Regulations of Guiyang Municipality on Community Drug Rehabilitation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Anti-drug Law of People's Republic of China (PRC), the Regulation on Drug Rehabilitation and other laws and regulations, combined with the actual situation of this Municipality, in order to standardize the community drug rehabilitation and community rehabilitation, help drug addicts to get rid of drug addiction, recover their health and integrate into society, maintain social order and promote social construction. Article 2 These Regulations shall apply to community drug rehabilitation and community rehabilitation (hereinafter referred to as community drug rehabilitation) and related service management activities within the administrative area of this Municipality.

The term "community drug rehabilitation" as mentioned in these Regulations refers to the drug rehabilitation measures taken by the township (town) people's government and community service management institutions according to the decision of the public security organs for drug addicts who have not yet constituted the conditions for compulsory isolation and drug rehabilitation.

Article 3 Community drug rehabilitation work should follow the principles of humanistic care, scientific drug rehabilitation, comprehensive correction and assistance, implement the working mechanism of unified leadership, government responsibility, departmental coordination and social participation, and build a working model of drug rehabilitation, psychological correction, physical rehabilitation, education and training, social security, employment support and entrepreneurial support. Article 4 The people's governments at or above the county level shall incorporate the community drug rehabilitation work into the national economic and social development plan and the government target performance appraisal, and the required funds shall be included in the fiscal budget at the corresponding level and classified guarantee shall be implemented. Fifth people's governments at all levels are mainly responsible for the first person in charge of community drug rehabilitation work in this administrative region; The main person in charge of the community service management institution is the first responsible person in the community drug rehabilitation work in this area.

The anti-drug committee at or above the county level shall organize, coordinate, supervise and guide the community drug rehabilitation work within its jurisdiction.

The member units of the Narcotics Control Committee shall incorporate the community drug rehabilitation work into the annual work plan of this department, and do a good job in community drug rehabilitation work according to their respective responsibilities. Article 6 It is forbidden for any unit or individual to insult, corporal punishment, abuse or condone others to insult, corporal punishment or abuse community drug rehabilitation personnel.

Community drug addicts and their family members are not discriminated against in enrollment, employment, entrepreneurship and social security. Article 7 The personal information of community drug rehabilitation personnel shall be kept confidential according to law. Chapter II Duties of Departments and Institutions Article 8 The Narcotics Control Committee shall perform the following duties in community drug rehabilitation:

Formulate work plans, annual plans and relevant policies and measures;

(two) the establishment and implementation of the seamless working mechanism;

Formulate performance appraisal and accountability measures for work objectives;

(four) to inspect, supervise and guide the completion of related tasks, and organize the performance appraisal of work objectives;

To study and solve major problems and release relevant information;

(six) regularly listen to relevant work reports. Article 9 Public security organs shall perform the following duties in community drug rehabilitation:

(1) Ordering the community to give up drugs according to law, and informing them of the relevant regulations that they should abide by;

(two) registration, management and drug testing of community drug rehabilitation personnel;

(three) to cooperate with the relevant departments to supervise and manage the drug rehabilitation medical institutions, drug maintenance treatment institutions and public welfare drug rehabilitation places organized by social forces according to law;

(four) the safety management of the special area set up by medical institutions to treat sick and disabled drug addicts;

(five) to guide, support and participate in community drug rehabilitation work.

The police station shall establish a linkage working mechanism with the township (town) people's government and community service management institutions in this area to strengthen the control and connection of community drug addicts. Tenth judicial administrative departments shall perform the following duties in the community drug rehabilitation work:

(1) Organizing legal publicity and education;

(two) to provide legal aid to eligible community drug addicts;

(three) to guide the behavior correction of community drug rehabilitation personnel;

(four) to guide the medical institutions and social forces to run the public welfare drug rehabilitation places in accordance with the law. Eleventh civil affairs departments shall perform the following duties in the community drug rehabilitation work:

Guide the construction and standardized operation of socialized drug rehabilitation stations;

(II) In accordance with the provisions, eligible community drug rehabilitation personnel and their family members will be included in the minimum living security, support for destitute people, medical assistance or temporary assistance;

(three) to guide and support social service institutions to provide professional services for community drug rehabilitation personnel. Twelfth human resources and social security departments shall perform the following duties in the community drug rehabilitation work:

(a) the implementation of community drug rehabilitation personnel employment support and entrepreneurship support policies;

(2) Organizing the vocational skills training and appraisal of community drug rehabilitation personnel;

(three) to provide social insurance services for community drug rehabilitation personnel in accordance with the regulations, and to give social insurance subsidies to qualified personnel. Thirteenth health authorities shall perform the following duties in the community drug rehabilitation work:

(a) in conjunction with the relevant departments, formulate the planning for the establishment of drug rehabilitation medical institutions, drug maintenance treatment institutions and their extended drug use points;

Organize the implementation, supervision and management of drug maintenance treatment;

(3) Organizing and coordinating medical institutions to set up special areas for treating sick and disabled drug addicts;

(four) to organize and coordinate medical institutions to set up branches in qualified drug rehabilitation places to provide medical services for drug addicts.
