Regulations on the protection and management of ancient and famous trees in Linxia Hui Autonomous Prefecture

Chapter I General Provisions Article 1 In order to strengthen the protection of ancient and famous trees and their follow-up resources, inherit history and culture, continue to promote the construction of ecological civilization, promote the rational development and utilization of forestry resources, and help the local development of eco-cultural tourism industry, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Environmental Protection Law of People's Republic of China (PRC), the Urban Greening Regulations of the State Council and other laws and regulations, and in combination with the actual situation of Autonomous Prefecture. Article 2 These Regulations shall apply to the protection and management of ancient and famous trees and their follow-up resources in Autonomous Prefecture (hereinafter referred to as ancient and famous trees).

Wild plants under special state protection shall be implemented in accordance with the relevant provisions of laws and administrative regulations. Article 3 The term "ancient trees" as mentioned in these Regulations refers to trees that are more than 100 years old. Any tree that is over 500 years old is a first-class ancient tree, those that are over 300 years old but less than 500 years old are second-class ancient trees, and those that are over 100 years old but less than 300 years old are third-class ancient trees. Article 4 The term "ancient trees" as mentioned in these Regulations refers to trees that are precious, rare or have important historical value, commemorative significance and scientific research value. Famous trees are not restricted by age and are not graded. Article 5 The term "follow-up resources of ancient trees" as mentioned in these Regulations refers to trees that are more than 80 years old but less than 100 years old. Article 6 The protection and management of ancient and famous trees shall adhere to the principles of government leading, territorial management, legal protection, local protection, scientific management and protection, and social participation. Article 7 The people's governments of autonomous prefectures and counties (cities) shall strengthen the organization and leadership of the protection and management of ancient and famous trees, incorporate the protection of ancient and famous trees into the national spatial planning, and include the funds for the protection of ancient and famous trees in the fiscal budget at the corresponding level. Eighth autonomous prefecture and county (city) people's government administrative department of forestry is the administrative department in charge of the protection and management of ancient and famous trees (hereinafter referred to as the administrative department of ancient and famous trees). Specifically undertake the following responsibilities:

(a) the investigation and registration of ancient and famous trees, organization identification, approval and publication, the establishment of archives.

(two) the formulation of ancient and famous trees conservation management, rescue and rejuvenation plan, to carry out business training and technical guidance.

(three) regularly investigate the growth of ancient and famous trees, and supervise and inspect the management and protection.

(four) to carry out historical research, cultural excavation, publicity and education, scientific research on the protection of ancient and famous trees, popularize the application of scientific research results, and popularize the protection knowledge.

(five) to accept suggestions, reports and complaints related to ancient and famous trees.

(six) other duties as prescribed by laws and regulations.

Autonomous Prefecture, county (city) people's government housing construction, natural resources, finance, public security, ecological environment, agriculture and rural areas, water conservancy, transportation, cultural tourism and other departments within the scope of their respective duties and responsibilities with the administrative departments of ancient and famous trees to do a good job in the protection and management of ancient and famous trees.

Township (town) people's governments and subdistrict offices shall cooperate with the administrative departments of ancient and famous trees to implement the specific protection and management responsibilities of ancient and famous trees within their respective jurisdictions.

Village (neighborhood) committees shall assist the township (town) people's governments and sub-district offices in the protection and management of ancient and famous trees within their respective jurisdictions. Ninth citizens, legal persons and other organizations have the obligation to protect ancient and famous trees and their ancillary facilities (signs, guardrails, support frames, lightning protection devices, etc.). ). Have the right to discourage and report the damage and destruction of ancient and famous trees and their ancillary facilities. Tenth administrative departments of ancient and famous trees should actively explore the management mode of "Internet plus ancient and famous trees" and establish the protection and management system of ancient and famous trees. Eleventh units and individuals are encouraged to participate in the protection and management of ancient and famous trees through donations and adoption, and use social capital to protect and manage ancient and famous trees. Donors and adopters can enjoy the right to sign on the protection and management signs of ancient and famous trees. Twelfth organizations or individuals that have made remarkable achievements in the protection and management of ancient and famous trees shall be commended and rewarded by the people's governments of autonomous prefectures and counties (cities). Chapter II Appraisal Article 13 The first-class ancient and famous trees shall be appraised by the county (city) administrative department of ancient and famous trees. After being audited by the administrative department of ancient and famous trees in the Autonomous Prefecture, it shall be examined and approved by the people's government of the Autonomous Prefecture, recognized and announced by the provincial people's government, and reported to the administrative department of ancient and famous trees in the State Council for the record.

Two ancient trees by the county (city) administrative departments of ancient and famous trees. After being audited by the administrative department of ancient and famous trees in Autonomous Prefecture, it shall be reported to the people's government of Autonomous Prefecture for confirmation and publication, and shall be reported to the administrative department of ancient and famous trees in the province for the record.

Three ancient trees and follow-up resources are identified by the administrative department of ancient and famous trees in the county (city), confirmed and published by the people's government of the county (city), and reported to the administrative department of ancient and famous trees in the Autonomous Prefecture for the record. Fourteenth Autonomous Prefecture People's Government shall organize a statewide survey of ancient and famous trees every ten years, and strengthen supplementary investigation and daily monitoring during the interval of the survey, timely grasp the changes of resources, and establish a dynamic database of ancient and famous trees resources.

County (city) administrative departments of ancient and famous trees shall check the first-class ancient and famous trees once every six months, and check the second-class ancient and famous trees, third-class ancient and famous trees and follow-up resources once a year.

County (city) administrative departments of ancient and famous trees found that the growth of ancient and famous trees is abnormal or environmental conditions affect the growth of ancient and famous trees, they should take rescue measures first and report to the administrative departments of ancient and famous trees at the next higher level. Article 15 The signs for the protection and management of ancient and famous trees shall be uniformly produced and numbered by the Autonomous Prefecture People's Government, indicating the Chinese name, Latin scientific name, family and genus, age, protection level, number, unit or individual responsible for management and protection, listed appraisal unit, appraisal time and QR code of ancient and famous trees.
