Regulations on the Prevention and Control of Pine Wood Nematode in Huangshan City

Article 1 In order to strengthen the prevention and control of Bursaphelenchus xylophilus, protect the pine forest resources in Huangshan City, and maintain the natural ecological security, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Plant Quarantine of the State Council, the Regulations on the Prevention and Control of Forest Pests and Diseases, and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of Bursaphelenchus xylophilus and the quarantine of Pinaceae plants and their products within the administrative area of this Municipality. Article 3 "Bursaphelenchus xylophilus disease" as mentioned in these Regulations refers to a destructive Bursaphelenchus xylophilus disease caused by invasion and infection of pine trees.

The occurrence area of Bursaphelenchus xylophilus refers to the occurrence area of Bursaphelenchus xylophilus confirmed by legal procedures but not announced by legal procedures.

Key prevention areas refer to the key prevention and control areas designated and announced by the people's governments at or above the county level according to the needs of pine wood nematode prevention and control.

Pinaceae plants and their products refer to trees and their products that can be infected with Bursaphelenchus xylophilus or parasitized by vector insects, but do not include fiberboard, plywood, particleboard and charcoal that have been treated at high temperature and high pressure. Article 4 The prevention and control of Bursaphelenchus xylophilus should follow the principles of prevention first, comprehensive management, scientific prevention and control, classified policies and supervision according to law, implement the working mechanism of government-led, departmental cooperation and social participation, and adhere to the responsibility system of whoever manages and controls. Article 5 The forest length system shall be implemented for the prevention and control of pine wood nematode disease. In the prevention and control of Bursaphelenchus xylophilus, forest managers should implement the responsibility of prevention and control and coordinate to solve major problems in their work.

The Municipal People's Government is responsible for organizing and leading the prevention and control of Bursaphelenchus xylophilus in the city, setting up special funds for the prevention and control of Bursaphelenchus xylophilus, coordinating the disposal of the epidemic situation of Bursaphelenchus xylophilus across county-level administrative regions, and ensuring the prevention and control of Bursaphelenchus xylophilus.

Measures for the use of special funds shall be formulated by the Municipal People's government. Sixth people's governments at or above the county level shall perform the following duties of prevention and control of Bursaphelenchus xylophilus:

(a) according to the needs of prevention and control of Bursaphelenchus xylophilus, delimit and publish key prevention and control areas;

(2) Organizing epidemic monitoring and special general survey in spring and autumn;

(3) Deciding to start an emergency plan and implement emergency treatment measures when an epidemic of Bursaphelenchus xylophilus occurs;

(four) timely organize quarantine activities of Pinaceae plants and their products;

(five) the funds needed for the prevention and control of Bursaphelenchus xylophilus will be included in the fiscal budget at the corresponding level.

The command organization for the prevention and control of Bursaphelenchus xylophilus established by the people's government at or above the county level, Huangshan Scenic Area Management Committee and Huangshan Economic Development Zone Management Committee undertakes the specific organization, command, coordination and supervision. Seventh forestry administrative departments at or above the county level, Huangshan Scenic Area Management Committee and Huangshan Economic Development Zone Management Committee are responsible for the following prevention and control of Bursaphelenchus xylophilus:

(a) responsible for the prevention and control of Bursaphelenchus xylophilus disease within their respective administrative areas;

(two) responsible for the implementation of epidemic monitoring and special census plan, and report to the people's government at the same level and the administrative department of forestry at the next higher level;

(3) to formulate an emergency plan for the prevention and control of Bursaphelenchus xylophilus and report it to the people's government at the same level for approval, reserve prevention and control materials according to the requirements of the emergency plan, set up an emergency team, and carry out prevention and control skills training and emergency drills;

(4) Establish and improve the monitoring and early warning system of Bursaphelenchus xylophilus, and strengthen the infrastructure construction of prevention and control of Bursaphelenchus xylophilus;

(five) according to the results of monitoring and investigation, the preparation of the annual plan for the prevention and control of Bursaphelenchus xylophilus, submitted to the people's government at the same level and the prevention and control headquarters at the next higher level for approval and implementation;

(six) to implement the deployment of the prevention and control headquarters, and to implement the quarantine of Pinaceae plants and their products;

(seven) responsible for the supervision and operational guidance of socialized prevention and control organizations.

Forestry pest control and quarantine institutions (hereinafter referred to as forest inspection institutions) under the forestry administrative departments at or above the county level are responsible for monitoring and early warning, inspection and quarantine of pine wood nematodes and related technical services and business training. Eighth relevant departments and institutions of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the prevention and control of Bursaphelenchus xylophilus.

Forestry, science and technology departments should support scientific research on the prevention and control of Bursaphelenchus xylophilus, and encourage the popularization and application of advanced and practical prevention and control technologies for Bursaphelenchus xylophilus.

Forestry, education, culture, radio and television departments should take various forms to publicize and popularize the knowledge of prevention and control of Bursaphelenchus xylophilus, and enhance the public's awareness and ability to prevent Bursaphelenchus xylophilus. Ninth Township People's government, street offices, etc. Should be in accordance with their respective responsibilities, organize the prevention and control of pine wood nematode disease related work.

Village (neighborhood) committees shall assist in the prevention and control of Bursaphelenchus xylophilus. Tenth to encourage and support citizens, legal persons and other organizations to participate in the prevention and control of Bursaphelenchus xylophilus. Units and individuals that have made significant contributions to the timely detection and reporting of epidemic situation or the prevention and control of Bursaphelenchus xylophilus shall be commended and rewarded in accordance with relevant state regulations. Eleventh state-owned forest farms, nature reserves, scenic spots, economic development zones, forest park management agencies, urban landscaping departments and other enterprises and institutions are responsible for the investigation and cleaning of dead pine trees within their management scope.

The Township People's Government shall be responsible for the investigation and cleaning of dead pine trees owned by collectives and individuals within its jurisdiction, and the village (neighborhood) committees shall provide assistance.

The investigation and cleaning of dead pine trees shall be carried out in accordance with the requirements of the deployment and technical regulations of the forestry administrative department of the people's government at or above the county level, and the management units and individuals of pine trees and pine forests shall cooperate with each other and shall not refuse or hinder them.
