Article 1 These Provisions are formulated in accordance with the People's Police Law of the People's Republic of China and other relevant laws and regulations, and in combination with the actual situation of this Municipality, in order to maintain social order, public safety and clean city appearance and environment, and protect citizens' personal and public and private property.

Article 2 The Municipal Public Security Bureau is in charge of the patrol work of the city's people's police.

City and district (city) county public security organs set up people's police patrol (hereinafter referred to as patrol) institutions, responsible for the work of urban roads in accordance with the division of responsibilities.

Article 3 The Municipal Public Security Bureau and the district (city) and county people's governments shall be responsible for organizing the implementation of these Provisions, and the relevant government functional departments shall cooperate with the public security organs to do a good job in patrol duty.

Article 4 Patrol officers shall perform their duties in a combination of walking and maneuvering according to the designated patrol areas.

There should be more than two patrolmen on duty.

Article 5 Units and citizens shall support and cooperate with patrol officers in performing their official duties and obey the management of patrol officers.

Article 6 When performing their duties, patrolmen must strictly abide by the law and discipline, enforce the law impartially, wear police uniforms, wear patrol signs, use police equipment according to law, and consciously accept the supervision of society and citizens. Units or citizens have the right to complain and report violations of laws and regulations of patrol officers.

Chapter II Functions and Powers

Article 7 A patrolman shall perform the following duties when on duty:

(1) Maintaining public order, traffic order and public safety;

(2) Maintaining a clean and tidy city appearance and environment and protecting municipal public facilities;

(three) to participate in the rescue work of outstanding disasters and accidents, and to maintain order;

(four) to persuade and stop public security disputes in the patrol area, and to prevent and stop illegal and criminal acts;

(five) to guide pedestrians and help citizens who are suddenly injured, sick or in distress;

(six) to accept the citizen's alarm;

(seven) to improve the vigilance and discipline of the people's police;

(eight) to perform other tasks stipulated by laws, regulations and rules.

Article 8 Patrol officers shall exercise the following functions and powers in accordance with these Provisions:

(a) to inspect suspected criminals, and to inspect suspected vehicles and articles;

(two) check the identity card, temporary residence permit and related documents;

(3) Relevant compulsory measures can be taken against active criminals, major criminal suspects or fugitives according to law;

(4) detaining vehicles, articles and certificates related to administrative violations or criminal suspects;

(five) to correct traffic violations and stop non-traffic occupation;

(six) acts that endanger public safety and violate public security management, urban management, city appearance and environmental sanitation management may be punished or handed over to the relevant administrative departments for handling according to regulations;

(seven) in the case of hunting, emergency rescue, emergency rescue and other emergency situations, priority can be given to the use of organs, groups, enterprises, institutions and individual citizens' means of transportation and communication, but they should be returned in time after use. If damage is caused, compensation shall be made.

(eight) other powers conferred by laws, regulations and rules.

Chapter III Illegal Acts and Penalties

Article 9 Whoever commits one of the following acts that disturb public security and social order, but not serious enough for criminal punishment, shall be detained or given a warning, and shall also or only be fined not more than 200 yuan:

(a) gang fights, stir up trouble, insult women or engage in other rogue activities;

(2) spreading rumors to mislead people, causing trouble or lying about dangerous situations, and creating chaos;

(three) beating others, causing minor injuries;

(4) coercing or tricking people under the age of 18 to perform horrible and cruel programs, which destroys their physical and mental health;

(five) using feudal superstition to disrupt social order;

(six) illegal trafficking, carrying daggers, triangular knives, spring knives and other controlled knives;

(7) illegally carrying guns and ammunition or committing other acts in violation of the regulations on gun control;

(eight) theft, fraud, robbery or damage to public or private property;

(nine) unreasonable interception of vehicles or forced boarding affect the normal operation of vehicles, and do not listen to dissuasion;

(10) refusing or obstructing state functionaries from performing their duties according to law without resorting to violence or threats.

Tenth illegal transportation, storage, sale and discharge of fireworks and firecrackers shall be punished in accordance with the Regulations of Chongqing Municipality on Prohibiting the Discharge of Fireworks and Firecrackers.

Article 11 Whoever illegally manufactures, sells, holds or uses police signs, standard clothes, police equipment and people's police certificates shall be punished in accordance with the provisions of the People's Police Law of the People's Republic of China.

Twelfth one of the following traffic violations, shall be punished according to the following provisions:

(a) in violation of the provisions of motor vehicle parking, in accordance with the provisions of Article 68 of the Regulations of Chongqing Municipality on Road Traffic Management, a warning, a fine and a temporary suspension of the driver's license;

(two) in the area (road) where non-motor vehicles are prohibited from driving and parking, they shall be given a warning or fined by 5 yuan in accordance with the "Several Provisions on Road Traffic Management in Chongqing":

(four) littering materials and articles on the road, shall be ordered to clear, and impose a fine of more than 20 yuan and less than 200 yuan. If it is not cleared within the time limit, it shall be withheld or confiscated.

