Regulations of Hubei Province on Waterway Traffic (202 1 Revision)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations, combined with the actual situation of this province, in order to standardize the waterway transportation activities, promote the development of waterway transportation, build a shipping center and comprehensive transportation hub in the middle reaches of the Yangtze River in Wuhan, and serve the economic and social development. Article 2 These Regulations shall apply to waterway traffic activities within the administrative area of this province.

Waterway traffic activities mentioned in these Regulations include waterway traffic development planning, waterway construction, conservation and protection, port construction and operation, waterway transportation, water traffic safety and environmental protection and other related management activities. Article 3 Waterway transportation shall follow the principles of scientific planning, comprehensive utilization, ecological protection, safety and smoothness, and convenience for the people and the people. Article 4 The people's governments at or above the county level shall, according to local conditions, incorporate waterway transportation into the national economic and social development plan, encourage, guide and support the construction of waterway transportation infrastructure, promote the interaction among shipping, ports, industries and cities, and form a modern comprehensive transportation system. Article 5 The transportation departments of the people's governments at or above the county level shall be in charge of waterway transportation within their respective administrative areas.

The port and shipping management, local maritime affairs and ship inspection institutions (hereinafter referred to as the waterway transportation management institutions) affiliated to the transportation departments of the people's governments at or above the county level shall be specifically responsible for waterway transportation within their respective administrative areas, and supervise and manage waterway transportation activities according to law.

Other relevant departments of the people's governments at or above the county level and the Township People's governments shall, in accordance with their respective responsibilities, do a good job in the relevant work of waterway traffic management. Chapter II Planning Article 6 The provincial people's government shall scientifically plan and co-ordinate the construction of a waterway transportation system with highly concentrated resources, perfect service functions, excellent market environment, convenient and efficient modern logistics, and form a shipping center in the middle reaches of the Yangtze River in Wuhan that faces the ocean, radiates the central and western regions and faces the whole country. Seventh waterway transportation development planning should be based on the needs of national economic and social development, in accordance with the principles of moderate advance, perfect function, industrial linkage and coordinated promotion.

Waterway traffic development planning should conform to the comprehensive traffic development planning, and be linked and coordinated with urban and rural planning, overall land use planning, regional development planning, river basin planning, lake protection planning and flood control planning.

Waterway traffic development planning includes waterway planning, port planning and shipping planning.

The legally approved waterway transportation development plan is the basis of waterway transportation construction, and it may not be modified without legal procedures. Article 8 The local waterway planning of the whole province shall be organized and compiled by the provincial transportation department according to law, promulgated and implemented after being approved by the provincial people's government, and reported to the the State Council transportation department for the record.

The planning of the Yangtze River, Hanjiang River and Jianghan Canal, which are included in the national high-grade waterway network, shall be compiled and approved in accordance with state regulations.

Rivers, lakes, reservoirs and artificial canals with development and navigation conditions shall be planned. Article 9 Port planning includes port layout planning and overall port planning.

Port planning shall be compiled, approved, promulgated and implemented in accordance with the People's Republic of China (PRC) Port Law and its relevant provisions.

The regulatory detailed planning of the port area shall optimize the overall layout of the waters and land areas of the port area, and make overall arrangements for the collection and distribution of railways, highways, aviation, pipelines, water supply and drainage, power supply, communications, safety supervision, port management, environmental protection and other facilities.

The people's governments at or above the county level and their relevant departments shall, according to the port planning, build a modern port system with reasonable layout, distinct levels, convenience, high efficiency and environmental friendliness. Article 10 The provincial people's government shall organize relevant departments to conduct a general survey, registration and clean-up of the use of shoreline resources in this province.

The provincial department in charge of transportation shall, jointly with the relevant departments of development and reform, natural resources, etc., combined with the general survey, prepare the utilization plan of the port coastline of the whole province according to the port layout planning and the overall port planning, and submit it to the provincial people's government for approval before promulgation and implementation.

The province's port coastline utilization planning should define the specific boundaries of the port coastline, and the land connected with the port coastline should be reserved for port construction. Strictly control the development and construction of port coastline, and promote the rational and efficient utilization of coastline. Article 11 People's governments at or above the county level shall, according to the development plan of waterway transportation, make overall plans for port logistics, warehousing and port-facing industries, scientifically plan logistics parks and bonded port areas, expand modern comprehensive service functions such as port distribution, processing, commerce, finance, insurance, electronic ports, ship trade and shipping transactions, and develop a comprehensive port transportation hub. Chapter III Waterways Article 12 The people's government of the province shall promote the construction of waterway system, build a large waterway of the shipping center in the middle reaches of the Yangtze River in Wuhan, strengthen cooperation with the transportation authorities in the State Council and other relevant ministries and commissions, speed up the construction of deep-water waterways in the middle reaches of the Yangtze River, and meet the needs of the 10,000-ton fleet passing through the middle reaches of the Yangtze River all the year round.

The people's governments at or above the county level and their transportation departments shall speed up the construction and maintenance of the Hanjiang River, Jianghan Canal, Qingjiang River and other important tributaries, large lakes and reservoirs, and form a waterway system with regional networking, trunk-branch connection and direct access to rivers and seas.

Strictly restrict the implementation of waterway regulation projects in ecological protection red lines, nature reserves and important habitats of aquatic organisms; If rectification is really necessary, it should be scientifically demonstrated, effective protective measures should be taken, and relevant procedures should be handled according to law.
