Measures of Hebei Province on Implementing the Law of People's Republic of China (PRC) on Assembly, Demonstration and Parade

Article 1 In order to implement the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations, guarantee citizens to exercise their rights of assembly, procession and demonstration according to law, and maintain social stability and public order, these Measures are formulated according to the actual situation of this province. Article 2 Assemblies, processions and demonstrations held within the administrative region of this province must abide by the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations and these Measures. Article 3 People's governments at all levels shall ensure that citizens exercise their rights of assembly, procession and demonstration according to law.

Citizens holding assemblies, processions and demonstrations must abide by the Constitution and state laws, and must not oppose the basic principles set by the Constitution, nor harm the interests of the state, society and the collective or the legitimate freedoms and rights of other citizens. Article 4 The competent authorities of assemblies, processions and demonstrations are the municipal and county public security bureaus and city public security sub-bureaus where assemblies, processions and demonstrations are held; Where the route of procession and demonstration passes through two or more districts and counties, the competent authority shall be the public security organ at the same level passing through the district or county. Article 5 (1) An assembly, a procession or a demonstration must be held with a responsible person.

The person who organizes and leads the assembly, procession and demonstration is the person in charge of the assembly, procession and demonstration. If there are more than two persons in charge, one person shall be determined as the main person in charge. Article 6 In any of the following circumstances, a person may not be the person in charge of an assembly, a procession or a demonstration:

(1) Being sentenced to public surveillance or probation, parole or execution outside prison;

(2) Being released on bail pending trial or under residential surveillance;

(3) Incapacity or limited capacity. Article 7 The person in charge of an assembly, a procession or a demonstration must hold a resident identity card or a certificate that can prove his identity, apply to the competent authority five days before the assembly, a procession or a demonstration is held, fill in the registration form of the assembly, a procession or a demonstration, and answer relevant inquiries. If an application is made by letter, telegram, telephone or other means, the competent authority will not accept it.

The time for applying for an assembly, a procession or a demonstration shall be counted from the time when the competent authority receives the registration form for an assembly, a procession or a demonstration. Article 8 An application shall contain the following items:

(1) The name, gender, age, nationality, native place, occupation, resident ID number, work unit, permanent address and telephone number of the person in charge;

(2) The date, starting and ending time, place (including meeting place and dissolution place) and route of the meeting;

(three) the purpose, method, slogan, slogan, number of people and placard specifications;

(four) the number of vehicles used, the model and license plate number of motor vehicles, and the type and quantity of audio-visual equipment;

(5) Security measures for assemblies, processions and demonstrations;

(six) other matters that the person in charge thinks need to be explained.

To apply for organizing or participating in an assembly, procession or demonstration in the name of an organ or unit, the application must be signed by the principal responsible person of the organ or unit and stamped with the official seal. Article 9 The competent authority shall, two days before applying for holding an assembly, a procession or a demonstration, notify its responsible person in writing of the decision on permission or disapproval or notify its responsible person to collect it at a designated place. If the license is not granted, the reasons shall be explained. Failing to notify within the time limit shall be deemed as permission. If the competent authority is unable to notify the person in charge of the application for an assembly, a procession or a demonstration, the application shall be deemed to have been withdrawn. Article 10 If the person in charge of an assembly, a procession or a demonstration refuses to accept the decision of the competent authority not to grant permission, he may apply to the people's government at the same level for reconsideration within three days from the date of receiving the notice of the decision, and the people's government shall make a decision within three days from the date of receiving the application for reconsideration and notify the person in charge and the competent authority. Article 11 Where an application for holding an assembly, a procession or a demonstration needs to solve specific problems, the competent authority may notify the relevant authorities or units to negotiate with the person in charge of the application for holding an assembly, a procession or a demonstration to solve the problems, and may postpone the application for holding for five days.

The relevant organ or unit shall report the consultation to the competent authority within three days after receiving the notice from the competent authority. Those who refuse to negotiate or fail to report the consultation within the time limit, resulting in serious consequences, shall be investigated for the responsibility of the person in charge of the relevant organ or unit according to law. Twelfth in any of the following circumstances, the competent authority may change the time, place and route of an assembly, a procession and a demonstration, and notify the person in charge in time:

At rush hour;

(2) Having foreign affairs activities, large-scale sports competitions or other major activities;

(3) Carrying out road construction or municipal construction;

(4) The occurrence of infectious diseases;

(five) other activities that affect the smooth progress of assembly, procession and demonstration or seriously affect traffic order and social order. Thirteenth in case of the following emergencies, the person in charge of the people's police has the right to change the route of the parade:

Major traffic accidents or traffic jams occur;

(2) In case of fire or other natural disasters;

(three) a major public security or criminal case;

(4) Other unforeseen circumstances. Fourteenth in the process of holding an assembly, a procession and a demonstration according to law, organizers and participants must abide by the following matters:

Obey the command of the people's police and safeguard public safety, public order and public health;

(2) Not to publish, shout or distribute remarks, slogans or propaganda materials that are inconsistent with the purpose of an assembly, a procession or a demonstration;

Do not insult, slander or gossip;

(four) shall not hold flags and banners inconsistent with the purpose of assembly, procession and demonstration;

(5) Do not carry weapons, controlled knives, inflammable and explosive articles that endanger personal and property safety;

(six) no graffiti, posters and slogans along the way;

(seven) shall not occupy or damage the green space, gardens and public facilities.
