Chapter 1 General Provisions Article 1 In order to strengthen the management of the ports of the Shenzhen Special Economic Zone (hereinafter referred to as the SEZ), promote the development of the port industry, and give full play to the role of the ports in social and economic development, this document is formulated in light of the actual conditions of the SEZ. regulations. Article 2 These regulations apply to the planning, construction, production, operation and other port-related activities of Shenzhen Port. Article 3 The meanings of the following terms in these Regulations are:

(1) Shenzhen Port: refers to all port areas and planned port areas in Shenzhen City for trading ships to enter and exit.

(2) Port area: refers to the waters and land areas delineated with approval in accordance with the overall layout plan of Shenzhen Port to ensure the needs of port production and operation.

(3) Planned port area: refers to the water and land areas planned for further development and construction of the port according to the overall layout plan of Shenzhen Port.

(4) Port facilities: refers to the buildings, structures and related equipment built for port production and operation in the port area and planned port area, including port infrastructure and other facilities.

Port infrastructure includes breakwaters, diversions, port channels, revetments, harbor basins, anchorages, locks, roads, wharfs, barges, trestles, pontoons, passenger stations, railways, water supply and drainage, highways** *Communications, power supply, fire protection, environmental protection and navigation aid facilities, etc.

(5) Port business: refers to the services provided to ships, cargo owners and passengers for ship docking, passenger and cargo transportation in the port area, including providing ships and cargo owners with the use of port facilities, towing, cargo loading and unloading , storage, barge, tally and other services, as well as providing waiting, boarding and disembarkation services for passengers.

Port operational business refers to the port business that is for profit and incurs expense settlement. Article 4 The Shenzhen Municipal People's Government (hereinafter referred to as the municipal government) shall incorporate the port industry into the national economic and social development plan and be responsible for organizing and implementing it.

The municipal government carries out macro-control of the port industry and implements a combination of government investment and social investment. Article 5 The municipal government establishes the Shenzhen Port Management Committee (hereinafter referred to as the Municipal Port Management Committee) to mainly perform the following responsibilities:

(1) Formulate policies and guidelines to promote port development;

(2) Review the overall layout plan of the port and its modification plan;

(3) Review the planning of each port area and its modification plan;

(4) Propose government investment in the port Plan;

(5) Determine the allocation and use plan of coastline, water and land areas in the port area;

(6) Review the construction plan of large-scale port construction projects;

(7) Coordinate the responsibilities of various relevant departments in port management. Article 6 The port administrative department of the municipal government (hereinafter referred to as the municipal port administrative department) shall manage the port industry in accordance with the law. Chapter 2 Port Planning Article 7 The overall layout plan of Shenzhen Port shall comply with the national and provincial port layout plans and the Shenzhen City overall urban plan. Article 8 The overall layout plan of Shenzhen Port shall be prepared based on the needs of the national economy and social development, taking into account the short-term and long-term passenger and freight throughput of Shenzhen Port, the types of ships entering the port, the types, flow, and direction of cargo in the hinterland, the port’s collection and distribution conditions, and the natural environment. factors such as environmental conditions and transportation safety conditions.

The main contents of the overall layout plan of Shenzhen Port should include: the size, nature, functions, port boundary, planned port area, port area division, water and land area utilization, coastline use, environmental protection, various Land allocation and phased construction plan for the construction of such facilities. Article 9 The overall layout plan of Shenzhen Port shall be organized and prepared by the municipal port authority. After comprehensive coordination by the municipal planning administrative department and review and approval by the municipal government, it shall be submitted for approval in accordance with relevant regulations. Article 10 The planning of each port area of ??Shenzhen Port shall be prepared based on the overall layout plan of Shenzhen Port. The main content shall include: the business scope and scale of the port area, the layout of functional areas on land and water, supporting auxiliary production facilities, environmental protection and phased construction plans. Article 11 The planning of each port area of ??Shenzhen Port shall be organized and prepared by the municipal port authority, and shall be submitted to the municipal government for approval after comprehensive coordination and review by the Municipal Port Management Committee. Article 12 The overall layout plan and port area planning of Shenzhen Port shall be supervised and implemented by the municipal port authorities.

Article 13 Modifications to the overall layout plan and port area planning of Shenzhen Port shall be reviewed and approved in accordance with the preparation and approval procedures stipulated in these Regulations. Chapter 3 Port Construction Article 14 The design, construction, and acceptance of Shenzhen Port port construction projects shall comply with the overall layout plan and port area planning of Shenzhen Port, and comply with the industry technical standards and requirements stipulated by the state. Article 15 The municipal government shall construct government terminals in a planned manner and optimize the terminal structure in accordance with the overall layout plan of Shenzhen Port. Article 16 The construction, reconstruction, expansion of port facilities and other projects in the port area and planned port area shall be reviewed and approved by the municipal port authority, and then the relevant procedures shall be applied to the relevant departments in accordance with the capital construction approval procedures.

Constructing facilities or conducting other construction activities in port areas and planned port waters must be reviewed by the water safety supervision department in advance. Article 17 The establishment of a port-facing industrial zone within a port area or planned port area shall be subject to review and approval by the municipal port authority and then be reported to the relevant authority for approval in accordance with regulations. Article 18 When the municipal government invests in the construction of port infrastructure projects, the municipal port department shall organize public bidding in accordance with the law, and the municipal construction administrative department shall supervise and manage the project.

Tendering and bidding for non-government-invested port facility construction projects shall be conducted in accordance with relevant laws and regulations, and shall be supervised and managed by the municipal construction administrative department in conjunction with the municipal port authority.
