Trial Measures of Suzhou Municipality on Relatively Centralized Administrative Punishment Right in Urban Management

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Administrative Punishment Law of the People's Republic of China and relevant laws, regulations and rules, combined with the actual situation of this Municipality, in order to strengthen urban management and actively promote the pilot work of relatively centralized administrative punishment power. Article 2 These Measures shall apply to the built-up areas of Suzhou. Third Suzhou City Administration and Law Enforcement Bureau is responsible for organizing the implementation of these measures.

City, district urban management administrative law enforcement bureau (hereinafter referred to as the law enforcement bureau) is the administrative organ of the government at the same level with relatively centralized power of administrative punishment. Have the independent qualification of law enforcement subject, exercise the relatively centralized power of administrative punishment, investigate and deal with illegal acts, and bear legal responsibility for specific administrative acts. Article 4 After the power of administrative punishment is relatively centralized, the original relevant administrative law enforcement departments may no longer exercise the power of administrative punishment that has been centralized by the law enforcement bureau; If it is still exercised, the decision on administrative punishment made is invalid. Article 5 The Municipal Law Enforcement Bureau shall set up a law enforcement brigade and an inspection brigade directly under it to enforce the law in the name of the Municipal Law Enforcement Bureau; The District Law Enforcement Bureau has set up several law enforcement squadrons to enforce the law in the name of the District Law Enforcement Bureau. Sixth District Law Enforcement Bureau to implement dual management:

(a) the district government (CMC) is responsible for the administrative relations, salary relations and organizational relations of the personnel of the district law enforcement bureau;

(two) the Municipal Law Enforcement Bureau is responsible for the business guidance, coordination, assessment, supervision and emergency dispatch and command of the District Law Enforcement Bureau;

(3) The person in charge of the District Law Enforcement Bureau shall be inspected by the district organization department, and after fully listening to the opinions of the Municipal Law Enforcement Bureau, the district shall appoint or remove him according to the prescribed procedures. Article 7 Administrative law enforcement personnel shall meet the requirements of national civil servants, adopt examination and assessment methods, implement fair competition, and select the best candidates; Administrative law enforcement personnel shall be appointed, and those who are incompetent for law enforcement positions shall be dismissed. Eighth city and district law enforcement bureau funds included in the financial budget of the people's government at the same level, fully funded by the financial. Fees and incomes from fines and confiscations shall not be used as sources of funds. Article 9 The Law Enforcement Bureau relatively concentrates on exercising the power of administrative punishment for all administrative violations in the management of city appearance and environmental sanitation, and part of the power of administrative punishment in urban planning, greening, industry and commerce, environmental protection, municipal administration, water conservancy (water supply) and public security traffic management. Chapter II City Appearance and Environmental Sanitation Article 10 Anyone who commits any of the following acts may be ordered to correct the illegal act, take remedial measures, give a warning and a fine, and may detain the working tools:

(a) spitting, urinating, littering cigarette butts, peels, scraps of paper and other wastes, and dumping sewage, with a fine of 10 yuan; Dumping garbage, sewage, feces and other wastes into roads, ponds and other places shall be fined1over 0 yuan 100 yuan;

(two) graffiti or unauthorized display and posting of promotional materials on urban buildings, facilities and trees. , a fine of more than 20 yuan and less than 200 yuan; Hanging banners, slogans and other items on primary and secondary roads without approval will be fined 10 yuan to 100 yuan;

(III) In the balconies and windows of buildings facing the street on primary and secondary roads, if items that are unsightly are displayed, stacked or hung, a fine of less than 10 yuan 100 yuan shall be imposed;

(4) Failing to dump garbage and feces within the specified time, and being fined 10 yuan; Failing to dump garbage and feces at the specified place, each time a fine of 10 yuan and 100 yuan will be imposed; Failing to dump garbage and feces in the prescribed way, a fine of 10 yuan shall be imposed; Failing to dump garbage and feces in the prescribed way, resulting in fouling, and imposing a fine of 10 yuan to 3,000 yuan;

(5) If liquid or bulk goods are not sealed, wrapped or covered, resulting in leakage or spillage, a fine of more than 5 yuan 10 yuan per square meter shall be imposed according to the polluted road area and pollution degree;

(VI) Street-facing construction sites are not provided with guardrails or are not covered, the shutdown sites are not covered in time, or the sites are not cleaned and leveled in time after completion, and sewage and sludge from construction sites overflow, which affects the city appearance and environmental sanitation, and a fine of not less than 3,000 yuan shall be imposed on 500 yuan;

(seven) dumping toxic and hazardous wastes into domestic waste containers or discharging or discarding them without authorization, and imposing a fine of more than 5,000 yuan in 200 yuan;

(eight) in the open air and public garbage containers burning leaves and other wastes, a fine of more than 20 yuan and less than 200 yuan;

(nine) stall operators can not keep the surrounding environment clean, a fine of 10 yuan and 100 yuan;

(ten) motor vehicles with mud driving in urban areas, a fine of more than 50 yuan and less than 500 yuan. Eleventh unauthorized feeding of livestock and poultry affect the city appearance and environmental sanitation, shall be ordered to deal with it within a time limit or be confiscated, and may be fined according to each 50 yuan above 10 yuan below. Twelfth one of the following acts, shall be ordered to stop the illegal act, a deadline to clean up, dismantle or take other remedial measures, and may be fined:

(a) without setting up large outdoor placards, galleries and plaques, which affect the city appearance, a fine of more than 5,000 yuan in 500 yuan;

(two) unauthorized stacking of materials, erection of buildings, structures or other facilities on both sides of the street and public places, which will affect the city appearance, and impose a fine of more than 5 yuan and less than 50 yuan per square meter per day according to the illegally occupied area;

(three) unauthorized removal of environmental sanitation facilities or not in accordance with the approved demolition plan, a fine of 5000 yuan;

(four) unauthorized establishment of kiosks, stalls, affecting the city, a fine of more than 50 yuan 1000 yuan.
