Measures for the Administration of Bidding in supervision bidding for Waterway Engineering Construction (for Trial Implementation)

Chapter I General Provisions Article 1 In order to strengthen the market management of waterway engineering construction supervision, standardize the bidding work in supervision bidding, and give full play to the core role of supervision in controlling engineering quality in engineering construction, these measures are formulated in accordance with the Measures for the Administration of Waterway Engineering Construction Market and the Provisions on Waterway Engineering Construction Supervision (for Trial Implementation), combined with the characteristics of waterway engineering construction. Article 2 These Measures shall apply to national and local waterway engineering construction projects. Major waterway engineering construction projects can adopt international bidding according to these measures.

Bidding work is divided into bidding, pre-qualification, bidding, bid opening, bid evaluation, bid selection and contract signing.

Supervision bidding construction should be completed before the construction bidding. Article 3 supervision bidding bidding for waterway engineering construction shall adhere to the principles of legality, openness, fairness and impartiality, and compete with management level, technical level, service quality and social reputation.

The bidding work is protected and constrained by the national laws, and the traffic administrative departments at all levels shall supervise and manage the activities of supervision bidding in the construction of water transport projects according to law. No unit or individual may interfere with normal bidding activities under any pretext. Article 4 The project legal person shall be responsible for organizing and implementing the construction of supervision bidding for water transport projects.

Supervision bidding bidding for large and medium-sized water transport projects above designated size and other important water transport projects is managed by the Ministry of Communications.

Supervision bidding bidding for waterway engineering projects other than the above-mentioned projects shall be managed by the local traffic administrative department.

Supervision bidding bidding for Sino-foreign joint ventures, cooperation, wholly foreign-owned and foreign-funded water transport projects shall be subject to the management and supervision of the traffic administrative department according to the above principles. The bidding documents and prequalification results shall be reported to the superior traffic administrative department for review, and the bid evaluation report and results shall be reported to the superior traffic administrative department for the record. Open tender. The project legal person issues the tender announcement through newspapers, radio and television.

Invite public bidding. For a few general construction projects, the project legal person may invite several supervision units to participate in the bidding by means of letters, telegrams and faxes. No less than 3 units are invited for each project subject to tender.

Negotiation. For a single waterway engineering construction project with strong professionalism, great technical difficulty and special requirements, with the approval of the traffic administrative department at the higher level of the project, the supervision unit that meets the corresponding qualifications of the project may be invited to negotiate and determine the winning bidder. Eighth construction projects in supervision bidding, the whole construction project can be a one-time tender, can also be based on different functions and professions in stages, block bidding. However, it is forbidden to dismember the main project or only carry out supervision bidding construction. Ninth waterway engineering project construction in supervision bidding should meet the following conditions:

1. Construction funds have been secured;

2. The preliminary design documents have been approved;

3. The supervision bidding document has been compiled and submitted to the superior traffic administrative department for examination and approval according to the principle of hierarchical management;

1. The project legal person determines the bidding method;

2. Prepare the tender documents;

3. Issue a tender announcement or invitation to bid (bid negotiation);

4. Publish prequalification requirements;

5. Pre-qualification of bidders;

6. Sell the bidding documents to the bidders who have passed the prequalification;

7. Organize bidders to inspect the project site and answer questions;

8. Organize the formulation of bid evaluation methods;

9. Accept the bidder's tender and review its compliance;

10. Organize the establishment of a bid evaluation committee or a bid evaluation team to conduct bid evaluation and recommend the winning bidder;

12. The project legal person signs a construction supervision contract with the winning bidder. Article 11 A project legal person or an entrusted agency engaged in bidding shall meet the following conditions:

1. Have the ability to organize the preparation of supervision bidding documents for waterway engineering construction;

2. Have the ability to review the qualification of tendering units for construction supervision of waterway engineering;

3. Ability to organize bid opening, bid evaluation and calibration activities. Article 12 The main contents of supervision bidding Announcement (Invitation Letter) on Waterway Engineering Construction:

1. An overview of the project subject to tender, including the project name, location, supervision scope, construction period, investment situation and the types, structures, scale and quantity of major projects;

2. The bidding method, time and place, and the starting and ending time and place of submitting the bidding application;

3. Qualification requirements for the tendering units;

4. The content requirements of the bid application;

5. Other matters.
