Provisions of public security organs on the administration of special trades

These Regulations are formulated in order to standardize the public security management of special industries, promote the healthy development of special industries and protect the legitimate rights and interests of citizens, legal persons and other organizations.

These Regulations shall apply to the administration of public security in the following special industries:

hotel industry

2. Pawnshop industry

3. Official seal engraving industry

④ Auction industry

⑤ Scrap metal purchasing industry

(6) Consignment business

(seven) used motor vehicles, used mobile phones, used computers and other second-hand goods trading industry.

(eight) scrap motor vehicle recycling and dismantling industry, motor vehicle maintenance industry, motor vehicle rental industry.

(9) Gold, silver and jewelry processing industry

10, unlocking industry

(eleven) other special industries as prescribed by laws and regulations.

1. Enterprises engaged in special industries shall meet the following security management requirements:

(1) Necessary property storage equipment and public security prevention facilities;

(two) identification equipment and public safety information collection and transmission equipment that need to be configured according to law;

(three) set up internal security agencies or equipped with full-time (part-time) security personnel, and have a sound internal security system.

Individual industrial and commercial households engaged in special industries shall meet the conditions stipulated in the first and second items of the preceding paragraph.

In the vicinity of railways, mining areas, oil fields, airports, ports, construction sites, military restricted zones and metal smelting and processing enterprises, it is not allowed to set up a point to buy scrap metal. The scope of the prohibition of opening stores shall be delineated and announced by the municipal and county people's governments.

Two, the legal representative or person in charge of the special industry is the person in charge of public security. The person in charge of contracted operation of special industries or the person in charge of designated operation is the person in charge of public security. The responsibility of the person in charge of public safety is:

(1) Formulate internal public security system and post responsibility system, check hidden dangers of public security and make rectification, and implement preventive measures for internal public security;

(two) according to the size of the unit, in accordance with the relevant provisions, equipped with full-time (part-time) security guards or security guards, and organized the security guards and security guards of the unit to receive public security professional training;

(three) to cooperate with the public security organs in investigating suspected criminal cases, public security cases and public security disasters;

(4) When public security disasters and accidents occur, immediately report to the relevant departments, and assist the relevant departments in rescue and treatment, organize rescue of the wounded, evacuate the masses, and maintain order at the scene.

Three, the public security organs to perform the duties of supervision and inspection of special industries, can take the following measures according to law:

(1) On-site inspection of the implementation of public security management conditions in business premises

(2) check the employee's identity documents;

(3) Check the traded goods or contract goods;

(4) Consult the employee list, video surveillance videos and other related materials.

(5) Other measures stipulated by laws and regulations.

Legal basis: Article 3 of the Regulations on Public Security Administration of Special Industries implements territorial management, protects the legitimate rights and interests of industry operators and consumers according to law, stops and bans illegal business operations, and prevents and cracks down on illegal and criminal activities.

Article 4 The public security organs of the people's governments at or above the county level shall be responsible for the administration of public security in special trades.

The competent departments of industry and commerce administration, commerce, tourism, transportation, human resources and social security, environmental protection, etc. of the people's governments at or above the county level shall, within the scope of their respective duties, do a good job in public security management of special industries.

Article 5 The public security organs shall standardize the public security management of special trades according to law, enforce the law in a civilized and fair manner, strengthen the sense of service, and consciously accept the supervision of society and citizens.

Sixth to encourage the establishment of various special trade associations, to guide and promote the orderly development of industry norms. Industry associations should strengthen industry self-discipline, cooperate with public security organs to implement industry public security management, and guide and urge relevant operators and their employees to fulfill their public security obligations according to law.
