Regulations on the protection of Nanjing city walls

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Regulations on the Protection of Famous Historical and Cultural Cities and Towns in Jiangsu Province and the actual situation of this Municipality in order to strengthen the protection of Nanjing city walls, promote the rational utilization of the city walls and highlight the characteristics of famous historical and cultural cities. Article 2 The term "Nanjing City Wall" as mentioned in these Regulations refers to the city wall of the former capital (including Miyagi, Imperial City, Beijing, Waiguo and its affiliated buildings), including city walls (gates), moats, city wall relics and city wall ruins. Article 3 These Regulations shall apply to the planning, protection, utilization and management of city walls within the administrative area of this Municipality. Article 4 The protection of city walls shall follow the principles of giving priority to protection, scientific planning, rational utilization and management according to law. Article 5 The Municipal People's Government shall strengthen its leadership over the protection of city walls and incorporate the protection of city walls into the national economic and social development plan. The funds for the protection, maintenance and management of city walls are included in the annual budget.

The District People's Government shall cooperate with the work related to the protection of city walls within its jurisdiction. Article 6 The Municipal People's Government shall set up a city wall protection committee, which shall be responsible for coordinating and guiding major issues of city wall protection.

The municipal administrative department of cultural heritage protection is the competent department of city wall protection, and its subordinate city wall protection and management institutions are responsible for the specific work of city wall protection and management. Article 7 The Municipal People's Government shall protect the city wall in accordance with the relevant standards of world cultural heritage, organize systematic rescue repair of the city wall, arrangement, excavation, display and utilization of historical and cultural relics, environmental improvement and restoration of historical features along the line, and display the city wall culture such as its evolution and construction technology by setting up museums and ruins parks. Article 8 The administrative department in charge of cultural heritage protection shall organize publicity and education on wall protection, enhance the public's awareness of wall protection, and do a good job in the protection of intellectual property rights related to the wall.

Encourage non-governmental volunteer organizations and their members to participate in the publicity of cultural relics of the city wall.

Encourage scientific research on wall protection, establish an expert consultation mechanism, and promote the application of scientific and technological achievements in wall protection. Ninth all units and individuals have the obligation to protect the city wall, and have the right to stop and report the damage and destruction of the city wall.

Encourage domestic and foreign organizations and individuals to set up city wall protection funds. The raising and use of funds shall be carried out in accordance with the relevant provisions of the state.

The Municipal People's Government or the municipal administrative department of cultural heritage protection shall commend and reward the units and individuals that have made remarkable achievements in the protection of city walls. Chapter II Protection and Utilization Article 10 The Municipal People's Government shall organize the preparation of a city wall protection plan and submit it to the provincial people's government for approval. The city wall protection plan shall not be changed without authorization. If it is really necessary to change, it shall be submitted for approval in accordance with the original approval procedures.

The preparation of the city wall protection plan should be connected with the protection plan of Nanjing historical and cultural city, and the opinions of the public, experts and relevant departments should be widely solicited.

The approved city wall protection plan should be incorporated into the regional regulatory detailed planning, which is the basis for the protection, management and utilization of the city wall. Article 11 The scope of protection of city walls shall be delineated.

According to Nanjing City Wall Protection Plan, Beijing City Wall is divided into general sections and special sections. The protection scope of the city wall in general sections extends from both sides of the base of the city wall to not less than15m, and the protection scope of the city wall in special sections is determined according to the city wall protection plan.

The scope of protection of Miyagi and Imperial City is determined according to the Master Plan for the Protection of the Site of the Ming Palace in Nanjing.

The protection scope of fruiting body is bounded by 30 to 50 meters on both sides of the wall base (body). Twelfth city walls and their scope of protection prohibit the following acts:

(a) the construction of buildings (structures) and outdoor advertising facilities unrelated to the protection or rational utilization of city walls;

(two) engaged in construction, blasting, drilling, excavation and stacking operations that may affect the safety of the city wall;

(3) Depicting, painting and posting on city walls and city wall protection signs;

(four) dumping garbage and waste endangering the safety of the city wall;

(5) Erecting and installing equipment and devices unrelated to the protection and rational utilization of city walls;

(six) demolition of the city wall to take bricks, quarrying or soil, planting crops;

(seven) piling, hanging, drilling and laying slurry on the wall without authorization;

(8) storing inflammable and explosive articles;

(nine) engaged in activities that endanger the safety of the city wall, such as humidity, high temperature, radiation and vibration;

(ten) other prohibited acts as prescribed by laws and regulations. Thirteenth municipal and district people's governments should strengthen the management of landscaping within the scope of city wall protection, and build a green belt that is in harmony with the city wall landscape and environmental ecology.

Trees and vines that endanger the existing city wall shall not be planted within eight meters on both sides of the city wall; Eight meters away from both sides of the city wall and within the scope of protection, tree species that do not cover the city wall and roots and do not destroy the city wall should be selected. The existing trees that affect the safety of the city wall should be moved, and the trees that block the city wall should be trimmed or moved. Plants that endanger the safety of the wall should be cleaned regularly on both sides of the wall and at the top of the wall.

The sites, relics and greening on both sides of the city wall should be coordinated with the scenic belt of the Ming city wall. Fourteenth outside the scope of protection of the city wall, delimit the construction control zone.

The construction control zone extends not less than 50 meters outside the scope of protection. The construction control zone of the special section of Beijing city wall is determined according to the city wall protection plan.

According to the "Nanjing Ming Palace Site Protection Master Plan", the construction control zones of Miyagi and Imperial City were determined.

The building (structure) built in the construction control zone shall not exceed the height of the city wall in this area, among which the remains and relics shall not exceed12m, and the range outside the construction control zone100m shall not exceed18m; The volume, style, color and density shall meet the requirements of the city wall protection planning, be in harmony with the surrounding environment, and go through the relevant examination and approval procedures according to law.

If it is really necessary to break through the above-mentioned height control standards for the benefit of * * *, an analysis shall be made on the impact of landscape sight, which shall be announced to the public and reported to the Municipal People's Government for approval.

Industrial projects and large-scale commercial facilities shall not be built in the construction control zone.
