Policy of demolition and reconstruction of old houses in rural areas

1, one household and one house. The state has clearly proposed to promote the clean-up and renovation of rural housing, demolish rural dilapidated houses and collapsed ownerless houses, carry out the renovation of one house for one household, and demolish and reform illegal houses one by one. At the same time, rural residents are encouraged to choose to recover the legally owned surplus homestead with compensation. After rural residents choose to recover the remaining homestead with compensation, their houses will also be demolished by rural collective organizations.

2. Reclamation of homestead. The demolition targets of old houses in rural areas mainly include dilapidated houses without owners, collapsed houses that have been idle for more than two years, old houses that have been demolished by rural residents themselves, old houses that have been rebuilt after poverty alleviation and relocation, and old houses on redundant homestead owned by rural residents in violation of laws and regulations. After these old houses are demolished, the homestead will also be reclaimed by rural collective organizations, and the homestead will be reclaimed for agricultural development.

3. Demolition compensation. According to the Land Management Law and the Measures for the Administration of Homestead, rural residents will not be compensated whether they build new houses or demolish old houses or clean up dilapidated houses. In recent years, with the development of rural reform, the state is encouraging rural residents to choose to take back their legally owned surplus homestead, and rural houses need to be demolished and expropriated for rural development. In both cases, rural residents can get compensation from the state after their old houses are demolished.

4. Inheritance of homestead. From 2022, houses in rural areas will also undergo great changes. All houses must be implemented in accordance with the new provisions of the Civil Code, that is, "the integration of real estate and premises". Heirs can inherit the right to use rural homesteads and the ownership of self-built houses, and must conform to the principle of "the land follows the house". Village cadres can't easily recycle homesteads. As long as the house does not collapse, the heir can inherit it. However, if it is occupied farmland, unmanned dangerous houses, small property houses, or homesteads purchased by city people, the principle of "integration of real estate and real estate" cannot be followed.

5. Renovation of old houses. In 2022, we will continue to implement the renovation of dilapidated houses in rural areas and improve the housing problem of rural residents through the renovation of dilapidated houses. When the old houses are rebuilt, there are some low-income families, and the cost of renovation will cause some pressure. In order to solve their plight, relevant subsidies will be provided to reduce the burden of housing renovation. The amount of subsidies varies from region to region, generally not less than 8000 yuan.