Thirteenth any of the following acts in violation of city appearance and environmental sanitation management shall be punished in accordance with the following provisions:

(a) spitting, urinating and littering, shall be ordered to immediately remove, and impose a fine of 5 yuan;

(two) the discharge of sewage and other solid and fluid substances on urban roads, according to the pollution area per square meter of 30 yuan; Dumping waste residue, fine 1000 yuan; If the circumstances are serious, a fine of more than 3000 yuan 1000 yuan shall be imposed;

(III) in the building (structure), street trees, telephone poles disorderly posting, graffiti, hanging advertisements, posters and paper slogans, shall be ordered to clear within a time limit, and in accordance with the relevant provisions of the Municipal People's Government "on the prohibition of posting, hanging, writing outdoor publicity materials notice", impose a fine of more than 50 yuan 1500 yuan;

(four) unauthorized construction on both sides of the road, shall be ordered to immediately stop construction, dismantle, and impose a fine of more than 50 yuan and less than 200 yuan. If it is not removed within the time limit, it shall be handed over to the relevant departments for compulsory removal according to law;

(five) without authorization to set up stalls on the road to engage in business activities, shall be ordered to make corrections, and impose a fine on 200 yuan; Refuses to correct, can temporarily detain its business items;

(six) illegal car washing, shall be banned, fined 500 yuan to 65438 yuan, and its cleaning equipment may be confiscated.

Article 14 In violation of the noise of life and the prohibition of motor vehicle honking in patrol areas, punishment shall be imposed in accordance with the relevant provisions of the Notice of the Municipal People's Government on Strengthening the Management of Urban Social Noise and the Notice on Strictly Controlling the Noise of Motor Vehicle Honking.

Article 15. Those who illegally buy or sell various tickets or foreign exchange, gold and silver, and gold and silver products shall temporarily detain the vehicles, articles and tickets related to the illegal acts and hand them over to the local public security organ or the relevant administrative department for handling.

Chapter IV Award and Enforcement

The punishment stipulated in Article 17 of Chapter III shall be executed according to the following authorities:

(a) warning, 50 yuan fine, withholding vehicles, articles, documents or 50 yuan to 200 yuan fine, the punished person has no objection, the patrol on duty on the spot;

(two) a fine of more than 50 yuan and less than 200 yuan shall be decided and executed by the patrol squadron;

(three) fines 1000 yuan, confiscation of property below 200 yuan, decided by the district (city) county patrol agencies and implementation.

The provisions of the second paragraph of Article 34 of the Regulations of the People's Republic of China on Administrative Penalties for Public Security shall apply to the punishment procedures in Items (2) and (3) of the preceding paragraph.

Beyond the authority listed in the first paragraph, it shall be submitted or transferred to the relevant competent department for handling according to law.

Eighteenth patrol in accordance with the provisions of the punishment decision, it shall issue a "patrol punishment decision". Fines and confiscation of property shall be issued with receipts uniformly printed by the financial department. Detained articles shall be listed and handled in accordance with the prescribed procedures.

Fines and confiscated property shall be turned over to the finance according to regulations.

Article 19 If the party concerned fails to accept the disposal at the designated place within two months, it shall be regarded as ownerless articles.

Article 20 For cases that should be transferred to other administrative departments for handling in accordance with these Provisions, the inspection agency shall make a case transfer letter and transfer it to the relevant administrative departments together with relevant evidence and withheld items within three days.

The administrative department shall accept the case transferred by the inspection agency, and shall not shirk or refuse, and shall inform the inspection agency of the handling result within 60 days.

Twenty-first was fined and did not pay the fine without justifiable reasons, each day overdue, an additional fine of 5 yuan.

Whoever refuses to pay a fine for violating the administration of public security may be detained for less than 15 days in addition to increasing the fine in accordance with the provisions of the preceding paragraph.

Twenty-second if a party refuses to accept the administrative punishment or administrative compulsory measures made by the patrol, it may, within 5 days from the date of receiving the decision, apply to the patrol agency at the next higher level or the competent public security organ for reconsideration; If he refuses to accept the reconsideration decision, he may bring a lawsuit to the people's court within 5 days from the date of receiving the reconsideration decision.

Where laws and regulations provide otherwise for reconsideration and litigation, such provisions shall prevail.

During the period of reconsideration and litigation, the execution of the punishment decision shall not be stopped.

Twenty-third inspectors who practice favoritism, ask for bribes and pervert the law should be given administrative sanctions; If the case constitutes a crime, the judicial organ shall investigate its criminal responsibility according to law.
