Be detained or fined for setting off firecrackers

According to the relevant laws and regulations of our country, if firecrackers are set off in an area where firecrackers are prohibited, or firecrackers are illegally stored, the parties concerned may be administratively detained by the public security organs. According to the local regulations on setting off fireworks and firecrackers, if the time and place exceed the prescribed time and place, and the police still refuse to correct it after verbal warning, it may violate the administrative punishment of public security and take detention measures. Administrative reconsideration is an activity and system in which a person who has a legal interest in an administrative act thinks that an administrative act made by an administrative organ infringes on his legitimate rights and interests and applies for reconsideration to an administrative organ with legal authority according to law, and the reconsideration organ examines the legality and rationality of the applied administrative act and makes a decision according to law. Administrative reconsideration is a passive administrative behavior implemented by administrative organs, which has the characteristics and attributes of administrative supervision, administrative relief and administrative judicial behavior. It is of great significance and function to supervise and safeguard the administrative subject's exercise of administrative functions and powers according to law and protect the legitimate rights and interests of the counterpart.

Legal basis: Article 24 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment commits one of the following acts, which disturbs the order of large-scale mass activities such as culture and sports, and is given a warning or a fine of less than 200 yuan; If the circumstances are serious, they shall be detained for more than five days and less than ten days, and may be fined up to five hundred yuan:

(1) forcibly entering the meeting place;

(two) in violation of regulations, fireworks or other items in the venue;

(three) display insulting slogans, banners and other items;

(4) Besieging referees, athletes or other staff members;

(five) throwing debris into the venue, not listening to stop; (six) other acts that disrupt the order of large-scale mass activities.

I. Conditions of detention:

1. Being prepared to commit a crime, committing a crime or being discovered immediately after committing a crime;

2. The victim or a witness on the spot identifies him as a criminal;

3. Found criminal evidence around or at the residence;

Two, the specific process of criminal detention is:

1. When carrying out detention, the public security organ shall hold a valid detention certificate and show it to the detained person.

2. After detention, the detained person shall be immediately sent to the detention center for custody, and shall not exceed twenty-four hours.

3. Under normal circumstances, the public security organ shall notify the family members of the detained person or their units within 24 hours.
