Provisions of Beijing Municipality on the Administration of Slogans and Publicity Materials (revised in 2007)

Article 1 These Provisions are formulated in accordance with the Regulations of Beijing Municipality on City Appearance and Environmental Sanitation for the purpose of strengthening the administration of the setting of slogans and publicity materials in this Municipality and maintaining a clean and beautiful city appearance and environment. Article 2 These Provisions shall apply to the setting up of slogans and publicity materials on roads, squares, stations and other public places and buildings and structures facing the street within the administrative area of this Municipality. Article 3 The municipal administrative department shall be responsible for the establishment and management of slogans and publicity materials in this Municipality, and the district and county municipal administrative departments shall be responsible for the establishment and management of slogans and publicity materials within their respective administrative areas in accordance with the division of labor.

Traffic, public security, planning and other administrative departments shall, in accordance with their respective responsibilities, do a good job in corresponding management according to law. Article 4 Slogans and publicity materials shall not contain commercial advertisements. It is forbidden to change the nature of the use of fixed publicity facilities for commercial advertising. Fifth fixed publicity facilities should be set up in accordance with the plan. Fixed publicity facilities planning into outdoor advertising planning, by the municipal administrative department in conjunction with the planning, transportation and other administrative departments to co-ordinate the preparation.

Fixed publicity facilities include billboards, light boxes, electronic display screens, etc. Article 6 It is forbidden to use public facilities such as transportation, lighting, electric power, communication and postal services to set up slogans and publicity materials in the following areas. But in the national political, diplomatic and major events need to set up slogans and promotional materials, decided by the Municipal People's government:

(1) Tiananmen Square area;

(2) Zhongnanhai office area starts from the intersection of Fu You Street in Jinwen Street in the north, the area along Chang 'an Street in Fu You Street in the south, the intersection of Fu You Street in Jinwen Street in the west, the intersection of Beijiang Street in Jinwen Street in the east, the intersection of Beijiang Street in Jinwen Street in the north and the intersection of Chang 'an Street in Nanchang Street in the south;

(3) Chang 'an Street (that is, the section from Jianguomen in the east to Fuxingmen in the west, the same below), Second Ring Road and Expressway. Seventh fixed publicity facilities are mainly used to set up slogans and promotional materials. If it is really necessary to hold activities, temporary slogans and promotional materials can be set up in the venue and its surrounding areas by using balloon banners, inflatable devices, publicity flags, exhibition boards and other carrier forms; If there is no activity place, no temporary slogan propaganda materials shall be set up.

Set up temporary slogans and promotional materials, and the setting period shall not exceed the activity period; If the activity period exceeds one month, the setting period shall not exceed one month. Eighth fixed publicity facilities, in line with the "Beijing outdoor billboards technical specifications".

The specifications, materials and forms of temporary slogan publicity materials shall conform to the prescribed setting standards. The specific setting standards shall be formulated and promulgated by the municipal administrative department. Article 9 The establishment of slogans and publicity materials shall be approved by the municipal administrative department. However, the political and diplomatic activities of the state and the activities of state organs to publicize and implement laws and regulations are excluded. Article 10 The following conditions shall be met for setting up slogans and publicity materials:

(1) meeting the prescribed standards;

(two) in harmony with the surrounding urban environment;

(three) the content conforms to the provisions of laws, regulations and rules and the requirements of social morality;

(four) the publicity activities held shall be approved by the relevant departments according to law, and shall be approved;

(five) other conditions stipulated by laws, regulations and rules. Eleventh in more than two districts and counties within the scope and the following areas, the municipal administrative department is responsible for the examination and approval:

(1) Tiananmen Square area;

(2) Chang 'an Street, various ring roads and expressways;

(3) Capital Airport and Beijing West Railway Station.

The examination and approval of the establishment of slogans and publicity materials other than those specified in the preceding paragraph shall be implemented by the district and county municipal administrative departments in the place of establishment. Twelfth applications for the establishment of slogans and promotional materials, the following application materials shall be submitted:

(1) An application form for setting up slogans and publicity materials;

(2) Color renderings of slogans and promotional materials;

(3) Activity plan and approved publicity plan;

(four) certification materials that meet the requirements of items (1), (4) and (5) of Article 10 of these Provisions.

After receiving the application, the municipal administrative department shall accept it immediately if the application materials are complete and conform to the prescribed form; If the materials are incomplete or do not conform to the prescribed form, the applicant shall be informed of all the contents that need to be corrected at one time. Thirteenth municipal administrative departments shall make a decision of approval or disapproval within 05 working days from the date of acceptance. If the establishment is approved, it shall be served on the applicant within 2 working days from the date of making the approval decision; If it is not approved, it shall explain the reasons in writing.

The decision to approve the establishment shall be made public. Article 14 Where slogans and publicity materials are set after examination and approval, the approver shall set them according to the approved scope, location, quantity, specifications, content and time limit. Fifteenth publicity facilities should be set up to ensure the safety, firmness and normal use of facilities; When setting up slogan publicity materials, they should be kept clean and beautiful, without damage or deformity.

After the expiration of the establishment period or the end of the festival activities, the slogans and publicity materials shall be removed in time. Sixteenth slogans and promotional materials shall not be portrayed, scribbled or sprayed on buildings and structures that affect the city appearance and environmental sanitation; It shall not affect the use safety of public facilities such as transportation, lighting, electricity and communication.
