Regulations of Chongqing Municipality on the Administration of Outdoor Advertising (revised on 20 13)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Advertising Law of People's Republic of China (PRC), the Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and administrative regulations, and in light of the actual situation of this Municipality, in order to standardize the establishment, release and management of outdoor advertisements, maintain city appearance and environmental sanitation and promote the healthy development of the advertising industry. Article 2 These Regulations shall apply to the establishment, release and management of outdoor advertisements within the administrative area of this Municipality. Article 3 The term "outdoor advertising" as mentioned in these Regulations refers to commercial advertisements and public service advertisements published by using outdoor space, venues, facilities or buildings, which mainly include:

(a) the use of display panels, electronic display devices, electronic flip devices, projection, light boxes, neon lights, exterior walls and other settings to publish advertisements;

(two) placing, printing (painting), posting and hanging advertisements in the form of models, inflatable devices, cloth and posters;

(three) the use of vehicles, lift-off equipment and other mobile carriers to set up advertisements;

(four) other advertisements released by outdoor space. Article 4 The municipal departments of cities, districts and counties (autonomous counties) shall be responsible for the supervision and management of outdoor advertisements within the urban planning area.

City, county (Autonomous County) Department in charge of transportation is responsible for the supervision and management of outdoor advertising in highway construction control areas.

City, county (Autonomous County) industrial and commercial administrative departments responsible for the registration, supervision and management of outdoor advertising. Article 5 The installation and release of outdoor advertisements shall be safe and beautiful, in harmony with the surrounding environment, and shall not interfere with the functions of public facilities, damage the appearance of the city or infringe upon the legitimate rights and interests of others.

Outdoor advertising content should be true, legal and healthy, in line with the requirements of socialist spiritual civilization construction. Article 6 Outdoor advertisements set up and published according to law shall be protected by law. Chapter II Installation of Outdoor Advertisements Article 7 The installation of outdoor advertisements shall be planned in a unified way according to the characteristics, pattern, regional functions and road features of the city to ensure the cleanliness and beauty of the city.

Outdoor advertising planning should be clear about the location, specifications, shape and material of outdoor advertising.

The number, volume, form, location, shape, color, orientation, height and material of outdoor advertising facilities should be in harmony with the surrounding environment. Article 8 The municipal departments and transportation departments of cities, counties (autonomous counties) shall, in accordance with the division of responsibilities, obey the overall urban and rural planning, pay attention to safety, and work out outdoor advertising plans in conjunction with the relevant departments of industry and commerce, planning, construction, public security, etc. according to the principles of reasonable layout, standardized classification and beautiful coordination, and report to the people's government at the same level for approval before promulgation and implementation.

Urban outdoor advertising planning in the main city is organized by the municipal competent department; Outdoor advertising planning outside the main city is organized by the municipal competent department of the county (autonomous county).

Outdoor advertising planning in the expressway construction control area shall be organized by the municipal transportation department. In addition to the highway outside the highway construction control area, outdoor advertising planning shall be organized by the transportation departments of counties (autonomous counties). Ninth outdoor advertising planning should take the form of hearings, solicit the opinions of relevant industry associations, advertising operators, experts and the public.

Outdoor advertising planning shall be announced to the public by the approval authority within ten working days from the date of approval. Once the outdoor advertising plan is released, it shall not be changed at will. If it is really necessary to adjust, it shall solicit opinions from the society in accordance with the procedures stipulated in these regulations, report to the society for approval, and announce it to the public. Tenth outdoor advertising should comply with the relevant national and municipal technical standards and norms, and meet the safety requirements.

The technical standards and norms of outdoor advertising in this Municipality shall be formulated by the municipal competent department and the municipal transportation department respectively, and announced to the public. Eleventh in any of the following circumstances, it is forbidden to set up outdoor advertising:

(a) the use of traffic safety facilities, traffic signs, fire control facilities, fire safety signs;

(two) affect the use of municipal public facilities, traffic safety facilities, traffic signs, fire control facilities and fire safety signs;

(3) Noise pollution, light pollution, etc. Exceeding the national standards and affecting the normal life of residents;

(four) interfere with the adjacent ventilation, lighting, transportation and other rights;

(five) the use of street trees or damage to public green space;

(six) set up floor-standing advertisements in areas less than ten meters away from roads and adjacent buildings;

(seven) set up commercial advertisements in state organs, cultural relics protection units, outstanding historical buildings, scenic spots and their building control areas;

(eight) commercial advertisements in the form of banners, colorful flags and flags are set up along the main roads and secondary roads of the city;

(9) Setting up advertisements across roads;

(ten) the use of floating objects in navigable waters to set up advertisements;

(eleven) other circumstances prohibited by laws and regulations. Twelfth prohibit the use of construction site walls (files) to set up commercial advertisements.
