Regulations of Ningbo Municipality on Fishery Production Safety

Chapter I General Provisions Article 1 In order to strengthen the supervision and management of fishery production safety, prevent and reduce fishery production accidents, and ensure the safety of people's lives and property, these Provisions are formulated in accordance with the provisions of the People's Republic of China (PRC) Law on Safety in Production, the Regulations on Safety in Production in Zhejiang Province, the Regulations on Fisheries Management in Zhejiang Province and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Provisions shall apply to the safe production of units and individual economic organizations engaged in fishery production and operation within the administrative area of this Municipality (hereinafter referred to as production and operation units).

The term "fishing grounds" as mentioned in these Provisions refers to the waters and beaches within the administrative area of this Municipality, as well as the waters engaged in aquaculture and fishing activities within the scope of fishery supervision and administration as stipulated by the state. Third city and county (city), district safety production supervision and management departments to implement comprehensive supervision and management of fishery safety production within their respective administrative areas, supervision, guidance and coordination of fishery safety production.

City, county (city) and district fishery administrative departments shall supervise and manage the work of fishery safety production.

Township (town) people's governments and sub-district offices shall strengthen their leadership over fishery safety in their respective administrative areas and perform their duties of supervision and administration of production safety according to law.

Villagers' committees and professional fishery cooperative economic organizations shall assist in the work of fishery safety production.

Public security frontier defense, maritime affairs and other relevant departments shall do a good job in the supervision and management of fishery safety production within their respective responsibilities. Article 4 The municipal, county (city) and district people's governments shall strengthen their leadership over the work of fishery safety production, establish a management system for fishery safety production, and implement the target responsibility system and administrative accountability system for fishery safety production. Article 5 A production and business operation entity is the main body responsible for fishery safety production in its own unit, and shall strengthen the management of fishery safety production according to law, establish and improve the responsibility system for fishery safety production and improve the conditions for fishery safety production.

The main person in charge of the production and business operation entity shall be fully responsible for the fishery safety work of the unit, and other responsible persons shall be responsible for the fishery safety work within their respective responsibilities. Sixth cities and counties (cities), district safety production supervision and management departments, fishery administrative departments and production and business units should take various forms to carry out publicity and education on fishery safety production knowledge. Chapter II Guarantee of Fishery Safety in Production Article 7 Production and business operation entities shall meet the following requirements for safety in production:

(a) establish and improve the responsibility system for production safety, formulate and improve the rules and regulations of production safety and safety operation procedures;

(two) according to the relevant provisions of the signing of fishery production safety responsibility, and the implementation of production safety responsibility;

(three) in accordance with the provisions of the professional and technical training of the crew on duty and other crew members, to ensure that fishing vessels meet the seaworthiness requirements;

(four) equipped with fishing vessel safety facilities and fishing protection equipment;

(five) to cooperate with the relevant administrative departments to do a good job in the management of foreign employees of fishing boats;

(six) supervision and inspection of production safety work, timely discover and eliminate hidden dangers of accidents;

(seven) other requirements stipulated by laws, regulations and rules. Article 8 The captain shall be directly responsible for the safety production of fishing vessels, organize the implementation of various safety operation systems and traffic and production rules and regulations, and implement the following safety production measures:

(a) before sailing, safety inspection of fishing vessels;

(2) During the voyage, the communication should be kept smooth, the position monitor should be turned on, and the ship's dynamics should be reported in time;

(three) the implementation of the safety duty system and navigation, operation and anchoring rules, and the records of navigation, fishing and engine logs;

(4) In case of typhoon, timely organize fishing boats to take shelter from the wind at the anchorage and evacuate the crew;

(five) to urge the crew to take corresponding preventive measures in the process of operation.

The captain of the lead ship is responsible for the departure, entry and navigation of the formation fishing vessels, and urges the captains of the formation fishing vessels to do a good job in ship safety management. Article 9 Employees of production and business operation entities shall enjoy the following rights:

(a) require the production and business operation entities to handle industrial injury insurance according to law;

(two) to participate in safety education and training;

(three) to understand the risk factors and emergency measures existing in fishing boats and operating posts;

(four) put forward rectification opinions on the hidden dangers of fishing vessels, and have the right to refuse to board when the hidden dangers have not been ruled out;

(5) Refusing to command or force risky operations in violation of regulations, and stopping operations when an emergency that directly endangers personal safety is discovered;

(six) to claim compensation according to law after being damaged by production safety accidents;

(seven) other rights stipulated by laws, regulations and rules. Article 10 Employees of production and business operation entities shall perform the following obligations:

(a) to comply with the relevant traffic and safety production operation systems and regulations, and to obey the management;

(two) to receive education and training in production safety;

(three) timely report the hidden dangers of accidents and unsafe factors;

(four) to participate in accident rescue;

(five) other obligations stipulated by laws, regulations and rules. Eleventh fishing vessels shall apply for entry and exit visas in accordance with the provisions.

Visa personnel shall conduct safety inspection of fishing boats in accordance with relevant regulations.
