Regulations on government supervision work

Article 1 These Regulations are formulated in order to strengthen and standardize government supervision, ensure the smooth implementation of government decrees, improve administrative efficiency, promote the building of a clean government and improve the administrative supervision system. Article 2 The term "government supervision" as mentioned in these Regulations refers to the supervision and inspection organized by the people's governments at or above the county level within the scope of their statutory functions and powers according to the needs of their work. Article 3 The government supervision work shall uphold and strengthen the leadership of the Party, take the people as the center, serve the overall situation, seek truth from facts, promote administration according to law, promote policy implementation and problem solving, and refrain from formalism and bureaucracy. Article 4 The contents of government supervision include:

Implementing the major decision-making arrangements of the CPC Central Committee and the State Council;

(two) the implementation of the important work arrangements of the superior and the people's government at the same level;

(three) the performance of the statutory duties of the object of supervision;

(four) the administrative efficiency of the people's governments at the corresponding levels and the people's governments at lower levels. Article 5 The objects of government supervision include:

Departments under the people's government at the corresponding level;

(2) People's governments at lower levels and their subordinate departments;

(3) Organizations authorized by laws and regulations to manage public affairs;

(4) Organizations entrusted by administrative organs to manage public affairs.

The people's governments at higher levels may supervise the people's governments at lower levels and their subordinate departments, and may supervise the people's governments at all levels and their subordinate departments under their jurisdiction when necessary. Article 6 The General Office of the State Council shall guide the inspection work of the national government and organize the implementation of inspection work in the State Council. The supervision organization of the State Council General Office undertakes the specific work of the State Council supervision.

The supervision institutions of local people's governments at or above the county level shall organize and implement the supervision work of the people's governments at the corresponding levels. The forms and specifications for the establishment of supervision institutions of local people's governments at or above the county level shall be handled in accordance with the relevant provisions on the establishment and management of institutions.

The supervision institutions of the State Council General Office and local people's governments at or above the county level are collectively referred to as government supervision institutions. Seventh people's governments at or above the county level may designate their subordinate departments to carry out government supervision in accordance with the designated matters, scope, responsibilities and time limit.

Without the designation of the people's government at the corresponding level, the working departments of the people's governments at or above the county level shall not carry out government supervision. Eighth people's governments at or above the county level may send inspection teams according to the needs of the work. The inspection team shall carry out government supervision in accordance with the inspection items, scope, responsibilities and time limit determined by the people's government at the corresponding level. The inspection team is responsible to the people's government at the corresponding level.

The inspection team is responsible for the team leader, who is determined by the people's government at the corresponding level.

NPC deputies, CPPCC members, government counselors, experts and scholars can be invited to participate in the inspection team. Article 9 An inspector shall have the political quality, work style, professional knowledge, professional ability and legal literacy suitable for his supervisory work, abide by the Constitution and laws, be loyal to his duties, be fair and honest, keep secrets and consciously accept supervision.

Government supervision institutions shall conduct political, theoretical and professional training for inspectors. Tenth government supervision institutions to perform their duties required funds, should be included in the budget at the corresponding level. Eleventh government supervision institutions according to the decision of the people's government at the same level or the instructions made by the chief executive of the people's government at the same level within the scope of their functions and powers, to determine the supervision matters.

According to the major decision-making arrangements of the CPC Central Committee and the State Council, the important work arrangements of the superior and the people's government at the corresponding level, and the clues mastered, the government supervision institutions can put forward suggestions on supervision work, and determine the supervision matters after the approval of the chief executive of the people's government at the corresponding level. Twelfth government supervision can take the following ways:

Require the inspection object to conduct self-examination and explain the situation;

Listen to the report of the object of supervision;

(three) to carry out inspections, interviews and unannounced visits;

(4) Organizing discussion, hearing, statistics and evaluation;

(five) to consult and copy the information related to the supervision matters;

Collect clues through letters, telephone calls, media and other channels;

(seven) interview the person in charge of the inspection object or the relevant responsible person;

Using modern information technology to carry out "internet plus" inspection. Thirteenth government supervision work needs assistance, the relevant administrative organs shall give assistance within the scope of their functions and powers. Fourteenth people's governments at or above the county level can organize and carry out comprehensive supervision, special supervision, incident investigation, daily supervision, clue verification and other government supervision work. Fifteenth to carry out the work of government supervision, it shall formulate the supervision plan, and clarify the content, object and scope of supervision; It is necessary to strictly control the frequency and time limit of supervision, scientifically use supervision methods, strictly observe supervision discipline and train inspectors in advance.

The government supervision work shall strictly implement the supervision plan, and shall not arbitrarily expand the scope of supervision, change the object and content of supervision, and shall not interfere with the normal work of the object of supervision. Repeated supervision, multi-head supervision and ultra vires supervision are strictly prohibited. Sixteenth people's governments at or above the county level shall make a conclusion after the government supervision. The inspection conclusion related to the inspection object shall be fed back to the inspection object.

The inspection conclusion shall be clear in facts, sufficient in evidence, objective and fair. Seventeenth inspection objects have objections to the inspection conclusion, you can apply for review to the people's government that made the inspection conclusion within 30 days from the date of receiving the inspection conclusion. The people's government that receives the application shall make a review decision within 30 days. Staff involved in making inspection conclusions should be avoided during the review.
