Measures of Chongqing Municipality on Radio Management

Chapter I General Provisions Article 1 In order to strengthen radio management, maintain radio wave order, effectively utilize radio spectrum resources and ensure the normal development of radio services, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Radio Management and the actual situation in Chongqing. Article 2 The establishment and use of radio stations, the development, production, sale and import of radio transmitting equipment and the use of non-radio equipment with radio wave radiation within the administrative area of this Municipality must abide by these Measures.

Radio management of military systems shall be implemented in accordance with relevant state regulations. Article 3 The term "radio station" as mentioned in these Measures refers to radio equipment that emits radio waves, including radio communication stations (stations), satellite earth stations, radio stations, television stations (including differential turntables), radars and navigation, telemetry and remote control equipment in various frequency bands.

The term "non-radio equipment that radiates radio waves" as mentioned in these Measures refers to equipment that can generate electromagnetic radiation in the fields of industry, transportation, science and medical treatment. Article 4 Radio spectrum resources belong to the state.

Radio management implements the policy of scientific management and promoting development, and follows the principles of unified planning, rational development, centralized management, graded responsibility and paid use. Article 5 Scientific research on the development, utilization and management of radio spectrum resources shall be encouraged, advanced technologies shall be popularized, and the utilization rate of radio spectrum resources shall be improved. Chapter II Management Organization and Responsibilities Article 6 The municipal radio management organization shall be responsible for the radio management of the whole city. Its main responsibilities are:

(a) the implementation of national radio management principles, policies, regulations and rules;

Formulate specific provisions on radio management in the whole city;

(three) planning the construction layout and frequency use of radio stations (stations) in the city;

(4) Examining and approving the address, setting and use of radio stations according to the examination and approval authority, assigning frequencies and call signs, and issuing the People's Republic of China (PRC) Radio Station License (hereinafter referred to as the Radio Station License);

(five) in accordance with the relevant provisions of the state, supervise and manage the production, development, sales and import of radio stations and radio transmitting equipment;

(6) Radio monitoring;

(seven) to coordinate the handling of radio management matters such as electromagnetic interference;

(8) Organizing the implementation of radio control;

(nine) other duties stipulated by the state radio regulatory agencies and the Municipal People's government.

According to the needs of the work, the municipal radio management institution may set up an agency in a specific area to be responsible for the radio management in the designated area. Seventh counties (autonomous counties, cities) established in accordance with the law of radio management institutions, in accordance with the provisions of these measures and the division of responsibilities, responsible for the radio management within their respective jurisdictions, and accept the leadership of the municipal radio management institutions. The specific division of responsibilities shall be formulated separately by the municipal radio management organization according to the relevant provisions of the state and implemented after being approved by the Municipal People's government. Chapter III Installation and Use of Radio Stations Article 8 The installation and use of radio stations must meet the following conditions:

(a) the radio equipment conforms to the national technical standards, and shall not interfere with the established radio stations or pose a threat to human health;

(2) The working environment of the radio station (station) is safe and reliable;

(three) the operator has the corresponding business skills and business qualifications;

(four) managers are familiar with radio management regulations, rules and technical specifications;

(5) Having corresponding management systems and measures;

(six) large stations (stations) and units with more equipment are equipped with specialized agencies or full-time and part-time managers;

(seven) to obtain a radio station license issued by the radio regulatory agency;

The establishment of personal amateur radio stations (stations) shall be handled in accordance with the relevant provisions of the state. Article 9 The establishment and use of radio stations shall be handled in accordance with the following procedures:

(a) by the establishment and use of radio stations (stations) units or individuals to submit a written application to the municipal radio management agencies, and signed by the local radio management agencies or agencies.

The frequency pre-assigned by the municipal radio management institution;

(three) the municipal radio management agency or its entrusted radio management agency shall test the electromagnetic environment of the proposed station (station) in accordance with state regulations;

(four) the applicant shall carry out the necessary technical design or feasibility demonstration in accordance with the pre-specified frequency;

(five) the municipal radio management institution shall review the technical design or feasibility study, and issue an approval document if it meets the requirements;

(six) the municipal radio management institution or its entrusted radio management institution shall, in accordance with the provisions of the state, test the purchased radio transmitting equipment, and install, debug and test it after passing the test;

(7) After 0 to 3 months of trial operation, the unit or individual who set up the station (station) shall submit a written acceptance application to the radio management institution, and the municipal radio management institution or its entrusted radio management institution shall conduct acceptance. Those who pass the acceptance shall approve the call sign of the radio station within 7 days and issue a radio license.

Radio stations (stations) that communicate or serve only in specific administrative areas of counties (autonomous counties and cities) (excluding short-wave radio stations and microwave radio stations) shall be examined and approved by local radio management agencies entrusted by municipal radio management agencies. Tenth fixed radio stations (stations) construction layout, should comply with the relevant provisions of the electromagnetic environment protection. Radio stations (stations) for trans-regional communication or service within the urban planning area and the administrative area of this Municipality shall be selected by the municipal radio management agency jointly with the relevant municipal departments, and the relevant planning and management procedures shall be handled in accordance with the urban planning and management procedures.

If the working environment and microwave routing of fixed radio stations need to be protected, the design unit shall report to the municipal planning administrative department for examination and approval, and the municipal planning administrative department shall make overall arrangements.

Construction projects shall not affect the working environment and microwave routing of protected radio stations. Due to the needs of urban construction, the construction project has an impact on the working environment and microwave routing of protected radio stations, and the construction unit shall take measures to eliminate the impact; If losses are caused to the protected radio station (station), the construction unit shall make compensation.
