New regulations on fishing ban in Lake Rome

202 1 National Fishing Ban Order is to implement strict fishing ban management in key waters of the Yangtze River Basin. Productive fishing is completely prohibited in the aquatic biological protection zone of the Yangtze River basin, and the productive fishing of natural fishery resources is completely prohibited in key waters such as the main stream and important tributaries of the Yangtze River, large Tongjiang lakes and specific areas of the Yangtze River estuary within the time limit prescribed by the state.

In order to strengthen the protection, proliferation, development and rational utilization of fishery resources, develop artificial breeding, safeguard the legitimate rights and interests of fishery producers, promote the development of fishery production and meet the needs of socialist construction and people's life. There are no regulations prohibiting fishing, but there are regulations prohibiting illegal fishing. The fishery administrative department shall, according to the specific conditions of the urban river shoreline, delimit the fishing range and the fishing ban, set up facilities such as the schematic diagram of the fishing range, warning signs of the fishing ban and fishing safety bulletin boards, and strengthen the maintenance and management of these facilities to keep them intact and clear. No unit or individual may move or damage the facilities specified in the preceding paragraph without authorization.

Fishing personnel shall abide by the regulations, fish within the designated fishing range, take good care of public property, and shall not damage the trees, green spaces and public facilities on the river bank, and shall not throw garbage and other toxic and harmful substances into the waters and the river bank, and shall clean up the waste when leaving the fishing site.

Those who fish aquatic products in no-fishing areas or during no-fishing periods or use prohibited tools and methods, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or fines. The crime of illegal fishing of aquatic products refers to a serious act of fishing aquatic products in a no-fishing area, no-fishing period or using prohibited tools and methods in violation of laws and regulations on the protection of aquatic resources.

Legal basis:

Article 30 of the Fisheries Law of People's Republic of China (PRC) prohibits the use of fried fish, poisonous fish and electric fish to destroy fishery resources. It is forbidden to manufacture, sell or use prohibited fishing gear. Fishing in closed fishing areas and closed fishing periods is prohibited. Fishing nets smaller than the minimum mesh size are prohibited. The juvenile fish in the catch shall not exceed the prescribed proportion. It is forbidden to sell illegally caught catches in closed fishing areas or closed fishing periods. The types of key protected fishery resources and their fishing standards, closed fishing areas and periods, fishing gear and fishing methods prohibited or restricted, minimum mesh size and other measures to protect fishery resources shall be stipulated by the fishery administrative departments of the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
