Regulations of Wuxi Municipality on Prohibiting Fireworks and Firecrackers (amended on 20 19)

Article 1 These Regulations are formulated in accordance with People's Republic of China (PRC) Environmental Protection Law, People's Republic of China (PRC) Air Pollution Prevention Law, the State Council Fireworks Safety Management Regulations and other laws and regulations in order to protect the public, personal and property safety, prevent environmental pollution and maintain social order. Article 2 The term "fireworks and firecrackers" as mentioned in these Regulations refers to all kinds of fireworks, firecrackers and fireworks. Can produce smoke, light and sound. Article 3 The municipal and county-level municipal people's governments shall, according to the actual situation, determine the areas where fireworks and firecrackers are prohibited and announce them to the public.

Fireworks and firecrackers are prohibited in the following places:

(a) the location of the state organ;

(two) within the scope of protection of cultural relics protection units;

(3) Military facilities protection zones, stations, docks, airports and other transportation hubs, railway lines and rail transit safety protection zones, power transmission and transformation facilities safety protection zones and oil and gas pipeline facilities safety protection zones;

(four) shopping malls, bazaars and public cultural facilities, places for religious activities and other crowded places;

(5) Places for producing and storing inflammable and explosive dangerous goods and warehouses for storing important materials such as grain, oil and cotton;

(six) medical institutions, pension institutions, kindergartens, schools, scientific research units and other places;

(seven) key fire prevention areas such as forests, deer ponds and nature reserves;

(eight) other places that prohibit the discharge of fireworks and firecrackers as determined and announced by the municipal and county-level municipal people's governments.

During the senior high school entrance examination and college entrance examination, during the early warning period of heavy pollution weather, and during the guarantee period of major activities issued by the municipal and county-level municipal people's governments, it is forbidden to set off fireworks and firecrackers. Fourth city, county-level city, District People's government should strengthen the organization and leadership of the work of prohibiting the discharge of fireworks and firecrackers, establish a discussion and coordination mechanism, and coordinate major issues in the work of prohibiting the discharge of fireworks and firecrackers.

The public security department is responsible for the supervision and management of prohibiting the discharge of fireworks and firecrackers.

The emergency management department is responsible for the supervision and management of fireworks production and operation.

Education, civil affairs, finance, natural resources planning, ecological environment, housing and urban construction, urban management, transportation, commerce, culture and tourism, administrative examination and approval, market supervision, meteorology and other departments shall, according to their respective functions and duties, do a good job in the relevant work of prohibiting the discharge of fireworks and firecrackers.

The Town People's Government and the street offices shall incorporate the prohibition of fireworks and firecrackers into the comprehensive management of grassroots social security, and strengthen organization, coordination, guidance and supervision.

Residents' committees and villagers' committees shall cooperate with relevant departments to do a good job in prohibiting the discharge of fireworks and firecrackers. Fifth people's governments at all levels, units and news organizations should carry out publicity and education on the prohibition of fireworks and firecrackers.

Schools and parents have the obligation to educate teenagers not to set off fireworks. Article 6 No unit or individual may produce, store or operate fireworks and firecrackers in areas and places where fireworks and firecrackers are prohibited.

The transportation of fireworks and firecrackers shall comply with the provisions of the state on the safety management of fireworks and firecrackers. Seventh it is forbidden to bring fireworks into shopping malls, restaurants, hotels, entertainment and other public places and take public transport.

It is forbidden to carry fireworks and firecrackers in checked, stored and mailed luggage, parcels and mails. Eighth fireworks, shall meet the following requirements:

(a) not to fireworks retail outlets, pedestrians, vehicles, buildings, structures, construction sites, trees, rivers, public green spaces, manhole throwing fireworks;

(two) shall not be set off in buildings and structures or from buildings and structures, throwing fireworks;

(3) Fireworks and firecrackers shall not be set off on vehicles, boats and other means of transportation;

(four) shall not hinder the safe passage of pedestrians and vehicles;

(five) fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety. Article 9 Units and individuals engaged in wedding, funeral and festive services shall not provide relevant services for purchasing and setting off fireworks and firecrackers in areas where fireworks and firecrackers are prohibited. Article 10 Hotels and hotel operators in areas where fireworks and firecrackers are prohibited shall inform consumers who hold wedding, funeral and festive activities in advance of the relevant provisions prohibiting fireworks and firecrackers, and discourage them from setting off fireworks and firecrackers in the area of responsibility for city appearance and environmental sanitation; Those who refuse to listen to dissuasion shall report to the public security organ in time. Eleventh in violation of the provisions of this Ordinance, laws and regulations have been punished, from its provisions. Article 12 Where a unit or individual, in violation of the provisions of Article 9 of these regulations, engages in matters of weddings, funerals and celebrations, and provides services related to the purchase and discharge of fireworks and firecrackers in areas where fireworks and firecrackers are prohibited, the public security organ shall order it to make corrections and impose a fine of not less than 1,000 yuan but not more than 5,000 yuan. Article 13 In violation of the provisions of Article 10 of these regulations, hotels and restaurant operators in areas where fireworks and firecrackers are prohibited fail to fulfill their obligation of informing, discouraging or reporting, and set off fireworks and firecrackers in their areas of responsibility for city appearance and environmental sanitation, the public security organs shall impose a fine of more than 200 yuan and less than 500 yuan on the hotels and restaurant operators. Fourteenth acts in violation of these regulations, any unit or individual has the right to stop and report, to stop the effective or verified report, to give praise or reward; Those who stop the masses or informants from taking revenge shall be punished according to law.
