Regulations of Sichuan Province on Liquor Management
All enterprises and individual industrial and commercial households engaged in liquor production, transportation and sales in Sichuan shall abide by these regulations. Article 3 The administrative departments of liquor monopoly at all levels (hereinafter referred to as liquor management departments) shall be responsible for the management of liquor industry within their respective administrative areas, and exercise the functions of overall planning, guidance, coordination, supervision and service. Its main responsibilities are: to assist the planning department in formulating liquor development plans; Supervise and inspect alcohol production and sales activities; Participate in the examination and issuance of liquor production and operation licenses; To formulate various quality standards for alcohol jointly with the technical supervision department; Participate in the organization and coordination of famous wine appraisal according to the unified deployment of the state.
Planning departments at all levels shall, jointly with the liquor management departments and the competent departments of liquor production enterprises, prepare and review the investment plans for the capital construction and technological transformation of wineries.
The competent departments of liquor production and sales enterprises should strengthen the management of their subordinate liquor production and sales enterprises. Its main responsibilities are: to urge subordinate enterprises to implement alcohol laws, regulations, principles and policies; Prepare the liquor development plan and draft plan of this system; Review the investment plans for capital construction and technical transformation of wineries in this system; Participate in the examination of liquor production and sales license; Guide subordinate enterprises to strengthen technological transformation, improve product quality, improve management, reduce costs, strengthen comprehensive utilization and improve economic benefits.
Industry and commerce administration, health, technical supervision (standard measurement), price, taxation, public security, traffic management and other departments shall, according to their respective functions, cooperate with the liquor management department to do a good job in liquor management, inspection and supervision. Article 4 A licensing system shall be implemented for the production and wholesale of alcoholic beverages. Liquor production and marketing licenses shall be reviewed by the relevant departments of the Planning Commission at all levels, and the production enterprises shall be approved and issued by the Planning Commission; Wholesale enterprises are approved and issued by the liquor management department. License management shall be handled in accordance with the Measures for the Implementation of Sichuan Liquor Production and Marketing License System. Article 5 The investment in capital construction and technological transformation of all kinds of wineries shall be reported to the municipal, prefectural and state planning departments for examination and approval according to the procedures for investment in fixed assets. Article 6 An alcohol production enterprise shall have a venue, facilities, technology, testing methods, hygiene and safety conditions that meet the requirements of alcohol production, and meet the relevant state regulations on environmental protection, and obtain a license for alcohol production and sales in accordance with the regulations, and can only put into production after being approved and registered by the administrative department for industry and commerce. Seventh liquor production enterprises should ensure the quality of products, develop famous wines and new products, save food and comprehensively utilize by-products.
Liquor products should be produced according to the standard, and the quality inspection must be strictly carried out before leaving the factory, and a certificate of approval must be issued. Labels shall be marked according to the national Food Labeling Standards and Beverage and Wine Labeling Standards. Wine that does not meet the standard is not allowed to leave the factory. It is forbidden to produce fake wine, inferior wine and counterfeit brand wine.
The processing and restructuring of liquid wine must be approved by the municipal, prefectural and state liquor management departments, and edible alcohol with grain or molasses as raw materials that meets the national second-class standards must be used; It is forbidden to use synthetic alcohol, hydrolyzed alcohol, industrial alcohol, methanol and additives harmful to human health. Article 8 The joint venture of liquor enterprises shall unify the production technology, quality standards and trademark identification, unify the blending of finished products and the ex-factory price of famous liquor, and ensure the quality of famous liquor. It is forbidden to counterfeit famous wines. Ninth liquor wholesale business is mainly operated by state-owned sugar liquor companies and supply and marketing cooperatives engaged in non-staple food wholesale. Liquor production enterprises can engage in the wholesale business of liquor products produced by their own enterprises; The supply and marketing institutions of the competent departments of liquor production enterprises can engage in the wholesale business of liquor products produced by this system. Other enterprises engaged in liquor wholesale business must be examined and approved by the provincial, municipal, prefectural and state liquor management departments. Individual industrial and commercial households shall not engage in liquor wholesale business.
Liquor wholesale enterprises should have registered capital, business premises and storage facilities that meet the requirements, have a sound management system, have professionals who are familiar with liquor knowledge, accurate measuring instruments and meet the requirements of sanitary conditions, and obtain liquor production and operation licenses in accordance with regulations before engaging in liquor wholesale business.
The planned allocation and wholesale business of national famous wines is managed by state-owned sugar and liquor companies. After the national famous winery completes the planned distribution task, it can wholesale the national famous wine produced by the factory to the enterprises with the right to operate. Enterprises without approval shall not engage in the national famous wine wholesale business. Article 10 The import and export of alcohol must be strictly controlled to ensure the quality. When transferring alcohol from outside Sichuan, the transferring unit must issue the inspection certificate issued by the health quality supervision institution at or above the county level; Liquor products transferred from outside the city (county) must have the product quality certificate of the production enterprise. Article 11 The national famous wines shall be subject to a transportation permit system. The transportation department is engaged in transportation business with the transportation license issued by the liquor management department at the place of departure. Twelfth liquor retail enterprises and individual industrial and commercial households can only purchase goods from liquor production and wholesale enterprises with liquor production and sales licenses. Doping, adulteration, degradation and shoddy are prohibited. It is strictly prohibited to sell fake wine, inferior wine, deteriorated wine and counterfeit brand wine. It is strictly forbidden to make drinks and wine for sale. The sale of bulk wine must indicate the name, alcohol content and price.
The retail business of national famous wines is operated by enterprises designated by local liquor management departments. Unauthorized enterprises and individual industrial and commercial households shall not engage in the retail business of national famous wines.
