Regulations on Emergency Management of Nuclear Accidents at Nuclear Power Plants (Revised in 2011)

Chapter 1 General Provisions Article 1 These Regulations are formulated in order to strengthen the emergency management of nuclear accidents in nuclear power plants and control and reduce the hazards of nuclear accidents. Article 2 These Regulations shall apply to the emergency management of nuclear accidents at nuclear power plants (hereinafter referred to as nuclear accidents) that may or have caused the release of radioactive materials and caused major radiation consequences. Article 3: The emergency management of nuclear accidents shall implement the principles of unremitting preparedness, active compatibility, unified command, vigorous coordination, protection of the public, and protection of the environment. Chapter 2 Emergency Agencies and Their Responsibilities Article 4 The department designated by the State Council is responsible for the national nuclear accident emergency management work. Its main responsibilities are:

(1) Formulate national nuclear accident emergency work policies;

(2) Unify and coordinate the nuclear accident emergency response work of relevant departments of the State Council, the military and local people’s governments;

(3) Organize the formulation and implementation of the national nuclear accident emergency plan, review and approve off-site nuclear accidents Accident emergency plan;

(4) Promptly approve the entry and termination of off-site emergency state;

(5) Propose suggestions for the implementation of nuclear accident emergency response actions;

(6) Review and approve nuclear accident bulletins and international notifications, and propose plans to request international assistance.

When necessary, the State Council will lead, organize, and coordinate the national nuclear accident emergency management work. Article 5 The department designated by the people's government of the province, autonomous region, or municipality directly under the Central Government where the nuclear power plant is located is responsible for the emergency management of nuclear accidents within its own administrative region. Its main responsibilities are:

(1) Execute national nuclear accident emergency response work regulations and policies;

(2) Organize and formulate off-site nuclear accident emergency plans and prepare for nuclear accident emergencies;

(3) Unify command of off-site nuclear accident emergency response Action;

(4) Organize and support nuclear accident emergency response actions;

(5) Timely report the nuclear accident situation to neighboring provinces, autonomous regions, and municipalities directly under the Central Government.

When necessary, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall lead, organize, and coordinate nuclear accident emergency management within their own administrative regions. Article 6 The main responsibilities of the nuclear accident emergency response agency of a nuclear power plant are:

(1) Implement national regulations and policies on nuclear accident emergency work;

(2) Formulate plans for on-site nuclear accidents Emergency plans and preparations for nuclear accidents;

(3) Determine the level of nuclear accident emergency status and uniformly direct the unit’s nuclear accident emergency response actions;

(4) Timely Report the accident situation to the superior authorities, the nuclear safety department of the State Council and the departments designated by the provincial people's governments, and make suggestions for entering an off-site emergency state and taking emergency protective measures;

(5) Assist and cooperate with the provincial level Departments designated by the people's government shall do a good job in emergency management of nuclear accidents. Article 7 The superior competent department of a nuclear power plant shall lead the nuclear accident emergency response of the nuclear power plant.

Relevant departments such as the nuclear safety department, environmental protection department and health department of the State Council shall carry out corresponding nuclear accident emergency response work within their respective scope of responsibilities. Article 8: As an important force in nuclear accident emergency response, the Chinese People's Liberation Army should provide effective support in nuclear accident emergency response. Chapter 3 Emergency Preparedness Article 9 In response to a possible nuclear accident in a nuclear power plant, the nuclear accident emergency response agency of the nuclear power plant, the department designated by the provincial people's government, and the department designated by the State Council shall formulate a nuclear accident emergency plan in advance.

Nuclear accident emergency plans include on-site nuclear accident emergency plans, off-site nuclear accident emergency plans and national nuclear accident emergency plans. Nuclear accident emergency plans at all levels should be connected and coordinated with each other. Article 10 The on-site nuclear accident emergency plan shall be formulated by the nuclear accident emergency response agency of the nuclear power plant. After review by its competent department, it shall be submitted to the nuclear safety department of the State Council for review and shall be reported to the department designated by the State Council for filing. Article 11 Off-site nuclear accident emergency plans shall be formulated by the department designated by the provincial people's government where the nuclear power plant is located and submitted to the department designated by the State Council for review and approval. Article 12 The national nuclear accident emergency plan shall be organized and formulated by the department designated by the State Council.

Relevant departments of the State Council and the headquarters of the Chinese People's Liberation Army shall formulate corresponding nuclear accident emergency plans in accordance with the national nuclear accident emergency plan and submit them to the departments designated by the State Council for filing. Article 13 The on-site nuclear accident emergency plan and the off-site nuclear accident emergency plan shall include the following contents:

(1) Basic tasks of nuclear accident emergency work;

(2) Nuclear accident emergency response plan Accident emergency response organizations and their responsibilities;

(3) The scope of plume emergency plan area and ingestion emergency plan area;

(4) Intervention level and derived intervention level;

(5) Detailed plans for emergency preparedness and emergency response for nuclear accidents;

(6) Emergency facilities, equipment, equipment and other materials;

(7) Nuclear power Matters and measures for mutual cooperation and support between the factory's nuclear accident emergency response agency and the departments designated by the provincial people's government, as well as with other relevant parties. Article 14 Relevant departments shall consider the requirements for nuclear accident emergency response when conducting site selection and design work for nuclear power plants.

Newly built nuclear power plants must review and approve their on-site and off-site nuclear accident emergency plans before loading fuel. Article 15 The departments designated by the State Council, the departments designated by the provincial people's governments and the nuclear accident emergency response agencies of nuclear power plants shall have necessary emergency facilities, equipment and fast and reliable communication systems between them.

The nuclear accident emergency response agency of the nuclear power plant and the departments designated by the provincial people's government shall have radiation monitoring systems, protective equipment, medicine and other materials.

Facilities, equipment, communication systems, radiation monitoring systems, protective equipment, medicines, etc. used for nuclear accident emergency work should be in good condition.
