Regulations of Nanjing Municipality on the Administration of Waterway Navigation

Article 1 In order to strengthen navigation management, ensure the safe and smooth navigation channels and sound navigation facilities, and promote the development of the shipping industry, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "waterway management" as mentioned in these Regulations refers to the administrative management implemented by the municipal and county people's governments in accordance with the law to protect waterways, waterway land and waterway facilities, standardize waterway construction and maintenance operations, control crossing, crossing and crossing waterway facilities, and stop encroachment and damage to waterways. Article 3 These Regulations shall apply to the navigation management of navigation channels other than the Yangtze River channel within the administrative area of this Municipality. Article 4 The traffic administrative department of the people's government of the city or county (hereinafter referred to as the traffic department) is the administrative department of waterway within its administrative area. The waterway management institutions affiliated to the municipal and county transportation departments shall be specifically responsible for waterway management in accordance with the prescribed responsibilities.

The relevant departments of the people's governments of cities and counties (districts) shall, in accordance with their respective responsibilities, coordinate in waterway management. Article 5 Waterways and waterway facilities shall be protected by the state. Any unit or individual has the right to stop and report encroachment, damage to navigation channels, navigation facilities and other acts that affect the smooth flow of navigation channels. Article 6 The technical level of the city's waterways is divided into five, six and seven external waterways, and the navigation guarantee scale is based on the designed navigable water level, namely:

(a) the clear width, clear height and water depth of the five-level channel are not less than 40 meters, 5 meters and 2.5 meters respectively;

(2) The clear width, clear height and water depth of Class VI waterway are not less than 22 meters, 4.5 meters and 2.5 meters respectively;

(3) The clear width, clear height and water depth of the Class-7 waterway shall not be less than18m, 3.5m and 2.2m respectively;

(4) The clear width, clear height and water depth of the first-class waterway shall not be less than12m, 2.5m and1.5m respectively.

The transportation department shall announce the navigation guarantee scale of a specific channel according to the channel development plan and the channel technical grade standard; The adjustment of the technical level of urban waterway and the scale of navigation guarantee shall be put forward by the municipal transportation department in conjunction with the relevant departments of city planning, and approved by the Municipal People's government and submitted to the original approval authority for approval. Article 7 The following activities are prohibited in the navigation channel:

(1) Dumping or discarding mud, sand, garbage, abandoned ships and other wastes;

(two) damage to navigation AIDS, survey marks, navigation marks and other waterway facilities;

(3) Planting aquatic plants, breeding around rivers and setting up fixed nets;

(four) the construction of docks, docks and yards and other facilities in the approach channel of passing buildings;

(five) other acts of occupation and damage to waterway and waterway facilities. Article 8 Unless otherwise stipulated by laws and regulations, engaging in the following activities within the range of 10 meters on both sides of the waterway and 20 meters around the navigation mark shall be subject to examination and approval by the transportation department:

(1) Dredging, obstacle clearing and salvage operations;

(two) engaged in temporary loading and unloading, stacking materials business activities;

(3) Erecting or burying pipelines and cables crossing the waterway;

(four) new or rebuilt buildings or structures adjacent to, across or across the waterway;

(five) set up revetment, ferry, berthing station (area), water intake and drainage, water level observation well, water storage field, cofferdam, pile protection, wharf and other facilities;

(six) installation, removal, relocation to ensure the smooth flow of navigation AIDS and signs, installation of billboards and other signs;

(seven) other activities that may affect the integrity of waterway and waterway facilities.

The transportation department shall, without affecting the integrity of navigation channels and navigation facilities, approve compliance with navigation standards and navigation guarantee standards within 30 days. Involving other departments, it shall also be approved by the relevant departments.

The water conservancy department should take into account the shipping needs when carrying out river regulation, and solicit the opinions of the transportation department on the relevant design and scheme in advance; The traffic department shall comply with the requirements of flood control safety in waterway regulation, and solicit the opinions of the water conservancy department on the relevant design and scheme in advance. Article 9 Excavated structures shall be adopted in the construction of wharves and port areas on river sections where vertical revetment has been built. There should be a distance between adjacent docks to ensure smooth navigation and safe navigation. Tenth waterway, waterway facilities construction land, by the construction unit in accordance with the provisions of relevant laws and regulations of the state land management for requisition or allocation procedures. The people's governments of counties (districts) and townships (towns) along the waterway shall assist in the requisition, demolition and resettlement of land for waterway construction according to law. Eleventh units and individuals that have been approved to carry out construction operations in the waterway shall, before the construction operation, handle navigation warnings and waterway notices respectively in accordance with the Regulations on Navigation Safety Management of Underwater Construction in People's Republic of China (PRC).

During construction, operation signs should be set on the construction site and the construction ship, and the operators should wear safety signs.

After the completion of the construction work, the cofferdam, caisson, residual pile, waste pier and other construction relics shall be removed in time and accepted by the transportation department. Article 12 Where the construction or reconstruction of wharves, revetments, bridges, houses and other facilities adjacent to or crossing waterways and the laying of pipelines and cables involve the safety of navigation and engineering facilities, the construction unit must set up navigation AIDS in accordance with regulations. The construction unit shall be responsible for maintaining the navigation marks recognized by the transportation department to keep them in good technical condition. If it is difficult to set up and maintain navigation AIDS, the waterway management agency may be entrusted to set up and maintain them, and the expenses shall be borne by the construction unit.
