Regulations of Chengdu Municipality on the Administration of Outdoor Advertisements and Signboards (20 12)

Chapter I General Provisions Article 1 In order to standardize the planning, installation and management of outdoor advertisements and signboards, these Regulations are formulated in accordance with the provisions of the Advertising Law of People's Republic of China (PRC), the Urban and Rural Planning Law of People's Republic of China (PRC), and the Regulations on the Administration of Urban Appearance and Environmental Sanitation of the State Council, taking into account the actual situation in Chengdu. Article 2 These Regulations shall apply to the installation of outdoor advertisements and signboards and their supervision and management activities in the following areas of this Municipality:

(1) Central cities;

(two) the district (city) county people's government is located in the city;

(three) the town (township) people's government is located in the built-up area;

(four) areas where urbanization management is implemented, such as industrial concentrated development areas and new rural communities;

(five) within the administrative area of this Municipality, the scope of the municipal highways and national highways, provincial highways, county roads, township roads and the building control areas on both sides.

The areas listed in Item (4) of the preceding paragraph shall be designated and announced by the district (city) county people's government and reported to the Municipal People's government for the record. Article 3 The term "outdoor advertising" as mentioned in these Regulations refers to the act of publishing advertisements to outdoor public spaces by using the following carriers such as words, images, electronic display devices and physical modeling:

(a) buildings and their ancillary plots and ancillary facilities;

(two) bridges, squares, tunnels and other structures and their ancillary plots and supporting facilities;

(three) roads, public green spaces, waters and other public open spaces;

(4) Municipal facilities such as newsstands, place name signs, information kiosks, telephone booths, taxi stop signs, bus shelters and stop signs (piles);

(five) other carriers that can carry outdoor advertisements.

These Regulations apply to users of underground public spaces such as urban rail transit stations, entrances and exits, and passages. Advertise to an unspecified public.

Signboard installation as mentioned in these Regulations refers to the setting of signs, signs, light boxes, neon lights and font symbols used to indicate names, shop names and business names on buildings (structures) and their ancillary facilities in commercial (office) places. Article 4 The setting of outdoor advertisements and signboards shall conform to the planning of outdoor advertisements and signboards, adapt to the function of regional planning, and coordinate with the building style and surrounding environment. Fifth city administrative departments responsible for the supervision and management of outdoor advertising and signs; The traffic administrative department is responsible for the supervision and management of outdoor advertising in the control area of highways and buildings on both sides.

The public security organs, the administrative departments for industry and commerce and the administrative departments for planning, construction, civil affairs and gardens shall, in accordance with their respective duties, cooperate with the administrative departments of urban management to implement these Regulations. Chapter II Planning and Standardization Article 6 The outdoor advertising planning of the central city shall be compiled by the municipal planning administrative department in conjunction with the municipal urban management administrative department and submitted to the Municipal People's Government for approval; Outdoor advertising planning in other regions shall be prepared by the district (city) county planning administrative department in conjunction with the city management administrative department and reported to the people's government at the same level for approval.

Outdoor advertising planning of expressways, national highways, provincial highways and building control areas on both sides of this Municipality shall be prepared by the municipal transportation administrative department and reported to the Municipal People's Government for approval; Outdoor advertising planning in the control area of county roads, township roads and buildings on both sides shall be compiled by the district (city) county traffic administrative department and reported to the people's government at the same level for approval.

Outdoor advertising planning approved for promulgation and implementation shall not be changed without authorization; If adjustment is really necessary, it shall be submitted for approval in accordance with the original examination and approval procedures. Seventh outdoor advertising planning should control the total amount and layout of outdoor advertising in the planning area, determine the road sections and areas where outdoor advertising is allowed and prohibited, and plan an appropriate number of public service advertising spaces. Article 8 The municipal administrative department of urban management and transportation shall, in accordance with the technical standards of national, provincial and municipal urban and rural planning, city appearance and environmental protection, jointly with relevant departments, formulate technical specifications for outdoor advertisements and signboards. Ninth planning, urban management and transportation administrative departments shall take the form of hearings, argumentation meetings and symposiums to listen to the opinions of experts and the public before compiling the planning and technical specifications for outdoor advertising. Tenth outdoor advertising planning, outdoor advertising and signboard setting technical specifications are the main basis for the approval of outdoor advertising and signboard setting by the competent department of urban management and transportation administration.

Planning, urban management, transportation and other administrative departments shall disclose the technical specifications for outdoor advertising planning, outdoor advertising and signboard setting, so as to facilitate the inquiry and supervision of setters, interested parties and the public. Chapter III Management of Outdoor Advertisements Article 11 No outdoor advertisements may be set up under any of the following circumstances:

(a) endangering the safety of the use of buildings (structures);

(two) the use of traffic safety facilities, traffic signs;

(3) Obstructing the normal use of traffic safety facilities and traffic signs;

(four) affect the normal use of municipal public facilities;

(five) affect the fire fighting and rescue;

(six) the use of street building glass;

(seven) the use of the roof of the building;

(eight) the use of trees or damage to green space;

(nine) other circumstances in which laws, regulations and plans prohibit the installation of outdoor advertisements.
