Measures for the Implementation of Safety Production Licenses for Fireworks and Firecracker Manufacturing Enterprises

Chapter 1 General Provisions Article 1 is to strictly regulate the safety production conditions of fireworks and firecracker production enterprises and do a good job in the issuance and management of safety production licenses for fireworks and firecracker production enterprises. According to the "Safety Production License Regulations" and relevant laws and administrative regulations, and formulate these implementation measures. Article 2 Fireworks and firecrackers production enterprises must obtain a production safety license in accordance with the provisions of these Implementation Measures.

Those who have not obtained a production safety license are not allowed to engage in production activities. Article 3 The issuance and management of production safety licenses shall be based on the principles of enterprise application, first-level license issuance, and territorial supervision. Article 4 The production safety supervision and administration department of the State Council shall guide and supervise the issuance and management of safety production licenses for fireworks and firecracker production enterprises nationwide.

The production safety supervision and management departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter referred to as the production safety license issuance and management agencies) are responsible for the issuance and management of production safety licenses for fireworks and firecracker production enterprises within their respective administrative regions. Chapter 2 Safety Production Conditions Article 5 Fireworks and firecrackers production enterprises shall establish and improve the safety production responsibility system of main persons in charge, persons in charge, safety production management personnel, functional departments, and positions; and formulate the following safety management systems and operating procedures:

(1) Safety target management system, safety reward and punishment system, safety inspection system, safety technical measures approval system;

(2) Accident hazard rectification system, safety facilities and equipment management system, employees Safety education and training system, hot work management system, safety investment guarantee system, major hazard source detection, monitoring and safety assessment system, protective equipment (tool) management system, and raw material and auxiliary material purchase, inspection, use and storage system;

(3) Occupational health management system;

(4) Safety operating procedures that comply with the requirements of the "Technical Regulations for Labor Safety of Fireworks and Firecrackers" (GB11652). Article 6 The safety investment of fireworks and firecrackers production enterprises shall comply with safety production requirements. Article 7 Fireworks and firecrackers production enterprises shall set up a production safety management agency, be equipped with full-time production safety management personnel, and meet the following requirements:

(1) Determine the person in charge of production safety;

( 2) Equipped with at least one full-time safety production management personnel accounting for more than 1% of the total number of employees of the enterprise;

(3) Equipped with a considerable number of part-time safety production management personnel. Article 8 The safety production knowledge and management capabilities of the main persons in charge and safety production management personnel of fireworks and firecracker production enterprises shall be assessed and qualified.

Special operators involved in the mixing, granulating, screening, charging, building, pressing, and cutting of fireworks and firecrackers should receive training on the professional knowledge of fireworks and firecrackers and obtain an operating qualification certificate after passing the assessment. .

Personnel employed in other positions must undergo education and training on production safety knowledge and pass the assessment. Article 9 Fireworks and firecrackers manufacturing enterprises shall participate in work-related injury insurance in accordance with the law and pay work-related injury insurance premiums for their employees.

Article 10 The production facilities of fireworks and firecrackers production enterprises shall meet the following conditions:

(1) Have production plants and storage warehouses that are suitable for the production scale and product varieties and meet safety production requirements;

< p> (2) The internal and external safety distances, factory layout, building structure, production process layout, safe evacuation conditions, fire protection facilities, explosion protection, lightning protection, anti-static and other safety facilities of production plants, storage warehouses, and discharge test sites comply with the "Fireworks "Safety Code for Firecracker Factory Design" (GB50161) requirements;

(3) Dangerous goods production area and office area (living area), fire source area and no-fire area, production workshop and warehouse (transit warehouse) (or mail room), dangerous processes and ordinary processes should be separated;

(4) The functions and uses of factories and warehouses specified in the factory design plan shall not be changed;

(5) Level A Buildings should be equipped with safety protection barriers;

(6) A2-level buildings should be used by one person in a single room;

(7) A3-level buildings should be used by one person in a single room. And the number of workers working in each building at the same time shall not exceed 2;

(8) The per capita usable area of ??Class C buildings shall not be less than 3.5 square meters;

(10) There should be corresponding fire isolation measures around the production plants and warehouses;

(11) The production area should have obvious safety warning signs Or warning slogans, safety management systems and operating procedures should be firmly posted at hazardous process sites;

(12) Have equipment, instruments and process equipment to ensure safe production and product quality;

(13) Equipment used for processing drugs or in contact with drugs should comply with the requirements of the "Technical Regulations for Labor Safety of Fireworks and Firecrackers" (GB11652);

(14) Electrical equipment and electrical appliances in mechanical processing equipment Part of it should comply with the requirements of the "Safety Code for Design of Fireworks and Firecrackers Factories" (GB50161);

(15) Each workshop for machinery manufacturing containing perchlorate ignition wires shall not have more than 2 units, and the manufacturing of nitric acid There should be no more than 4 units in each workshop of the salt ignition line. The units should be separated by solid walls. Each workshop should have one person. Other processes (such as mechanical granulation, mixing, pressing, and other direct mechanical drug processing processes) ) There shall be no more than one unit in each workshop;

(16) Special equipment should be inspected regularly and comply with the conditions stipulated in relevant laws, regulations, national standards and industry standards;

(17) It is strictly prohibited to erect temporary electrical facilities in dangerous places.
