Measures for the Administration of Construction Projects Involving National Security Matters in Ningxia Hui Autonomous Region

Chapter I General Provisions Article 1 In order to strengthen the management of construction projects involving national security matters and safeguard national security, these Measures are formulated in accordance with the Administrative Licensing Law of People's Republic of China (PRC), the National Security Law of People's Republic of China (PRC) and relevant decisions of the State Council. Article 2 These Measures shall apply to the examination and approval, supervision and management activities of construction projects involving national security matters within the administrative area of this Autonomous Region. Article 3 The term "construction projects involving national security matters" as mentioned in these Measures refers to the construction projects newly built, rebuilt or expanded within the national security control zone designated by the urban and rural planning of the people's government at or above the municipal level with districts, and the following construction projects newly built, rebuilt or expanded outside the national security control zone that meet the national security requirements:

(1) International airports, entry and exit ports, docks, postal hubs and telecommunications hubs;

(2) Foreign-related hotels, restaurants, office buildings, apartments and resorts;

(3) Other construction projects involving national security as stipulated by laws and regulations.

The term "national security control zone" as mentioned in these Measures refers to the construction control zone set aside by the state security organ in conjunction with the competent department of urban and rural planning within a certain distance around it in order to protect the safety of important state organs, military facilities, national defense scientific research and military enterprises. Article 4 The state security organs of autonomous regions and cities divided into districts shall carry out administrative examination and approval, supervision and management of construction projects involving national security matters.

Urban and rural planning, land resources, development and reform, state secrets, industry and commerce, tourism and other administrative departments and military organs shall cooperate with the state security organs to do a good job in the supervision and management of construction projects involving national security matters. Article 5 The competent department of urban and rural planning and the competent department of construction projects shall not go through the relevant examination and approval procedures for new construction, reconstruction and expansion projects without the approval of the state security organs, and the construction unit shall not start construction. Chapter II Application and Acceptance Article 6 For newly-built construction projects involving national security matters, the construction unit (hereinafter referred to as the applicant) shall apply to the state security organ for examination and approval of national security matters before applying to the competent department of urban and rural planning and the competent department of construction projects for relevant administrative examination and approval procedures.

The applicant shall submit the following materials when applying for examination and approval of national security matters:

(1) A site selection opinion or an application for planning permission for construction land;

(2) A copy of the registration certificate;

(3) A copy of the qualification certificate for real estate development;

(4) A topographic map with the basic scale of 1: 500 with a radius of 500 meters for the construction project;

(five) the approval, approval and filing documents of the construction project. Article 7 For reconstruction and expansion of construction projects involving national security matters, the applicant shall apply to the state security organ for examination and approval of national security matters before applying to the competent department of urban and rural planning administration for relevant examination and approval procedures.

The applicant shall submit the following materials when applying for examination and approval of national security matters:

(1) An application for reconstruction and expansion of a construction project;

(2) A copy of the registration certificate;

(3) A copy of the qualification certificate for real estate development;

(4) A topographic map with the basic scale of 1: 500 with a radius of 500 meters for the construction project;

(five) the construction drawings involved in the reconstruction or expansion project planning;

(6) Design scheme of intelligent integrated management system;

(seven) the relevant documents of the competent department for examination and approval of construction projects. Article 8 An applicant may file an application with a state security organ in person or through an agent.

Applications can be made by letter, telegram, telex, fax, electronic data interchange and email. Article 9 The state security organ shall publicize the basis, conditions, procedures and time limit for examination and approval of construction projects involving national security matters in the office, as well as the list of materials and the model text of the application that the applicant needs to submit.

Where the applicant requests the state security organ to explain and explain the contents of the publicity, the state security organ shall explain and explain and provide accurate information. Article 10 When an applicant applies to the state security organ for examination and approval of a construction project involving national security matters, he shall truthfully submit relevant materials to reflect the real situation and be responsible for the authenticity of his application materials. Article 11 The State security organ shall handle the application filed by the applicant according to the following circumstances:

(1) If the application matters do not need to be examined and approved according to law, the applicant shall be informed immediately;

(two) if the application matters do not belong to the scope of construction projects involving state matters according to law, it shall immediately make a decision not to accept them;

(3) If there are errors in the application materials that can be corrected on the spot, the applicant shall be allowed to correct them on the spot;

(four) the application materials are incomplete or do not meet the statutory form, it shall inform the applicant of all the contents that need to be corrected on the spot;

(5) If the application matters fall within the scope of construction projects involving national security matters, and the application materials are complete and conform to the statutory form, or the applicant has submitted all the corrected application materials according to the requirements of the state security organ, it shall be accepted.

When a state security organ accepts or rejects an application for examination and approval, it shall issue a written notice stamped with its special seal, dated and explained.
