Regulations of Longyan Municipality on the administration of fireworks and firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, reduce noise nuisance and air pollution, ensure public safety and personal and property safety, and create a good production and living environment, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge management of fireworks and firecrackers within the administrative area of this Municipality. Article 3 "Fireworks and firecrackers" as mentioned in these Regulations refers to inflammable and explosive articles which are mainly made of pyrotechnics and can produce light, sound, color, shape and smoke after being ignited for viewing. Fourth fireworks should adhere to the principles of changing customs, safety and environmental protection, civilization and thrift. Fifth city and county (city, district) people's governments shall establish a joint meeting system for the management of fireworks and firecrackers to comprehensively coordinate major issues in the management of fireworks and firecrackers.

The public security department is responsible for the safety management of fireworks and firecrackers, and is the competent department of fireworks and firecrackers management.

Safety production supervision and management, urban management, environmental protection, quality and technical supervision, transportation, industry and commerce, civil affairs, religion, culture and other departments shall, in accordance with their respective responsibilities, do a good job in the management of fireworks and firecrackers. Sixth Township People's governments and sub-district offices shall incorporate the management of fireworks and firecrackers into grassroots social governance, and strengthen organization, coordination, guidance and supervision.

Residents' committees, villagers' committees and realty service enterprises shall cooperate with the management of fireworks and firecrackers, strengthen publicity and education for residents, villagers and owners, guide them to change their customs, and discharge fireworks and firecrackers in accordance with the law, civilization and safety. Seventh people's governments at all levels in this Municipality and their relevant departments shall regularly organize publicity activities for the management of fireworks and firecrackers.

Radio, television, newspapers, internet and other media should do a good job in the public welfare publicity of fireworks and firecrackers.

Schools and guardians of minors shall educate and guide minors to set off fireworks legally, civilly and safely. Article 8 The discharge of fireworks and firecrackers is restricted within the administrative area of this Municipality, and any unit or individual can only discharge fireworks and firecrackers of specified varieties within the specified time and area.

Longyan central city is an area where fireworks and firecrackers are restricted, and the specific scope of restrictions is determined and announced by the Municipal People's Government. 1From February 23rd to the 15th day of the first lunar month, including New Year's Eve, the first day and the 15th day of the first lunar month, fireworks and firecrackers are allowed to be set off in restricted areas from 6: 00 to 22: 00 every day. In addition to the above time, it is forbidden to set off at other times.

Yongding County, Shanghang County, Wuping County, Liancheng County, Changting County and zhangping city restrict the area and time of setting off fireworks and firecrackers, which shall be determined and announced by the people's governments of counties (cities, districts).

Where fireworks and firecrackers are restricted, funeral homes, cemeteries and other public places of worship can set off fireworks in designated areas and at designated times. Ninth the following places and areas are prohibited from setting off fireworks at any time:

(a) cultural relics protection units;

(2) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(3) Units that produce and store inflammable and explosive articles;

(4) Within the safety protection zone of power transmission and transformation facilities;

(5) Medical institutions, kindergartens, schools, nursing homes, libraries, archives and museums;

(six) urban primary and secondary roads and elevated roads, overpasses, footbridges and underground passages;

(seven) scenic spots and key fire prevention areas such as woodland, public green space and nursery;

(eight) shopping malls, bazaars, cultural and entertainment venues and other crowded places;

(nine) other places where fireworks are prohibited by laws and regulations. Article 10 The municipal public security department shall, jointly with the departments of production safety supervision and management, quality and technical supervision, determine the types of fireworks and firecrackers that are prohibited from operating and discharging in this Municipality according to the principles of environmental protection and safety, and announce them to the public after being reported to the Municipal People's Government for approval. Eleventh restricted fireworks area, in addition to funeral homes, cemeteries and other public places of worship can set up fireworks retail outlets according to law, other places shall not set up fireworks wholesale places and permanent retail outlets.

The temporary point of sale of fireworks and firecrackers in the restricted discharge area of Longyan central city shall be reasonably determined by the safety production supervision and management department of xinluo district in conjunction with the public security and urban management departments. Twelfth restricted fireworks area allows retail fireworks from1February 20th to the 15th day of the first lunar month, and may not be sold at other times. Thirteenth major celebrations need to hold a fireworks party or other large-scale fireworks display activities, the organizer shall apply to the public security department in accordance with the provisions of hierarchical management, obtain a "fireworks display permit", and set off fireworks at the designated place and time. Fourteenth fireworks shall comply with the following provisions:

(a) not to people, vehicles, buildings, underground pipe network, public green space throwing lit fireworks;

(two) shall not hinder the safe passage of pedestrians and vehicles;

(three) not in the corridor, roof, balcony, window setting off or throwing fireworks;

(four) fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety.
