Measures for examination and approval of railway crossing setting or widening pedestrian passage

Article 1 In order to strengthen the management of railway crossings and pedestrian walkways and ensure the safety of railway transportation, these Measures are formulated in accordance with the Regulations on the Safety Protection of Railway Transportation. Article 2 The railway crossing mentioned in these Measures means that the pavement width on the railway road is more than 2.5 meters, and it directly intersects with the running plane of the road. "Pedestrian walkway" means that the width of the road surface on the railway line is less than 2.5 meters, which directly crosses the plane where the road passes. Among them, the width of urban pedestrian walkways is generally 0.75 ~ 1.5m, and the width of rural pedestrian walkways is generally 0.4 ~1.2m. Animal-drawn vehicles and motor vehicles are prohibited from passing through pedestrian walkways. Article 3 The establishment or widening of railway crossings and pedestrian walkways on railway lines within the territory of People's Republic of China (PRC) shall be subject to approval. Article 4 To set up or widen a railway crossing, the following conditions shall be met:

(1) The running speed of passenger trains allowed to pass through the line is below 120km/h, the running speed of freight trains is below 80km/h, and the traction mass of freight trains is below 5,000t;

(2) The secondary and tertiary railways cross the road;

(three) the crossing spacing is more than 2 kilometers, and there is no bypass condition;

(4) When the allowable speed of the line is below 120km/h, vehicles or pedestrians should be able to see the trains 400m away from both sides; when the allowable speed of the line is below 100km/h, they should be able to see the trains 340m away from both sides; when the allowable speed of the line is below 80 km/h, they should be able to see the crossings 850m away from both sides;

(five) the road to be crossed by the crossing is orthogonal to the railway plane in principle, and the crossing angle should be greater than 45 degrees;

(6) The plane alignment of the road crossing should be straight; The minimum straight line length from the road to the outermost rail should not be less than 50 meters, urban roads should not be less than 30 meters under special circumstances, and rural roads should not be less than 20 meters; The longitudinal slope of the road connecting the crossing platform shall not be greater than 3%. Under difficult conditions, the urban roads of articulated cars are not less than 3.5%, the urban roads, highways and roads in different places of ordinary cars are not more than 5%, and the rural roads are not more than 6%.

(7) The railway crossing should be located outside the railway station, at a distance of 100 meters from both ends of the bridge and tunnel and at both ends of the turnouts of the section or special line, and at a distance of 50 meters;

(eight) in line with local urban planning and land use requirements;

(nine) in line with the relevant national railway and highway design specifications;

(ten) other requirements stipulated by laws and regulations. Article 5 To set up or widen a pedestrian passage, the following conditions shall be met:

(1) Allow the running speed of railway passenger trains passing through the line to be below 120km/h;

(two) the distance between the pedestrian walkway and the existing railway crossing corridor in the residential area is more than 500 meters and there is no bypass condition;

(3) Good observation conditions;

(four) the location of the pedestrian walkway should be outside the railway station, away from both ends of the bridge and tunnel and the entrance signal 100 meters, and 50 meters away from both ends of the turnout of the section or special line;

(five) in line with local urban planning and land use requirements;

(6) Other conditions stipulated by laws and regulations.

In line with the requirements of the preceding paragraph, if the villages along the railway need to set up pedestrian walkways across the railway, in principle, only one natural village will be set up.

However, in areas where people are concentrated, trains are dense, and pedestrians are prone to accidents when crossing the railway, it is not necessary to set up pedestrian walkways if they may endanger the safety of railway transportation. Article 6 Due to special needs, an application can be made to set up a temporary railway crossing whose service time does not exceed 1 year. The establishment of a temporary railway crossing shall meet the conditions stipulated in Article 4 of these Measures, formulate effective and reliable safety measures, set up necessary protective facilities and equipment, announce the service life, and set up guards. Article 7 An application shall be submitted to the railway management institution for setting up or widening a railway crossing or pedestrian passage. Where a railway crossing or pedestrian passage is set up or widened on a newly built, rebuilt or expanded railway line, the construction unit shall apply before the project starts. Article 8 To apply for setting up or widening a railway crossing or pedestrian passage, the following materials shall be submitted:

(1) An application for administrative license;

(2) the identity certificate of the applicant;

(3) documents such as the location, width, safety protection measures and feasibility analysis of setting or widening railway crossings and pedestrian crossings;

(four) the plan of the railway crossing and pedestrian passage to be set up or widened;

(five) new construction, reconstruction and expansion of roads or railways, but also need to provide project approval documents and design documents in line with the procedures prescribed by the state;

(six) to apply for the establishment or widening of railway crossings, it is also necessary to provide consultation opinions with relevant property rights units;

(seven) other materials required by laws and regulations.

The application for administrative license adopts the format text. The format text is provided by the Railway Bureau. Article 9 After receiving the application materials, the railway administration institution shall timely examine them and make a decision on whether or not to accept them. If the accepted application belongs to setting up or widening railway crossings and pedestrian walkways in cities, the railway management institution shall review it jointly with the city planning department; If the accepted application belongs to setting up or widening railway crossings and pedestrian walkways outside the city, the railway management institution shall examine it jointly with the local people's government.

To carry out the examination specified in the preceding paragraph, and hire experts to conduct the examination when necessary.
