone, SMS, etc.

Telecommunications (communication) products, technologies or services are just carriers used by criminals, and they have not participated in them, that is, they are not intentional subjectively. Therefore, telecom (communication) enterprises lack subjective intention and should not bear any legal responsibility.

At the same time, according to Article 2, Paragraph 1 (1) of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Fraud, "whoever commits fraud against an unspecified majority by sending short messages, making phone calls or publishing false information through the Internet, radio, television and newspapers" reaches a certain amount standard, which constitutes the crime of fraud.

We can know here that the carriers that constitute the crime of communication fraud are not only telephones and short messages, but also the Internet and software. No matter from the subjective composition and objective performance of the crime of fraud, or the provisions of relevant laws, regulations and judicial interpretations, it is inconsistent to call this related fraud case "telecom fraud".
