Article 2 of the newly revised trade union law stipulates what is a trade union and what is a mass organization of the working class that employees voluntarily join.

Trade unions are mass organizations of the working class, and workers unite voluntarily. The All-China Federation of Trade Unions and its trade union organizations represent the interests of employees and safeguard their legitimate rights and interests according to law. In China's enterprises, institutions and institutions, manual workers and mental workers whose main source of livelihood is wages have the right to join and organize trade unions according to law, regardless of nationality, race, sex, occupation, religious belief and education level. No organization or individual may obstruct or restrict it. Trade unions must abide by and safeguard the Constitution, take the Constitution as the fundamental activity criterion, focus on economic construction, adhere to the socialist road, adhere to the people's democratic dictatorship, adhere to the leadership of the Communist Party of China (CPC), adhere to Marxism-Leninism, Mao Zedong Thought and Deng Xiaoping Theory, adhere to reform and opening up, and independently carry out their work in accordance with the articles of association of the trade union.

All-China Federation of Trade Unions is the leading organ of local Federation of Trade Unions and national industrial trade unions. The All-China Federation of Trade Unions is led by the Secretariat of the CPC Central Committee.

The main duties of the trade union are:

1, according to the party's basic theory, basic line, basic program and labor movement policy, and focusing on the overall situation of the work of the party and the state, implement the principles, tasks and resolutions determined by the National Congress of the Chinese Trade Union and the meeting of the Executive Committee.

2. Organize and guide trade unions at all levels to unswervingly implement the party's fundamental guiding principle of relying on the working class wholeheartedly, and further highlight and perform their maintenance functions in accordance with the law and the Articles of Association of China Trade Union.

3. Investigate and study major issues involving the legitimate rights and interests of employees, reflect the thoughts, wishes and demands of employees to the CPC Central Committee and the State Council, and put forward opinions and suggestions; Participate in the formulation of policies, measures, systems and draft laws and regulations concerning the vital interests of employees; Participate in the investigation and handling of major employee casualty accidents.

Article 1 This Law is formulated in accordance with the Constitution in order to safeguard the position of trade unions in the political, economic and social life of the country, clarify their rights and obligations, and give full play to their role in the cause of socialist modernization.

Article 5 Trade unions shall organize and educate workers to exercise their democratic rights in accordance with the provisions of the Constitution and laws, play the role of masters, and participate in the management of state affairs, economic and cultural undertakings and social affairs through various channels and forms; Assist the people's government in its work and safeguard the socialist regime of the people's democratic dictatorship led by the working class and based on the alliance of workers and peasants.
