Article 4: Flood prevention work shall be subject to the responsibility system of administrative heads of people's governments at all levels, with unified command and hierarchical and sub-departmental responsibilities. All relevant departments implement a post responsibility system for information prevention. Article 5: All units and individuals have the obligation to participate in flood prevention and fighting. The Chinese People's Liberation Army and the Armed Police Force are important forces in flood prevention and fighting. Chapter 2 Flood Control Organization Article 6 The provincial flood control command agency, under the leadership of the national flood control command agency and the provincial people's government, is responsible for organizing and leading the province's flood control and flood relief work. Its offices are located in the provincial water administrative department and the provincial Yellow River channel. Competent authority. Article 7 The people's governments of each city (prefecture) and county (city) shall establish a flood control command organization, which shall be composed of the heads of the relevant departments, local garrison and people's armed forces, and shall be commanded by the heads of the people's governments at all levels. Under the leadership of the higher-level people's government's flood control command agency and the people's government at the same level, the higher-level flood control instructions are implemented, various flood control and flood relief measures are formulated, and the flood control and flood relief work in the region is unifiedly directed. Its offices are located in the water administrative departments of the governments at the same level and the Yellow River channel authorities, and are responsible for handling daily flood control work within their jurisdiction. Article 8 River management agencies, water conservancy and hydropower project management units and construction units of projects under construction along rivers shall set up flood control agencies during the flood season to participate in flood prevention and relief work under the leadership of the flood control command agency of the people's government with jurisdiction. Article 9 The flood prevention office established by the urban construction department shall, under the leadership of the flood prevention command institution of the people's government at the same level, be responsible for handling daily flood prevention work in urban areas.

Departments and units with flood control tasks such as petroleum, electric power, post and telecommunications, railways, highways, shipping, industry and mining, commerce, and materials should form temporary flood control organizations during the flood season, and establish a temporary flood control organization under the jurisdiction of the people's government flood control command agency. Under unified leadership, be responsible for the flood prevention work of this industry and unit. Article 10: County and township people's governments shall organize mass standing flood control teams with militia as the backbone. They shall also organize flood control and rescue reserve teams for reservoirs and embankments, and establish mobile flood control and rescue teams for the Yellow River and other rivers with major flood control tasks. Relocation and rescue teams should be organized in flood detention areas. Chapter 3 Flood Control Preparations Article 11 The people's governments at or above the county level shall formulate flood control work plans (including measures to prevent general floods and excessive floods) based on the comprehensive river basin planning, the actual status of flood control projects and the flood control standards stipulated by the state or determined by the province. ).

The flood prevention plan for the main streams of the Yellow River and Huaihe River shall be submitted to the State Council for approval for implementation; the flood prevention plan for the Hongru River, Shaying River, Wei River, Communist Canal, Tangbai River, Yiluo River, and Huiji River It shall be reported to the Provincial People's Government for approval and implementation; flood control plans for other rivers shall be approved and implemented by the people's government with jurisdiction.

Each city people's government shall formulate its own city's flood prevention plan based on the comprehensive river basin plan, urban flood control plan and river flood prevention plan, and submit it to the superior people's government or its authorized agency for approval before implementation.

After the flood prevention plan is approved, people's governments at all levels must implement it. Article 12 Enterprises and institutions with the task of flood prevention and relief shall formulate their own flood prevention and relief measures based on the flood prevention plan of the area or river in which they are located, and after obtaining the consent of the local flood control headquarters, submit them to the superior competent department of the unit for approval. . Article 13 For large reservoirs (including medium-sized reservoirs managed as large), key sluices and major flood control rivers, the provincial water administrative department shall organize relevant municipal, local and project management units to design flood prevention plans based on the project planning and the actual status of the project. , on the premise of obeying flood control and ensuring safety, formulate flood season dispatching and operation plans and river flood control guarantee tasks, and submit them to the provincial flood control command agency for approval. The flood season dispatch and operation plans for Luhun Reservoir and Banqiao, Suyahu, Nanwan, and Ayushan Reservoirs were submitted to the Yellow River Water Conservancy Commission and the Huaihe River Water Conservancy Commission for approval respectively. Flood control measures along the Yellow River are formulated by the local Yellow River channel authorities in accordance with the provincial Yellow River flood control plan.

The flood season dispatching and operation plans and flood control guarantee tasks for other reservoirs, sluices, hydropower stations and rivers shall be organized and compiled by the municipal (prefecture) and county (city) water administrative departments respectively, and submitted to the flood control command agency at the same level for approval.

After the flood season dispatch and operation plan is approved, the reservoir, hydropower station, sluice and river management units are responsible for implementation. Article 14 Flood control command agencies at all levels shall organize inspections of various flood control facilities before floods, discover problems that affect flood control safety, and instruct responsible units to deal with them within a time limit, without delaying flood prevention and relief work.

Relevant departments and units should report problems and treatment measures that affect flood control safety to the flood control command agency with direct jurisdiction. Article 15 River obstruction removal, reconstruction or dismantling of bridges, approach roads, docks and other cross-river engineering facilities that have serious water obstruction or blockage shall be carried out in accordance with national and provincial laws and regulations on river management.
