Regulations of Jiamusi Municipality on the Prevention and Control of Cooking Fume Pollution
Township (town) people's governments and sub-district offices (community public service centers) shall, under the leadership of the county (city) District People's governments, organize the prevention and control of cooking fume pollution in the catering industry according to local conditions.
Neighborhood (village) committees shall assist the supervision and management departments in the prevention and control of cooking fume pollution in the catering industry. Article 4 The competent department of ecological environment shall be responsible for the unified supervision and management of the prevention and control of cooking fume pollution in catering industry and the comprehensive coordination of the prevention and control of cooking fume pollution in catering industry.
Market supervision, urban management, urban and rural planning, urban and rural construction, housing security and other relevant departments shall perform the supervision and management duties of the prevention and control of cooking fume pollution in the catering industry within their respective responsibilities. Fifth any unit or individual has the right to complain and report to the competent department of ecological environment for violations of these regulations. After receiving a complaint or report, the competent department of ecological environment shall handle it in time and inform the complainant or informant of the result. Sixth catering operators are responsible for the prevention and control of cooking fume pollution in the catering industry, and should prevent and reduce cooking fume pollution in accordance with the provisions of relevant laws and regulations, and accept the supervision and management of relevant departments. Article 7 The site selection of catering business projects shall conform to the technical specifications for environmental protection of catering industry.
It is forbidden to build, rebuild or expand catering business projects that produce oil smoke in residential buildings, commercial and residential complex buildings and commercial floors adjacent to residential floors in commercial and residential complex buildings without special flues.
Construction units that build, rebuild or expand catering projects outside the scope prohibited in the preceding paragraph shall record the environmental impact registration form of construction projects online and be responsible for the authenticity, accuracy and completeness of the contents of the record.
Before the implementation of these regulations, catering business projects that have been established within the scope of prohibition shall be rectified within a time limit. Specific measures shall be formulated by the Municipal People's Government. Eighth urban and rural planning, urban and rural construction departments should share the location information of commercial and residential buildings with special flues with the market supervision and management departments.
Market supervision and management departments shall urge catering operators to install fume purification facilities in accordance with technical specifications, and shall not issue business licenses within the prohibited scope. Article 9 If a real estate development enterprise presales (sells) a new commercial and residential complex, it shall clearly inform the buyer in the shop sales contract that it shall not be used to set up catering business projects that produce oil smoke pollution. Tenth catering operators shall install fume purification facilities in accordance with the following provisions:
(a) set up a gas collecting hood, an exhaust pipe and an exhaust fan, and install oil fume purification facilities that have passed the inspection by a nationally recognized unit and are matched with its business scale and cooking technology;
(two) the minimum removal efficiency of lampblack purification facilities, small and medium-sized catering business projects should reach more than 85%, large catering business projects should reach more than 90%;
(three) scientific and reasonable installation of exhaust fans, blowers and other noise-producing equipment, take sound insulation and noise reduction measures, regular maintenance. The noise generated during the operation of the equipment shall meet the national and local emission standards. Set up the equipment noise display screen in a prominent position in the business place, and announce the noise value at the factory boundary in real time.
Catering operators shall normally use the fume purification facilities, and clean and maintain the fume purification facilities by themselves or by entrusting professional institutions. Oil fume emission shall conform to national and local emission standards, and shall not be discharged without oil fume purification facilities.
Oil fume shall not be discharged through facilities such as urban rainwater or sewage pipes. Eleventh no unit or individual may barbecue food in the open air in the area prohibited by the local people's government, or provide a venue for barbecue food in the open air. Twelfth departments responsible for supervision and management shall disclose the illegal information of cooking fume pollution in the catering industry on the national enterprise credit information publicity system and credit China (Heilongjiang) platform. Article 13 In violation of the provisions of the second paragraph of Article 7 of these regulations, if a special flue is not set in a residential building or a commercial and residential complex building, or a new, rebuilt or expanded catering business project that produces oil fume is adjacent to the residential building, the competent department of ecological environment shall order it to make rectification within a time limit; Refuses to correct, be closed, and impose a fine of fifty thousand yuan and one hundred thousand yuan.
In violation of the provisions of the third paragraph of Article 7 of this Ordinance, if the catering project construction unit fails to file the environmental impact registration form of the construction project according to law, the competent department of ecological environment shall order it to file the record and impose a fine of not less than 1,000 yuan but not more than 50,000 yuan. Article 14 Whoever, in violation of the provisions of Item (1), Item (2) and Item (2) of Paragraph 1 of Article 10 of these Regulations, fails to install oil fume purification facilities, uses oil fume purification facilities abnormally or does not install oil fume purification facilities to purify oil fume emissions, and discharges oil fume in excess of the emission standard, shall be ordered by the competent department of ecological environment to make corrections and be fined not less than 5,000 yuan but not more than 50,000 yuan; Refuses to correct, shall be ordered to suspend business for rectification.
In violation of the provisions of Item (3) of the first paragraph of Article 10 of these regulations, if the noise generated by oil fume purification equipment in catering business projects exceeds the noise emission standards stipulated by the state and local governments, the competent department of ecological environment shall order it to make corrections and impose a fine of more than 5,000 yuan and less than 50,000 yuan.
Whoever, in violation of the provisions of the third paragraph of Article 10 of these regulations, discharges lampblack into urban public rainwater, sewage pipes and other facilities shall be ordered by the competent department of ecological environment to stop the illegal act, restore the original state within a time limit or take other remedial measures, and be given a warning; If remedial measures are not taken within the time limit or serious consequences are caused, the unit shall be fined between100000 yuan and 300000 yuan, and the individual shall be fined between 20000 yuan and100000 yuan; If losses are caused, it shall be liable for compensation according to law.
