UAV related laws

A few days ago, the State Council and the Central Military Commission promulgated the Interim Regulations on Flight Management of Unmanned Aerial Vehicles, which will be implemented in Chinese mainland from June 5 to1October 6, 2008. This is the first special administrative regulation on UAV management in China, which is of great significance to the development of UAV industry.

FREQUENTLY ASKED QUESTIONS

1. Will the promulgation of the Regulations affect my flight?

The Regulations came into force on June 65438+10/October 65438 +0, 2024, and have not been formally implemented. You can still use drones according to existing regulations.

2. After the promulgation of the Regulations, what impact will it have on the purchase or use of drones by ordinary consumers?

The "Regulations" provide users with clearer guidance, clarify the current classification of drones and corresponding airspace, simplify the application process corresponding to different types of drones, and clarify the use thresholds of various drones, such as flight licenses and liability insurance. At the same time, the "Regulations" also clarify that the national air traffic management leading organization will co-ordinate the construction of an integrated and comprehensive service platform for drones, fundamentally solve the flight legality problem that plagues most drone users, and promote the healthy and orderly development of the whole industry.

3. What kind of drone do you belong to? Do you need real name registration, driver's license and liability insurance?

Please note: Although the DJI mini-series UAV weighs 250g, it is classified as a light UAV because the radio transmitting equipment exceeds the requirements of micro-power and short distance.

4. Which UAV types are suitable for integrated flight? Is it necessary to get approval from the air traffic management agency? How high can I apply?

[1] Fusion flight refers to the simultaneous flight of unmanned aerial vehicles and manned aircraft in a unified airspace.

[2] The heights mentioned above are all "true altitude".

5.? How to understand the concepts of "airspace suitable for flying" and "controlled airspace"?

This regulation creates new concepts of "flight airspace" and "controlled airspace" for unmanned aerial vehicles. Controlled airspace mainly includes air restricted areas, air dangerous areas, airports, borders, border areas, military restricted areas, military administrative areas, radio observation stations, inflammable and explosive dangerous goods enterprises and warehouses, and other core sensitive areas that need protection. Except for controlled airspace, the airspace below1.20m is classified as "flyable airspace", which is open to users of micro, light, small and agricultural UAVs with relatively small operational safety risks, so as to reduce legal flights.

Details are as follows:

controlled airspace

1.1the airspace above 20 meters is really high.

2.? Air restricted area, air restricted area and surrounding airspace

3.? Military aviation ultra-low altitude flight airspace

4.? The other eight areas below

(1) Airport and surrounding areas;

(2) national boundaries, actual control lines and a certain range of boundary lines on our side;

(3) Secret-related units such as military restricted zones, military administrative zones and supervision sites and their surrounding areas;

(four) important military facilities protection areas, nuclear facilities control areas, inflammable and explosive dangerous goods production and storage areas and large storage areas of inflammable and important materials;

(five) power plants, substations, gas stations, water supply plants, public transport hubs, shipping power hubs, major water conservancy facilities, ports, highways, railway electrification lines and other public infrastructure and their surrounding areas and drinking water source protection areas;

(6) Radio observation stations, satellite measurement and control (navigation) stations, aviation radio navigation stations, radar stations and other facilities that need special protection for the electromagnetic environment and its surrounding areas;

(seven) important revolutionary memorial sites, important immovable cultural relics and their surrounding areas;

(eight) other areas as prescribed by the state air traffic management agency.

The specific scope of controlled airspace is determined by the air traffic management agencies at all levels in accordance with the provisions of the national air traffic management leading institutions, announced by the people's governments at or above the municipal level with districts, and released by the civil aviation management departments and units that undertake corresponding responsibilities.

Airspace suitable for flying.

The airspace outside controlled airspace is suitable for flying micro, light and small unmanned aerial vehicles.

6. After the promulgation of the Regulations, what impact will it have on the flight height limit?

Micro, light and small unmanned aerial vehicles with relatively small operational safety risks fly in suitable airspace, and the flight altitude of controllers should not exceed the real altitude120m;

Controlled airspace determines the flying altitude according to the examination and approval. According to the regulations, unmanned aerial vehicles are not allowed to fly in controlled airspace without the approval of the air traffic management agency.

When manned aircraft and unmanned aerial vehicles appear in the same airspace at the same time, the flying height of light, small and medium-sized unmanned aerial vehicles shall not exceed the real height of 300 meters; The final flying height of large UAV is determined according to the examination and approval.

7. How long is the approval period of flight application? How long does it take to approve in advance?

The approval is applicable to the flight declaration in the control area and some comprehensive flight declarations of altitude and type. Users need to declare before noon 12 the day before the latest flight, and the results will be issued before noon 2 1 at the latest.

8. Can you judge whether you are in controlled airspace according to the no-fly zone designated by DJI·DJI?

At present, DJI's no-fly zone includes some control areas, such as airports. DJI's electronic fence is defined by enterprises according to flight safety, and will be adjusted after the future policies and regulations are clear.
