Article 1

Article 3

The State Council licenses the issuance of welfare lotteries and sports lotteries. The issuance of other lotteries without special permission from the State Council is prohibited. Article 4

The issuance, sale and drawing of lottery tickets shall follow the principles of openness, fairness, impartiality and good faith.

Article 5

The financial department of the State Council is responsible for the supervision and management of lottery nationwide. The civil affairs department and sports administration department of the State Council are respectively responsible for the management of welfare lotteries and sports lotteries nationwide in accordance with their respective responsibilities.

The financial departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for the supervision and management of lottery within their respective administrative regions. The civil affairs departments and sports administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government are respectively responsible for the management of welfare lotteries and sports lotteries in their respective administrative regions in accordance with their respective responsibilities.

The public security organs of the people's governments at or above the county level and the industrial and commercial administrative organs at or above the county level shall, within the scope of their respective responsibilities, investigate and deal with illegal lottery tickets in accordance with the law and maintain the order of the lottery market. Article 7

When a lottery issuing agency applies to open or discontinue specific varieties of welfare lotteries or sports lotteries (hereinafter referred to as lottery varieties) or applies to change the approval matters of lottery varieties, it shall comply with these provisions. The financial department of the State Council shall, based on the needs of the healthy development of the lottery market, follow the principles of rationally planning the lottery market and lottery variety structure, and strictly controlling lottery risks, and review the applications of lottery issuers.

Article 8

When a lottery issuing agency applies to open a lottery variety, it must be reviewed and approved by the civil affairs department of the State Council or the sports administrative department of the State Council, and submit the following application materials to the finance department of the State Council:

(1) Application form;

(2) Rules for lottery varieties;

(3) Issuance method and scope of issuance;

(4) ) Market analysis report and technical feasibility analysis report;

(5) Lottery drawing and prize redemption operating procedures;

(6) Risk control plan.

The financial department of the State Council shall, within 90 working days from the date of acceptance of the application, listen to public opinions on the lottery varieties through expert review, hearings, etc., review the application and make a written decision.

Article 9

If a lottery issuing agency applies to change the rules of lottery varieties, issuance methods, issuance scope and other approval matters, it shall be reviewed and approved by the civil affairs department of the State Council or the sports administration department of the State Council. Apply to the finance department of the State Council and submit materials related to the change. The financial department of the State Council shall review the application and make a written decision within 45 working days from the date of acceptance of the application.

Article 10

If a lottery issuing agency applies to discontinue a lottery variety, it shall obtain the review and approval of the civil affairs department of the State Council or the sports administrative department of the State Council, and submit a written application to the financial department of the State Council and submit it to the suspension Materials related to lottery varieties. Article 11

Article 12

Due to the need to safeguard the interests of the public, in emergencies, the financial department of the State Council may take necessary measures to decide to change lottery variety approval matters or suspend Lottery variety.

Article 13

Lottery issuing agencies and lottery sales agencies shall purchase lottery equipment and technical services that meet standards in accordance with the provisions of government procurement laws and administrative regulations.

Standards for lottery equipment and technical services shall be formulated by the finance department of the State Council in conjunction with the civil affairs department and sports administration department of the State Council in accordance with the relevant national standardization laws and administrative regulations.

Article 14

Lottery issuing agencies and lottery sales agencies shall establish a risk management system and a suspicious fund reporting system to ensure the safety of lottery issuance and sales.

Lottery issuing agencies and lottery sales agencies are responsible for the data management of the lottery sales system, the management of prize draw and redemption, and the collection and management of lottery funds, and may not entrust others to manage them.

Article 15

Lottery issuing agencies and lottery sales agencies may entrust units or individuals to sell lottery tickets as agents. Lottery issuing agencies and lottery sales agencies shall sign a lottery sales contract with the entrusted lottery sales agency. The model texts of agency sales contracts for welfare lotteries and sports lotteries are formulated by the civil affairs department and the sports administration department of the State Council respectively.

