Chapter 1 General Provisions Article 1 In order to protect and improve the environment, prevent and control air pollution, protect public health, promote the construction of ecological civilization, and promote sustainable economic and social development, in accordance with the "Atmospheric Regulations of the People's Republic of China and the State Council" These regulations are formulated in accordance with the provisions of relevant laws and regulations such as the Pollution Prevention and Control Law and in combination with the actual conditions of the province. Article 2 These regulations apply to the prevention and control of air pollution within the administrative region of this province. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment, and follow the principles of source control, planning first, highlighting key points, combining prevention and control, and taking government leadership and public participation. Article 4 People's governments at all levels are responsible for the quality of the atmospheric environment within their respective administrative regions.

People's governments at or above the county level should incorporate air pollution prevention and control into national economic and social development plans, rationally plan urban layout and industrial development layout, optimize industrial structure and energy structure, strengthen ecological construction, and improve atmospheric environmental quality . Article 5: The environmental protection departments of the people's governments at or above the county level shall implement unified supervision and management of air pollution prevention and control within their respective administrative regions. Other relevant departments of the people's governments at or above the county level shall supervise and manage air pollution prevention and control within the scope of their respective responsibilities:

(1) The development and reform, industry and information technology departments of the people's governments at or above the county level shall be responsible for the total coal consumption Control and optimize the industrial and energy structure and layout adjustment, organize and promote the technological transformation and upgrading of industrial enterprises, the implementation of backward production capacity elimination plans, increase the use of clean energy, develop circular economy, formulate and improve atmospheric environmental protection and other related policies;

(2) The public security, transportation, commerce and other departments of the people's governments at or above the county level shall supervise and manage motor vehicles, non-road mobile machinery, oil and gas recovery and treatment, etc.;

(3) People's governments at or above the county level Government departments such as housing and urban-rural development, land and resources, transportation, urban management, industry and information technology implement supervision and management of construction dust, mine dust, road dust, enterprise material storage yards, etc.;

(4) The urban management, public security, industry and commerce, food supervision, agriculture and other departments of the people's governments at or above the county level shall supervise and manage catering services, open-air barbecues, raw coal burning, straw burning ban, etc.;

(5) Above the county level The agriculture, forestry, animal husbandry and other departments of the people's government shall supervise and manage the air pollution caused by agricultural production and livestock and poultry breeding; Implement supervision and management of air pollutant emissions.

The township (town) people's government and sub-district offices, under the guidance of the county (city, district) people's government, organize and carry out air pollution prevention and control work based on the actual conditions of the region. Article 6 Enterprises, institutions and other producers and operators shall abide by the provisions of laws and regulations, improve the environmental protection management system, implement job responsibility systems, truthfully disclose environmental information to the public, and consciously accept the supervision of environmental protection authorities and other responsible for atmospheric environmental protection. Supervise and manage the departments with management responsibilities. Strengthen cleaner production management, take effective measures to prevent and reduce air pollution, and bear responsibility for the damage caused in accordance with the law.

Citizens should enhance their awareness of atmospheric environmental protection, adopt a low-carbon, frugal, and green lifestyle, and consciously fulfill their responsibilities for atmospheric environmental protection. Article 7: This province implements an atmospheric environment quality target responsibility system and an assessment and evaluation system. The Provincial People's Government formulates assessment rewards and punishment methods to assess the completion of air environment quality improvement goals and key tasks of air pollution prevention and control in cities and counties (cities, districts) divided into districts. The assessment results should be made public to the public. Article 8 People's governments at or above the county level shall increase financial investment in air pollution prevention and control, strengthen the supervision and management of air pollution prevention and control funds, and improve the efficiency of fund use.

People's governments at all levels should provide support and assistance to enterprises, institutions and other producers and operators that carry out technological transformation and energy substitution.

Encourage and support social capital to participate in air pollution prevention and control, and guide financial institutions to increase credit support for air pollution prevention and control projects.

Article 9 The people's governments of provinces and municipalities divided into districts shall encourage and support scientific and technological research on air pollution prevention and control, carry out analysis of the sources of air pollution and their changing trends, prepare emission inventories of air pollutant sources, and promote and apply advanced prevention and control technologies. Give full play to the supporting role of science and technology in the prevention and control of air pollution.

Relevant departments of the people's governments at or above the county level should guide and serve enterprises, institutions and other production operators to enhance their awareness of atmospheric environmental protection and take effective measures to prevent and reduce air pollution. Article 10 People's governments at all levels shall reward units and individuals that have made outstanding achievements in preventing and controlling air pollution, protecting and improving the atmospheric environment.

Governments, social groups, schools, news media, grassroots mass autonomous organizations, etc. should strengthen publicity and education on atmospheric environmental protection, popularize laws, regulations and scientific knowledge on air pollution prevention and control, and improve the public’s awareness of atmospheric environmental protection. , to promote public participation in atmospheric environmental protection. Chapter 2 Plans and Standards for Air Pollution Prevention and Control Article 11 The people's governments of municipalities divided into districts that do not meet the national atmospheric environment quality standards shall establish atmospheric environment quality deadlines in accordance with national and provincial air pollution prevention and control target requirements and regional atmospheric environment quality conditions. Standard compliance plan and annual implementation plan for air pollution prevention and control, and take strict air pollution control measures to meet the prescribed atmospheric environment quality standards on schedule.

The people's governments of municipalities divided into districts that meet national atmospheric environment quality standards shall formulate continuous improvement measures for atmospheric environment quality in accordance with national and provincial requirements.

The air environment quality compliance plan and the annual implementation plan for air pollution prevention and control as well as the implementation results should be disclosed to the public and evaluated and revised in a timely manner.
