Haidong City Urban Landscaping Management Measures

Chapter 1 General Provisions Article 1 In order to strengthen urban landscaping management, beautify the urban living environment, and promote the construction of ecologically livable cities, in accordance with the "Urban and Rural Planning Law of the People's Republic of China" and "Urban Greening Regulations" "Haidong City Urban Management Regulations" and other laws and regulations, and combined with the actual situation of this city, these measures are formulated. Article 2 These Measures apply to landscaping planning, construction, protection and management activities within the urban planning area of ??this city. Article 3 The term "urban landscaping" as mentioned in these Measures refers to the activities of cultivating seedlings, planting flowers, planting grass, planting trees, planning, constructing, protecting and managing green areas, green spaces, scenic spots and other activities within the urban planning areas of this city. Article 4 Urban landscaping should adhere to the principles of scientific planning, ecological priority, adaptability to local conditions, and equal emphasis on construction and management. It should adhere to the coordination of greening and beautification, and the unity of ecology and landscape with local characteristics and national styles. Article 5 The landscaping department of the Municipal People’s Government shall supervise and manage the city’s landscaping.

The landscaping departments of the county and district people’s governments are responsible for the construction, protection and management of landscaping within their respective administrative regions. Other relevant departments of the municipal, county and district people's governments shall be responsible for the work related to urban landscaping in accordance with their respective responsibilities. Article 6 The municipal, county and district people's governments shall incorporate urban landscaping construction into the national economic and social development plan, include landscaping planning, construction, protection and management funds in the fiscal budget at the same level to ensure funding for urban landscaping work.

The municipal, county and district people's governments should organize relevant departments to increase investment in scientific research on urban landscaping and improve the scientific and technological content and technological level of urban landscaping.

Encourage units, organizations and individuals to participate in the construction of urban garden green spaces, set up nurseries, flower gardens, and lawns, carry out green space recognition, adoption, and management activities, plant commemorative trees, and build commemorative forests. Article 7 Units, organizations and individuals with labor capacity shall perform urban landscaping obligations in accordance with relevant national regulations.

Units, organizations and individuals should take good care of garden green spaces and greening facilities, and have the right to discourage and report behaviors that damage garden green spaces and greening facilities. Article 8 The municipal, county and district people's governments shall commend units, organizations and individuals that have made outstanding achievements in urban landscaping work. Chapter 2 Planning and Construction Article 9 The municipal and county people's governments shall organize the planning and landscaping and other competent departments to prepare urban landscaping plans and incorporate them into the overall urban plan.

The municipal and county landscaping administrative departments shall, in conjunction with the planning administrative department, delineate the control lines for various types of urban green spaces based on the city's overall plan, regulatory detailed plan, urban green space system plan, and the current status of green space ( (hereinafter referred to as the urban green line) shall be submitted to the people's government at the same level for approval before implementation.

The urban green line approved by the county people's government shall be reported to the municipal planning and landscaping administrative department for record.

Urban green lines approved by municipal and county people’s governments should be announced to the public and subject to public supervision. Article 10: Urban landscaping planning shall be implemented in accordance with national and local standards. Article 11 The urban green line management system shall be implemented for new construction, reconstruction and expansion projects within urban planning areas.

The Urban Green Line shall not be adjusted without legal procedures. If adjustments are really needed due to construction or other special circumstances, they shall be submitted to the people's government at the same level for approval after review by the municipal and county landscaping administrative departments and planning departments. Article 12 The planning and design plan of ancillary greening projects for new construction, reconstruction, and expansion projects must be reviewed and approved by the county or district landscaping administrative department.

The county and district landscaping administrative departments shall complete the review within ten working days from the date of receipt of the application. Only those who pass the review can go through follow-up procedures.

Article 13 Urban landscaping construction projects that are newly built, renovated or expanded shall meet the following index requirements:

(1) The park greening land area shall not be less than 65% of the park’s land area;< /p>

(2) The green space rate in newly built residential areas should not be less than 35%, and the reconstruction of old residential areas should not be less than 30%. Construction of 1.5 square meters;

(3) The green space rate of garden landscape roads shall not be less than 40%; for roads with a red line width greater than 50 meters, the green space rate shall not be less than 30% ; For roads with a red line width greater than 40 meters and less than 50 meters, the green space rate shall not be less than 25%; for roads with a red line width less than 40 meters, the green space rate shall not be less than 20%;

(4) The width of protective green belts beside major rivers and other water bodies in the city and railways should be no less than 30 meters;

(5) Commercial, financial, transportation hubs, municipal public facilities and other units , the green space rate is not less than 20%;

(6) The green space rate of industrial zones that produce harmful gases and pollutants is not less than 30%, and the green space rate is not less than 30%, and no less than 30% is established in accordance with national standards. Fifty meters of protective green belt; the green space rate of new water supply plants, sewage treatment plants and garbage treatment plants shall not be less than 45%;

(7) Government agencies, cultural entertainment, sports, For medical and health, education, scientific research and design, military and other units, the green space rate shall not be less than 35%;

(8) The green space rate of other construction projects shall not be less than 35%.

If it belongs to the old city reconstruction area, the index stipulated in the first paragraph can be reduced by 5%.

The construction of production green land shall meet the needs of urban landscaping construction, and its green land area shall not be less than 2% of the total urban built-up area.