Lottery agent sellers are not allowed to entrust others to sell lottery tickets on their behalf.

Article 16

Lottery sales agencies shall equip lottery agents with special equipment for lottery betting. Special equipment for lottery betting belongs to the lottery sales agency, and lottery agents are not allowed to lend, rent or sell it.

Article 17

Lottery sales agencies shall, under the guidance of the lottery issuing agency, make overall plans for the layout of lottery sales venues. Lottery sales venues should set up lottery sales signs and post warning slogans in accordance with the unified requirements of the lottery issuing agency.

Article 18

Lottery issuers, lottery sales agencies, and lottery agents shall not engage in the following behaviors:

(1) Conduct false or misleading information Propaganda;

(2) Unfair competition by slandering fellow industry players;

(3) Selling lottery tickets to minors;

(4) Sell ??lottery tickets on credit or on credit.

Article 19

If lottery tickets need to be destroyed, the lottery issuing agency shall report it to the financial department of the State Council for approval, and then destroy it under the supervision of the civil affairs department of the State Council or the sports administrative department of the State Council.

Article 20

Lottery issuing agencies and lottery sales agencies shall fully announce the issuance and sales of lottery tickets to the public in a timely manner and accept supervision by the public. Article 21

Article 22

Lottery issuing agencies and lottery sales agencies shall ensure the completeness, accuracy and security of lottery sales data. After the current lottery sales data is sealed and before the end of the lottery event, the sales data may not be viewed, changed or deleted.

Article 23

Lottery issuing agencies and lottery sales agencies shall strengthen the management of lottery equipment, ensure the normal operation of lottery equipment, and configure backup equipment.

Article 24

Lottery issuing agencies and lottery sales agencies shall promptly announce to the public the current lottery sales situation and lottery results after the end of each lottery sale.

Article 25

Lottery winners shall take the winning lottery ticket to the designated location to redeem the prize within 60 natural days from the date of the draw. The rules of the lottery type require that identification be shown. If you have a certificate, you should also show your identity document. Prizes not redeemed within the time limit will be deemed as forfeited prizes.

It is prohibited to use counterfeit or altered lottery tickets to redeem prizes.

Article 26

Lottery issuing agencies, lottery sales agencies, and lottery agents shall redeem prizes in accordance with the rules of lottery types and prize redemption operating procedures.

Lottery winnings shall be paid in one lump sum in the form of RMB cash or cash check.

Prizes may not be redeemed to minors.

Article 27

Lottery issuing agencies, lottery sales agencies, lottery agents, and other persons who know the personal information of lottery winners due to their duties or business conveniences shall disclose the lottery winners’ personal information. personal information will be kept confidential. Article 28

Lottery funds include lottery prizes, lottery issuance fees and lottery public welfare funds. The proportion of lottery funds is determined by the State Council.

The specific proportion of lottery funds in lottery types shall be determined by the financial department of the State Council in accordance with the decision of the State Council.

With the expansion of lottery issuance scale and the increase of lottery varieties, the proportion of lottery issuance fees can be reduced.

Article 29

Lottery issuing agencies and lottery sales agencies shall open lottery fund accounts in accordance with the regulations of the financial department of the State Council for the purpose of accounting for lottery funds.

Article 30

The financial department of the State Council and the financial department of the people's government of provinces, autonomous regions, and municipalities directly under the Central Government shall establish an information system for lottery issuance, sales, and fund management to promptly monitor lottery sales and fund flows. Article 31

Lottery prize money is used to pay lottery winners. The maximum limit for single lottery prizes shall be determined by the financial department of the State Council based on the development of the lottery market.

Overdue winnings will be included in the lottery public welfare fund.

Article 32

Lottery issuance fees shall be used exclusively for the business expenses of lottery issuing agencies, lottery sales agencies and the sales expenses of lottery agents.

The business expenses of lottery issuing agencies and lottery sales agencies shall be managed on two lines of revenue and expenditure, and their expenditures shall comply with the financial management systems of lottery issuing agencies and lottery sales agencies.

