Xi special equipment safety regulations

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Safety of Special Equipment and other laws and regulations, in combination with the actual situation of this Municipality, in order to strengthen the safety of special equipment, prevent accidents of special equipment, safeguard personal and property safety and promote economic and social development. Article 2 These Regulations shall apply to the production (including design, manufacture, installation, renovation and repair), operation, use, inspection and testing of special equipment and the safety supervision and management of special equipment within the administrative area of this Municipality.

The term "special equipment" as mentioned in these Regulations refers to boilers, pressure vessels (including gas cylinders), pressure pipes, elevators, lifting machinery, passenger ropeways, large amusement facilities and special motor vehicles in the field (factory) that are dangerous to personal and property safety. The specific scope is determined according to the catalogue of special equipment approved by the State Council. Article 3 The municipal, district and county people's governments and the administrative committee of the Development Zone shall take overall responsibility for the safety of special equipment in their own areas.

The municipal, district and county people's governments and the Development Zone Administrative Committee shall incorporate the safety work of special equipment into the annual safety production target assessment to ensure the funds needed for the safety supervision and management of special equipment. Article 4 The town people's government and subdistrict offices shall include the safety of special equipment in the scope of safety production inspection, urge the production, operation and use units of special equipment to implement the main responsibilities, and assist relevant departments to perform the duties of safety supervision and management of special equipment.

Residents' committees and villagers' committees shall actively cooperate with relevant departments to perform their duties of safety supervision and management of special equipment. When it is found that the production, operation and use units have illegal acts or hidden dangers of special equipment, it shall report to the town people's government, sub-district offices or relevant departments in a timely manner. The safety supervision and management departments of special equipment in counties and development zones shall, in accordance with the division of responsibilities, supervise and manage the safety of special equipment in their respective jurisdictions.

Development and reform, land, planning, construction, housing management, public security, safety supervision, industry and information, environmental protection, urban management, sports, prices, education, municipal administration, health, transportation, commerce, tourism, exhibition, rail transit and other departments shall, according to their respective functions and duties, do a good job in the safety supervision and management of special equipment. Article 6 Special equipment industry associations shall formulate industry norms, strengthen industry self-discipline, promote the construction of industry credit system, publicize special equipment safety laws, regulations and related knowledge, and assist special equipment safety work. Article 7 The municipal, district and county people's governments and the administrative committee of the Development Zone shall strengthen the publicity and education on the safety of special equipment, popularize the safety knowledge of special equipment, and enhance the public's safety awareness.

The news media shall publicize the laws, regulations and related knowledge of special equipment safety for public welfare, and supervise the illegal activities of special equipment safety by public opinion. Article 8 This Municipality implements safety liability insurance for special equipment. Ninth to encourage the use of advanced technology, advanced management methods, improve the safety management level of special equipment. Tenth special equipment safety supervision and management departments should establish a complaint reporting system, open the telephone number and email address of complaints and reports, and accept complaints and reports from units and individuals.

Any unit or individual shall have the right to complain and report to the safety supervision and management department of special equipment and other relevant departments when discovering the hidden dangers of accidents or illegal acts involving the safety of special equipment. The department that receives the complaint report shall promptly organize the investigation and handling according to law. Chapter II Production, Operation and Use Section 1 General Provisions Article 11 The production units of special equipment, the filling units of mobile pressure vessels and the filling units of gas cylinders shall obtain corresponding qualifications in accordance with the relevant provisions of the state.

The safety management personnel, testing personnel and operating personnel equipped by the production, operation and use units of special equipment shall obtain corresponding qualifications in accordance with the relevant provisions of the state. Twelfth special equipment production, operation and use of units is the main responsibility for the safety of special equipment. Units that produce, operate and use special equipment and their principal responsible persons shall be responsible for the safety of the special equipment they produce, operate and use. Thirteenth buildings, structures and ancillary facilities related to the safety of special equipment shall meet the needs of special equipment design, construction, use, emergency rescue and inspection, and shall not affect the safety of special equipment. Section 2 Production and Operation Article 14 Construction units that install, modify and maintain special equipment shall inform the municipal special equipment safety supervision and management department or its entrusted special equipment safety supervision and management departments in districts, counties and development zones in writing before construction. Fifteenth boilers, pressure vessels, pressure piping components and other special equipment manufacturing process and boilers, pressure vessels, pressure pipes, elevators, lifting machinery, passenger ropeways, large recreational facilities, major repair process, should accept the supervision and inspection of special equipment inspection agencies; Without supervision and inspection or unqualified supervision and inspection, it shall not leave the factory or be delivered for use. Sixteenth after the completion of the installation, renovation and maintenance of special equipment, the construction unit shall hand over the relevant technical data and documents to the users within thirty days after the acceptance.

After the special equipment has passed the supervision and inspection and is completed and accepted, the construction unit shall deliver the technical data and documents to the users. Before delivery, the construction unit shall take effective measures to prevent the special equipment from being used by others.
