Measures of Shanghai Municipality on Social Assistance
In order to ensure the basic livelihood of urban and rural residents in this Municipality, help individuals or families overcome their difficulties in life, maintain social stability and promote social progress, these Measures are formulated according to the actual situation of this Municipality. Article 2 (Definitions)
The term "social assistance" as mentioned in these Measures refers to the social security system in which government departments and relevant units share the responsibility and provide necessary material assistance to urban and rural residents in this city whose living standard is lower than the minimum living standard. Article 3 (Principles of Social Assistance)
To carry out social assistance work, we should follow the principle that the level of assistance should be adapted to the level of economic construction and social development, and that social assistance should be combined with statutory maintenance, support and upbringing to promote the self-help and self-reliance of the recipients. Article 4 (Competent Authority)
Shanghai Municipal Civil Affairs Bureau (hereinafter referred to as the Civil Affairs Bureau) is in charge of social assistance in this Municipality.
The district and county civil affairs departments shall be responsible for the organization and implementation of social assistance work within their respective administrative areas. Article 5 (Responsibilities of Relevant Departments)
Sub-district offices and Township People's governments are responsible for the specific implementation of social assistance work under the guidance of district and county civil affairs departments.
The relevant departments of the people's governments at all levels in this Municipality shall, in accordance with the division of responsibilities, assist the civil affairs departments to carry out social assistance work.
Social organizations or organizations engaged in social assistance activities shall, in accordance with their respective articles of association, cooperate with the civil affairs departments to do a good job in social assistance. Article 6 (Responsibilities of Units)
Enterprises, institutions, organs, social organizations and other organizations shall, in accordance with the provisions of these measures, do a good job in social assistance for their employees and their families. Article 7 (Right to apply for social assistance)
All urban and rural residents with household registration in this Municipality have the right to apply for social assistance and get material help in accordance with these measures when their personal or family living standards are lower than the minimum living standard. Article 8 (Principles for Determining the Minimum Living Standard)
To determine the minimum living standard, we should comprehensively refer to the following factors:
(a) The actual living standard per capita in society;
(two) the expenses necessary to maintain the minimum living standard;
(3) price index;
(four) the level of economic development and financial situation. Article 9 (Determination and Adjustment of Minimum Living Standard)
The minimum living standard shall be formulated by the Municipal Civil Affairs Bureau in conjunction with relevant departments in accordance with the principle of distinguishing between urban and rural areas and regions, and shall be promulgated and implemented after being approved by the Municipal People's Government.
The minimum living standard should be adjusted according to the actual situation. Article 10 (Conditions for Applying for Social Assistance)
Individuals or families who have one of the following circumstances and whose property is within a certain limit may apply for social assistance:
(a) the individual has no ability to work, no source of income, no legal maintenance obligor or has been unable to support;
(two) although individuals or family members have income, but the per capita income is lower than the minimum living standard.
The family members mentioned in the preceding paragraph of this article refer to people who have legal maintenance, support and support relationships and live together.
Individuals or householders and their spouses who refuse employment opportunities introduced by the labor department without justifiable reasons while enjoying unemployment insurance benefits, or who are legally stopped from enjoying unemployment insurance benefits during enjoying unemployment insurance benefits, cannot apply for social assistance. Article 1 1 (income composition of individuals and family members)
The income of individuals and family members mentioned in Item (2) of Paragraph 1 of Article 10 of these Measures includes the following contents:

(4) Other income. Article 12 (Application)
Individuals or families in need of social assistance under the circumstances listed in the first paragraph of Article 10 of these Measures may apply for social assistance to the neighborhood offices or township and town people's governments where their household registration is located. Article 13 (Form and Content of Application)
An individual or family applying for social assistance shall state the reasons for the application in writing, truthfully fill in the relevant information of the individual or family, and provide relevant certification materials when necessary. Article 14 (Verification of Application Contents)
Sub-district offices or township and town people's governments shall, within 10 days from the date of receiving the application for social assistance, verify the relevant information declared by the applicant and the actual living standard of the applicant's individual or family.
Sub-district offices or township and town people's governments may also entrust the residents' committees or villagers' committees where the applicant's household registration is located to conduct verification within the time limit specified in the preceding paragraph of this article. Article 15 (Examination and Approval)
Sub-district offices or township and town people's governments shall make a decision of approval or disapproval within 5 days after verification. If the decision is approved, it shall be reported to the district and county civil affairs departments for the record; If it decides not to approve, it shall notify the applicant in writing and explain the reasons. Article 16 (Execution of Approval Decision)
Individuals or families who have been approved to give social assistance shall be given social assistance by the neighborhood offices or the people's governments of townships and towns in accordance with the provisions of these measures, except in the circumstances specified in the second paragraph of this article.
If an individual or family that has been approved to give social assistance is an employee of an enterprise, institution, organ or social organization (hereinafter referred to as a unit), the subdistrict office or the people's government of a township or town shall inform the unit to which it belongs in writing of the approval decision, and the unit to which it belongs shall give social assistance in accordance with the provisions of these Measures.