Article 33

Lottery public welfare funds are used exclusively for social welfare, sports and other social welfare undertakings, and are not used to balance the general fiscal budget.

The lottery public welfare fund is included in the budget in accordance with the government fund management methods, and is managed on two lines of revenue and expenditure.

Article 34

Lottery issuing agencies and lottery selling agencies shall, in accordance with the provisions of the financial department of the State Council, promptly turn over the lottery public welfare funds and business fees from lottery issuance fees, and shall not withhold or Appropriate for other purposes. The financial department shall promptly allocate the business expenses of lottery issuing agencies and lottery sales agencies.

Article 35

The distribution policy of lottery public welfare funds shall be proposed by the financial department of the State Council in conjunction with the civil affairs, sports administration and other relevant departments of the State Council, and shall be implemented after approval by the State Council.

Article 36

Lottery issuance fees,

Managers and users of lottery public welfare funds shall accept the payment of funds from the financial department, auditing agencies and the public in accordance with the law. supervision.

Article 37

Article 38

Whoever violates the provisions of these Regulations by issuing or selling lottery tickets without authorization, or issuing or selling overseas lottery tickets within the territory of the People's Republic of China, which constitutes a crime, shall be investigated for criminal liability in accordance with the law; it does not constitute a crime. Article 39

If a lottery issuing agency or lottery sales agency commits any of the following acts, the financial department shall order it to suspend operations for rectification; if there are any illegal gains, the illegal gains shall be confiscated and A fine of three times the illegal income shall be imposed; the directly responsible person in charge and other directly responsible persons shall be punished in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law:

(1) Opening or stopping lottery without approval variety or changes in lottery variety approval matters without approval;

(2) Failure to issue or sell lottery tickets or draw and redeem prizes in accordance with the rules, issuance methods, issuance scope, and prize drawing and redemption operating procedures of the approved lottery variety;

(3) Entrusting others to manage the data management of the lottery sales system, prize draw and redemption management, or the collection and management of lottery funds;

(4) Viewing, changing, or deleting in violation of regulations Lottery sales data;

(5) Selling lottery tickets on credit or credit;

(6) Destroying lottery tickets without approval;

Article 40

If a lottery issuing agency or lottery sales agency commits any of the following acts, the financial department shall order it to make corrections; if there are any illegal gains, the illegal gains shall be confiscated; those directly responsible shall The supervisors and other directly responsible personnel shall be punished in accordance with the law:

(1) Purchasing lottery equipment or technical services that do not meet standards;

(5) Leaking the personal information of lottery winners;

(6) Failure to include overdue prizes into the lottery public welfare fund;

Article 41

If a lottery agent commits any of the following acts, the civil affairs department or the sports administrative department shall order him to make corrections and impose a fine of not less than 2,000 yuan but not more than 10,000 yuan; Illegal gains shall be confiscated:

(1) Entrusting others to sell lottery tickets or lending, renting or selling special equipment for lottery betting;

If a lottery agent is punished for the behavior specified in the preceding paragraph, the lottery issuing agency and lottery sales agency have the right to terminate the lottery agency contract.

Article 42

Whoever forges or alters lottery tickets or uses forged or altered lottery tickets to redeem prizes shall be subject to public security administrative penalties in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

Article 43

If a unit that manages or uses lottery public welfare funds violates the regulations on the management and use of lottery public welfare funds, the financial department shall order it to make corrections within a time limit; if there are any illegal gains, the illegal gains shall be confiscated; If corrections are not made within the prescribed period, the assets formed by using the lottery public welfare funds will be confiscated and the person's qualification for using the lottery public welfare funds will be cancelled.

Article 44

Staff of the financial department, civil affairs department, and sports administration department who perform lottery management responsibilities in accordance with the provisions of these regulations abuse their power in lottery supervision and management activities , dereliction of duty or engaging in malpractice for personal gain, which constitutes a crime, shall be investigated for criminal responsibility in accordance with the law; if it does not constitute a crime, shall be punished in accordance with the law.
