Provisions of Guangzhou Municipality on Assembly, Parade and Demonstration
When exercising the rights of assembly, procession and demonstration, citizens must abide by the Constitution and laws and regulations, and must not oppose the basic principles set by the Constitution, nor harm the national, social and collective interests or the legitimate freedoms and rights of other citizens. Article 4 The competent authorities of assemblies, processions and demonstrations in this Municipality are the district and county public security bureaus where the assemblies, processions and demonstrations are located; Where the route of procession and demonstration passes through more than two districts and counties, the competent authority shall be the Municipal Public Security Bureau. Article 5 Whoever holds an assembly, a procession or a demonstration in this Municipality must apply to the competent authority and obtain permission according to law. However, according to the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations, no application is required. Article 6 Citizens who are not registered in this Municipality shall not launch, organize or participate in citizens' assemblies, processions and demonstrations in this Municipality. Article 7 A person deprived of political rights according to law shall not launch, organize or participate in an assembly, a procession or a demonstration. Article 8 An assembly, a procession or a demonstration must be held with a responsible person. If there are more than two persons in charge, one person shall be determined as the main person in charge.
The main person in charge must hold a resident identity card or other valid documents to prove his identity, and apply to the competent authority five days before the assembly, procession and demonstration are held.
The application shall specify the purpose, mode, slogan, slogan, number of people, number of vehicles and boats, type and quantity of audio equipment used, starting and ending time and place (including assembly place and dissolution place), travel route, name, occupation and address of the person in charge, location of delivery of decision notice and other matters that need to be explained. Article 9 Applications for holding assemblies, processions and demonstrations in Sun Yat-sen Memorial Hall, Guangzhou Uprising Martyrs Cemetery, Heroes Square, Huanghuagang Martyrs Cemetery, tianhe sports center, China Export Commodities Fair and Haizhu Square must be examined by the competent authorities and reported to the Municipal People's Government for approval.
* Note: The administrative licensing item of "the Municipal People's Government approves the holding of assemblies, processions and demonstrations in specific places such as Sun Yat-sen Memorial Hall" in this article has been cancelled by the Decision of the Standing Committee of Guangzhou Municipal People's Congress on Cancelling Some Administrative Licensing Items in Local Regulations of Guangzhou (release date: August 6, 2004, implementation date: August 6, 2004). Article 10 After receiving an application for holding an assembly, a procession or a demonstration, the competent authority shall, 48 hours before the application date, notify its responsible person in writing of the decision of approval or disapproval. If the license is not granted, the reasons shall be explained. Failure to notify within the time limit shall be deemed as permission.
The person in charge of applying for an assembly, a procession or a demonstration shall sign the receipt of approval or disapproval. If the person in charge of an assembly, a procession or a demonstration is not at the place of delivery and has not entrusted others to collect it in writing, the notice of decision cannot be delivered, or if the person in charge refuses to sign the receipt of the notice of decision, the person in charge shall invite witnesses to be present, and the signature of the person in charge and the witness shall be deemed as delivery. Article 11 Where an assembly, a procession or a demonstration is temporarily needed due to an emergency, the person in charge of the assembly shall immediately report to the competent authority in writing and hold it only after obtaining permission. After receiving the report, the competent department shall immediately review and decide whether to approve it. Article 12 Where an application for holding an assembly, a procession or a demonstration needs to solve specific problems, the competent authority may notify the relevant authorities or units to negotiate with the person in charge of the assembly, a procession or a demonstration to solve them, and may postpone the application for holding for five days.
The relevant organ or unit shall, within 48 hours after receiving the notice from the competent authority, arrange to negotiate with the person in charge of the assembly, procession and demonstration to solve the problem, and shall not shirk or delay, and inform the competent authority of the negotiation results in time. Article 13 If the person in charge of an assembly, a procession or a demonstration refuses to accept the decision of the competent authority not to permit it, he may apply to the people's government at the same level for reconsideration within three days from the date of receiving the notice of decision, and the people's government shall make a decision within three days from the date of receiving the application for reconsideration and notify the person in charge and the competent authority in writing. Article 14 For assemblies, processions and demonstrations held according to law, the competent authorities shall send people's police to maintain traffic and social order and ensure the smooth progress of assemblies, processions and demonstrations.
No one may disturb, shock or disrupt an assembly, a procession or a demonstration held according to law by violence, coercion or other illegal means. Violators, the competent department shall take effective measures to stop or deal with according to law. Article 15 Assemblies, processions and demonstrations shall be conducted in accordance with the permitted matters. The person in charge must be responsible for maintaining order, and should designate more than one tenth of the people who participate in the assembly, procession and demonstration to assist the people's police in maintaining order and prevent others from joining.
The person in charge and the person in charge of maintaining order should wear signs. The pattern of signs shall be submitted to the competent authority for the record one day before the assembly, procession and demonstration are held.
